[00:00:10 --> 00:00:16] It is my pleasure to welcome the members of the Empire County Board of Supervisors and Cities. [00:00:16 --> 00:00:20] And thank you for volunteering your time to start this community. [00:00:20 --> 00:00:28] At this time I will call the meeting to order. The time is 6.02pm on September 17, 2025. [00:00:28 --> 00:00:32] We will begin with item number two, our older bosses. [00:00:32 --> 00:00:37] In front of you, you will find a sheet that has the oath of office. [00:00:37 --> 00:00:45] I will be reading the top portion of the oath, and then the bottom portion will be read by each committee member. [00:00:45 --> 00:00:47] We will do this all together. [00:00:47 --> 00:00:55] You will say your name when it's asked for, and we will stand up, raise our right hand, and proceed with the oath of office. [00:00:55 --> 00:01:01] Once you complete the oath of office, we could take a moment and then take a couple of pictures [00:01:01 --> 00:01:04] and then moving forward with your agenda. [00:01:04 --> 00:01:12] So at this time if you could please stand. [00:01:12 --> 00:01:14] Again I will read the top version of the old [00:01:14 --> 00:01:15] with my right hand right side [00:01:15 --> 00:01:18] and you guys will read the form, [00:01:18 --> 00:01:19] bottom person of the page, [00:01:19 --> 00:01:22] those with your right hand right side. [00:01:22 --> 00:01:24] Ready? [00:01:24 --> 00:01:26] I, said Yamadina, [00:01:26 --> 00:01:27] clerk of the board of supervisors, [00:01:27 --> 00:01:29] and the county of the material, [00:01:29 --> 00:01:31] state of California, [00:01:31 --> 00:01:33] junior vice-certified, [00:01:33 --> 00:01:35] that the members of the Davis Center, [00:01:35 --> 00:01:36] the advisory committee, [00:01:36 --> 00:01:39] were appointed to act an office of member [00:01:39 --> 00:01:43] as appears by the records instead of for now in my custody. [00:01:43 --> 00:01:51] In fact, they're July 14th, 2020. [00:01:51 --> 00:02:22] Thank you. [00:02:22 --> 00:02:26] Congratulations, you are now sworn in to be committee members [00:02:26 --> 00:02:28] for the 20 days of the Center of Administration. [00:02:28 --> 00:02:42] Please stand up and welcome to the picture. [00:02:42 --> 00:02:51] Thank you. [00:02:51 --> 00:02:53] All right, everyone looking at this phone. [00:02:53 --> 00:02:54] Three, two, one. [00:02:54 --> 00:02:56] I'll see you on the one. [00:02:56 --> 00:02:57] Three, two, one. [00:02:58 --> 00:03:01] Thank you so much. [00:03:01 --> 00:03:05] Committee members, we do have one arrival [00:03:05 --> 00:03:06] at Pixel 5 fan. [00:03:06 --> 00:03:10] Mr. Hamley, please stay up and do your starting in. [00:03:10 --> 00:03:13] You have a form in front of you. [00:03:13 --> 00:03:17] I will lower the remaining top portion of the oath [00:03:17 --> 00:03:26] and we will rate the bottom portion of the oath. [00:03:26 --> 00:03:30] If these two race to the right hand and I will go first. [00:03:30 --> 00:03:34] I said to the board of supervisors [00:03:34 --> 00:03:37] and the county of Ontario, state of California, [00:03:37 --> 00:03:39] to hear my service life that Mark County [00:03:39 --> 00:03:41] was appointed to act an office as member [00:03:41 --> 00:03:44] of the Ontario County Data Center and advisory committee [00:03:44 --> 00:03:46] as a peer-spendure efforts that set board [00:03:46 --> 00:03:52] now in my custody, as I get the live fortune to fight my guts. [00:03:52 --> 00:03:59] I'm Henry Salmon Square, a firm, full support [00:03:59 --> 00:04:01] of the Constitution of the United States [00:04:01 --> 00:04:03] on Constitution and State California. [00:04:03 --> 00:04:06] So that would be more in the best of my little courage [00:04:06 --> 00:04:08] with any kind of agents. [00:04:08 --> 00:04:10] Constitution and State California [00:04:10 --> 00:04:12] that I do take the obligation to believe [00:04:12 --> 00:04:15] that in the general administration of the purpose [00:04:15 --> 00:04:18] of the nation, that I will make it as well [00:04:18 --> 00:04:20] We have English choice on English one, [00:04:20 --> 00:04:24] which one is about two, three. [00:04:24 --> 00:04:26] We just have graduations. [00:04:26 --> 00:04:36] If everyone can sign her out, [00:04:36 --> 00:04:38] and then I will take care of that. [00:04:38 --> 00:04:47] We will continue with item number three, [00:04:47 --> 00:04:50] our roll call. [00:04:50 --> 00:04:53] Henry Christ, John Hop, [00:04:53 --> 00:04:55] Mark Tandy, [00:04:55 --> 00:04:57] and Michelle Hologen. [00:04:57 --> 00:05:00] Longio Brigal Virginia. [00:05:00 --> 00:05:02] Kristen Michelle Salado. [00:05:02 --> 00:05:05] Andrew Schwartz. [00:05:05 --> 00:05:06] Here. [00:05:06 --> 00:05:08] Chalita Kay Edwards. [00:05:08 --> 00:05:09] Here. [00:05:09 --> 00:05:10] Marjorie E. Muckin. [00:05:10 --> 00:05:12] Just want to make that correction. [00:05:12 --> 00:05:14] Marjorie E. Muckin. [00:05:14 --> 00:05:18] Oli Bucci. [00:05:18 --> 00:05:19] absent. [00:05:19 --> 00:05:20] Sandy Fanau. [00:05:20 --> 00:05:21] Here. [00:05:21 --> 00:05:23] Jeffrey Nell. [00:05:23 --> 00:05:24] Here. [00:05:24 --> 00:05:24] John Brab. [00:05:24 --> 00:05:26] Here. [00:05:26 --> 00:05:27] He's at the Marzana. [00:05:27 --> 00:05:28] Here. [00:05:28 --> 00:05:29] Michael William. [00:05:29 --> 00:05:30] Here. [00:05:30 --> 00:05:31] Uncle Edmonds. [00:05:31 --> 00:05:32] Here. [00:05:32 --> 00:05:33] Mike Goodsell. [00:05:33 --> 00:05:34] Here. [00:05:34 --> 00:05:35] Dennis Merida. [00:05:35 --> 00:05:36] Here. [00:05:36 --> 00:05:37] Thank you. [00:05:37 --> 00:05:46] present and we may proceed with tonight's meeting. [00:05:46 --> 00:05:48] As the Shumpton Committee's inaugural meeting tonight [00:05:48 --> 00:05:51] presented, we'll focus on getting the committee established, [00:05:51 --> 00:05:53] including with the oath of office, [00:05:53 --> 00:05:56] introductions and overview of the committee's [00:05:56 --> 00:05:58] purpose and responsibilities, [00:05:58 --> 00:06:01] from our requirements and establishing future meetings, [00:06:01 --> 00:06:04] dates and location. [00:06:04 --> 00:06:06] At this time, I will ask Mr. Angela Shurks [00:06:06 --> 00:06:08] to conduct our pleasure meeting. [00:06:08 --> 00:06:11] Please rise if you will be absent. [00:06:11 --> 00:06:13] We'll be back in a minute. [00:06:13 --> 00:06:18] Let the nations to abide by the United States of America. [00:06:18 --> 00:06:23] And to the republic for which it stands, one nation under God, [00:06:23 --> 00:06:27] indivisible, with liberty and justice for all. [00:06:27 --> 00:06:37] We will now move to item number five, public comment. [00:06:37 --> 00:06:43] The committee will follow the same general public structure as the board of superwriters. [00:06:43 --> 00:06:46] We will chivalry 30 minutes for public comment at this time. [00:06:46 --> 00:06:53] members of the public will be given an opportunity to address the committee matters [00:06:53 --> 00:07:01] of the committee's jurisdiction. If additional time is needed for public comment, the committee may provide additional time at the end of the meeting. [00:07:01 --> 00:07:12] When your name is called, please come forward to the lesson made of public comment area and state your name for the record, which will be the microphone for the open center. [00:07:12 --> 00:07:15] Please stare at your comments to the committee as a whole. [00:07:15 --> 00:07:18] The committee may listen to your comments [00:07:18 --> 00:07:22] while I engage in discussion or take action on matters [00:07:22 --> 00:07:25] that are not listed on the agenda. [00:07:25 --> 00:07:27] Please allow me to read the public comment [00:07:27 --> 00:07:32] as stated on the public comment split. [00:07:32 --> 00:07:34] Please remember to follow the public comment [00:07:34 --> 00:07:36] for the comment, no profanity or insanity, [00:07:36 --> 00:07:38] yelling or screaming, no slander [00:07:38 --> 00:07:42] or defamatory statements, personal threats or attacks. [00:07:42 --> 00:07:45] Okay, four, we're demanding language based on hate. [00:07:45 --> 00:07:48] On hate of a person's race, community, religion, [00:07:48 --> 00:07:52] sexual orientation, ethnicity, gender, or disability. [00:07:52 --> 00:07:55] Respect all people that are present and watching. [00:07:55 --> 00:08:01] Obey the direction of the chat and talk to the board. [00:08:01 --> 00:08:03] At this time I will open the board for public comment. [00:08:03 --> 00:08:10] I do have a couple of switch. [00:08:10 --> 00:08:12] First speaker is Susan Parade. [00:08:20 --> 00:08:24] Good evening committee, good evening, Ms. Mamadi. [00:08:24 --> 00:08:26] My name is Susan Carrar-Pheragus. [00:08:26 --> 00:08:29] I reside in El Centro, California now. [00:08:29 --> 00:08:30] I'm recently moved. [00:08:30 --> 00:08:35] I just want to take this opportunity [00:08:35 --> 00:08:39] to thank you all for coming to this tough matter, [00:08:39 --> 00:08:43] for being willing to problem solve this, [00:08:43 --> 00:08:48] patent find, and better our community. [00:08:48 --> 00:08:51] Because I feel that's the end result. [00:08:51 --> 00:08:56] I'm a big proponent of having this committee [00:08:56 --> 00:09:01] and problem solved the situation in May for better. [00:09:02 --> 00:09:06] So I just want you to know that I support you [00:09:06 --> 00:09:11] my only request in anything, [00:09:11 --> 00:09:14] any fines that come up this committee [00:09:14 --> 00:09:19] is that when reports are put out [00:09:19 --> 00:09:23] that everything be listed, pros and cons. [00:09:23 --> 00:09:27] And my reason for that is I have seen many projects [00:09:27 --> 00:09:31] being presented towards, and it was all the great things, [00:09:31 --> 00:09:34] the money that's coming in, how it's gonna be done, [00:09:34 --> 00:09:38] but never once are there, we could face these obstacles. [00:09:38 --> 00:09:42] And so my request is that you put it all out there [00:09:42 --> 00:09:44] for whole purposes transparency [00:09:44 --> 00:09:48] and let the chips fall where they fall. [00:09:48 --> 00:09:52] This is volunteer and it's a big job. [00:09:53 --> 00:09:59] So I'm gonna speak to the community, [00:09:59 --> 00:10:01] people that are here, thank you so much. [00:10:01 --> 00:10:04] I'm a big supporter and advocate of this, [00:10:04 --> 00:10:07] but I'm gonna ask our community [00:10:07 --> 00:10:12] to give this committee a chance to do some work. [00:10:12 --> 00:10:17] I'm gonna ask this community to be respectful [00:10:17 --> 00:10:19] of their roles as assistance volunteer, [00:10:19 --> 00:10:24] especially on social media, please give them a chance [00:10:24 --> 00:10:28] to do work and if you don't agree with the findings [00:10:28 --> 00:10:30] or you do agree or you have input, [00:10:30 --> 00:10:34] respectfully write to whomever you wish [00:10:34 --> 00:10:36] and say I'm concerned about this [00:10:36 --> 00:10:37] or I'd like to address this [00:10:37 --> 00:10:39] or have you thought about that. [00:10:39 --> 00:10:44] But we're at the point now where this board, [00:10:44 --> 00:10:49] The county board of supervisors is listening, [00:10:49 --> 00:10:51] they've heard, they're taking steps, [00:10:51 --> 00:10:53] and that needs to be acknowledged, [00:10:53 --> 00:10:56] and one of those is through this committee. [00:10:56 --> 00:11:00] And so I just ask our community as a whole, [00:11:00 --> 00:11:02] whether you like someone or don't, [00:11:02 --> 00:11:06] just give this committee an opportunity [00:11:06 --> 00:11:12] to get some real work done and give you some results. [00:11:12 --> 00:11:15] For memory, for all of us, [00:11:15 --> 00:11:19] that this is for the betterment of our balance. [00:11:19 --> 00:11:19] Thank you. [00:11:19 --> 00:11:21] Have a good evening. [00:11:21 --> 00:11:22] Thank you, Ms. Davis. [00:11:22 --> 00:11:33] Our next speaker is Robert Cowan. [00:11:33 --> 00:11:35] Good evening, committee members. [00:11:35 --> 00:11:37] I want to start out by thanking you all very much [00:11:37 --> 00:11:38] for setting up for your community. [00:11:38 --> 00:11:42] It's just awesome that we agreed to do this. [00:11:42 --> 00:11:44] I want to suggest to you that your task [00:11:44 --> 00:11:49] in this committee should not be to find guidelines [00:11:50 --> 00:11:53] where for what a data center needs to do [00:11:53 --> 00:11:54] or where they need to be located. [00:11:54 --> 00:11:58] Your task first should be whether data signals belong at all in the period of time. [00:11:58 --> 00:12:01] That should be the very first thing that you determine. [00:12:01 --> 00:12:04] Please take a hard look at the potential impacts. [00:12:04 --> 00:12:09] If you do indeed determine as a group that there could be some American data somewhere, [00:12:09 --> 00:12:11] then please pay attention in the details. [00:12:11 --> 00:12:14] Don't forget the lithium ion battery storage systems that come with these. [00:12:14 --> 00:12:20] The fact that there was a lithium ion battery storage system fire in San Diego [00:12:20 --> 00:12:26] took 17 days to extinguish and it was the same kind of facility that was [00:12:26 --> 00:12:30] previously to be located right next to millions of gallons of gasoline so please [00:12:30 --> 00:12:35] keep those impacts in mind it's a safer duty to serve [00:12:35 --> 00:12:39] community so please keep your community in mind you're not here to carry out the [00:12:39 --> 00:12:42] agenda of any board members or any senior county leadership in fact I [00:12:42 --> 00:12:45] it's probably too late to make this comment I don't believe that there [00:12:45 --> 00:12:49] should be any board members on this committee I think that's a mistake [00:12:49 --> 00:12:53] But keep in mind that you're not here to carry out their agenda. [00:12:53 --> 00:12:56] You're here to carry out the people's agenda. [00:12:56 --> 00:12:58] So please keep that in mind. [00:12:58 --> 00:13:01] One last thing, if you decide on a chairman, [00:13:01 --> 00:13:05] please do not vote a board member as a chairman of this committee. [00:13:05 --> 00:13:07] That would be hiding the problem. [00:13:07 --> 00:13:10] And once again, I want to thank you very, very much for stepping up. [00:13:10 --> 00:13:13] This is just awesome that you've agreed to do this. [00:13:13 --> 00:13:15] Sandy, it's nice to see you again. [00:13:15 --> 00:13:17] Margaret, nice to see you. [00:13:17 --> 00:13:20] Thank you very much. [00:13:20 --> 00:13:29] Thank you Mr. Cole. Our next speaker is Jake Tyson. [00:13:29 --> 00:13:33] Hi committee. I'm Jake Tyson, the resident of El Sesto Born and Wraith. [00:13:33 --> 00:13:38] What do you know? I'm not a fan of the Hyperscale AI data center. [00:13:38 --> 00:13:42] So I oppose Hyperscale AI data centers in the Federal Valley. [00:13:42 --> 00:13:45] And I oppose selecting Peggy Price as chair of this committee. [00:13:45 --> 00:13:48] Mr. Tyson, the item is on the agenda please. [00:13:48 --> 00:13:51] Okay. Public trust cannot be restored and handy. [00:13:51 --> 00:13:56] the gavals to someone who's [00:13:56 --> 00:13:59] on this project is already [00:14:00 --> 00:14:04] on the agenda. Okay. Okay. [00:14:04 --> 00:14:06] and committee members are you [00:14:06 --> 00:14:08] are responsible for your own [00:14:08 --> 00:14:09] votes. You can choose [00:14:09 --> 00:14:11] independent leadership and you [00:14:11 --> 00:14:13] can or you can insist that [00:14:13 --> 00:14:16] protecting residents confers [00:14:16 --> 00:14:18] reject the idea that our [00:14:18 --> 00:14:20] cultural community must [00:14:20 --> 00:14:26] facilities to have an economic future. Our farmland, water, neighborhoods and first responders [00:14:26 --> 00:14:34] deserve better than promises whose cost the public is expected to absorb. The community [00:14:34 --> 00:14:40] has been asking for months who pays for this infrastructure, who carries the emergency [00:14:40 --> 00:14:45] response burden, who answers when noise, generating emissions or water demands affect [00:14:45 --> 00:14:53] the people already living here. Promises of revenue are not answers. Your own [00:14:53 --> 00:14:58] governing document allows any other recommendations the committee determines [00:14:58 --> 00:15:04] appropriate. Put a prohibition on hyperspell data centers in unincorporated [00:15:04 --> 00:15:08] Imperial County on the next agenda. You only have till January 1st to get [00:15:08 --> 00:15:12] done and you're not going to have any time talking about land issues or zoning [00:15:12 --> 00:15:18] or any of that stuff, especially without CEQA. [00:15:18 --> 00:15:22] So the January deadline calls for findings and recommendations. [00:15:22 --> 00:15:28] It does not require you to find a developer's location for the development. [00:15:28 --> 00:15:32] So if public participation means anything, the public's demand to reject this development [00:15:32 --> 00:15:36] must receive a fair hearing. [00:15:36 --> 00:15:41] Choose a chair who can earn public confidence. [00:15:41 --> 00:15:47] Okay, regarding disclosure of developer contributions and put a ban before this committee. [00:15:47 --> 00:15:51] Our community's future is not owed to a developer. [00:15:51 --> 00:15:54] Your duty is to the people who live here. [00:15:54 --> 00:15:57] Thank you. [00:15:57 --> 00:15:58] Next speaker is Claudia Lomino. [00:15:58 --> 00:16:24] Shut me down. [00:16:24 --> 00:16:27] Just for clarification, this is general public comment. [00:16:27 --> 00:16:34] If it's anything on the agenda, I would like to ask that you wait until the I know that's being discussed. [00:16:34 --> 00:16:35] Okay. [00:16:35 --> 00:16:37] It's not an I just wait. [00:16:37 --> 00:16:38] It's not a general public comment. [00:16:38 --> 00:16:40] Is there anything on the agenda? [00:16:40 --> 00:16:45] What's on the agenda? [00:16:45 --> 00:16:49] We have a selection of offices. [00:16:49 --> 00:16:53] And we also have the location and time of the event. [00:16:53 --> 00:16:54] No. [00:16:54 --> 00:16:55] Go ahead. [00:16:55 --> 00:16:56] Thank you. [00:16:56 --> 00:16:57] Hello, everyone. [00:16:57 --> 00:17:01] My name is Salyala Mollerna and I am here today. [00:17:01 --> 00:17:05] With the Senate IDW569, we represent about 3,800 [00:17:05 --> 00:17:08] electricians throughout the Imperial and San Diego [00:17:08 --> 00:17:09] counties. [00:17:09 --> 00:17:14] We have officially been part of this community since the opening of our brick and mortar [00:17:14 --> 00:17:20] electrical training institute since 2012, but many of our members have been born and [00:17:20 --> 00:17:23] raised here and are now raising their families. [00:17:23 --> 00:17:27] We are looking forward to this committee starting their work on conducting research on the [00:17:27 --> 00:17:28] impacts of data centers. [00:17:28 --> 00:17:34] Many people throughout the county do not have time to devote to do their own research. [00:17:34 --> 00:17:38] As part of this committee, I ask you to bring the facts and verify studies on [00:17:38 --> 00:17:43] of data centers as a way to serve the people of your county. [00:17:43 --> 00:17:45] I would also suggest that the committee [00:17:45 --> 00:17:48] go and personally visit a data center. [00:17:48 --> 00:17:50] If you go and visit one that is getting built, [00:17:50 --> 00:17:55] you will see the way in which the fire suppression systems [00:17:55 --> 00:17:58] are installed, the amount of workers that are on site, [00:17:58 --> 00:18:00] both in the construction industry [00:18:00 --> 00:18:03] and other drops that data first provide. [00:18:03 --> 00:18:07] Thank you all for your dedication to this. [00:18:07 --> 00:18:08] and so on. [00:18:08 --> 00:18:10] At this time I've got no more public comments. [00:18:12 --> 00:18:17] Anyone else have any other comments? [00:18:17 --> 00:18:18] We will now move to item six, [00:18:18 --> 00:18:21] the crew of the order of the agenda. [00:18:21 --> 00:18:24] We'll have a motion to approve the order of the agenda. [00:18:24 --> 00:18:25] So, is that it? [00:18:25 --> 00:18:29] Is that it? [00:18:29 --> 00:18:31] Motion by Mr. Nian. [00:18:31 --> 00:18:33] And we'll start with Mr. Kessler. [00:18:33 --> 00:18:39] Mr. Forte, taking a roll call vote. [00:18:39 --> 00:18:42] Peggy Park, [00:18:42 --> 00:18:44] Zunga, [00:18:44 --> 00:18:45] Mark County, [00:18:45 --> 00:18:47] and Michelle Hollinger. [00:18:47 --> 00:18:48] Okay. [00:18:48 --> 00:18:49] We will be now, Regina. [00:18:49 --> 00:18:50] Yes. [00:18:50 --> 00:18:51] Christian Mitchell-Solo. [00:18:51 --> 00:18:53] Yes. [00:18:53 --> 00:18:54] Andrew Shorts. [00:18:54 --> 00:18:56] Yes. [00:18:56 --> 00:18:57] Sheila Kay-Evans. [00:18:57 --> 00:18:58] Yes. [00:18:58 --> 00:18:59] Marjorie E. Marker. [00:18:59 --> 00:19:00] Yes. [00:19:00 --> 00:19:01] Sandy Finnell. [00:19:01 --> 00:19:02] Yes. [00:19:02 --> 00:19:03] Jeffrey Nemez. [00:19:03 --> 00:19:04] Yes. [00:19:04 --> 00:19:05] John Graff. Yes. [00:19:05 --> 00:19:06] Yvette Roman-Banade. [00:19:06 --> 00:19:07] Yes. [00:19:07 --> 00:19:08] Michael Leigh-Anne. [00:19:08 --> 00:19:10] Yes. [00:19:10 --> 00:19:11] Anthony Hernandez. [00:19:11 --> 00:19:12] Yes. [00:19:12 --> 00:19:13] Mike Pitzel. Yes. [00:19:13 --> 00:19:14] And Dennis Marga. [00:19:14 --> 00:19:17] Yes. [00:19:17 --> 00:19:18] Moshe Pembe. [00:19:18 --> 00:19:24] Moving on to item seven, informational items. [00:19:24 --> 00:19:27] Items. [00:19:27 --> 00:19:29] This is 7A, overview, information of committee [00:19:29 --> 00:19:31] and approved by us. [00:19:31 --> 00:19:33] Before we proceed with the overview, [00:19:33 --> 00:19:36] I would like to ask each committee member [00:19:36 --> 00:19:38] to please introduce yourself. [00:19:38 --> 00:19:42] Let us know what sector or area you are representing [00:19:42 --> 00:19:45] and share what you hope to accomplish [00:19:45 --> 00:19:49] or what expectations you are, [00:19:49 --> 00:19:53] What are some things that you have to make up? [00:19:53 --> 00:19:58] We'll go ahead and start with Ms. Marjorie E. Marquez. [00:19:58 --> 00:20:04] We'll be having you here. [00:20:04 --> 00:20:07] Hello, my name is Marjorie Elizabeth Marquez, [00:20:07 --> 00:20:11] and I am representing education. [00:20:11 --> 00:20:15] And what I hope to gain being a part of this committee [00:20:15 --> 00:20:18] is just representing the community as a whole [00:20:18 --> 00:20:21] and defining what's gonna be best for our community [00:20:21 --> 00:20:28] with all the information that we're provided. [00:20:28 --> 00:20:30] Hello, good afternoon members of the public [00:20:30 --> 00:20:31] and the rest of the committee. [00:20:31 --> 00:20:33] My name is Christian Sondalo [00:20:33 --> 00:20:38] and I'm here representing the environmental expert position. [00:20:38 --> 00:20:39] Do you want us to provide a little bit [00:20:39 --> 00:20:41] of background of ourselves as well? [00:20:41 --> 00:20:43] So I work for the University of California [00:20:43 --> 00:20:45] Agricultural and Natural Resources. [00:20:45 --> 00:20:48] I am an environmental region operation specialist [00:20:48 --> 00:20:51] for the UC Master Gardener Program. [00:20:51 --> 00:20:53] So I oversee the management of a huge [00:20:53 --> 00:20:58] volunteer-based program over 6,000 volunteers in California that focuses on research-based [00:20:58 --> 00:21:04] knowledge and horticultural information as management, so in the ag sector, so to speak. [00:21:04 --> 00:21:09] So yeah, what do I hope to accomplish? Well, I hope to be able to hear and learn from [00:21:09 --> 00:21:15] each one of you and also move forward this topic that has been very contentious within [00:21:15 --> 00:21:19] our county and really come up with some solutions that we can work collaboratively [00:21:19 --> 00:21:23] together to solve. So that's a little bit about me. Thank you. [00:21:23 --> 00:21:31] I'm the representative for the city of Colexical and I hope that we are able to objectively [00:21:31 --> 00:21:37] look at evidence, ask the hard questions as we know that we're here because of the community [00:21:37 --> 00:21:42] first of all as they have made their voices clear that this is a one sort of development [00:21:42 --> 00:21:51] that they want accountability and answers to so hopefully that's what you guys think. [00:21:51 --> 00:21:57] Representative and the Board of Regents. [00:21:57 --> 00:21:59] I'm Ex-Vladimir Bihalma here as a public member. [00:21:59 --> 00:22:06] I'm just going to say with business degree, Army veteran, [00:22:06 --> 00:22:08] got certified as a hospital official administrator [00:22:08 --> 00:22:11] and pretty much in the medical field with 20 plus years. [00:22:11 --> 00:22:14] But part of that has been me always asking questions. [00:22:14 --> 00:22:16] I'm currently out of work as a laborer [00:22:16 --> 00:22:18] at 15th and 15th level 542. [00:22:18 --> 00:22:20] So that's one of the things that I have always been [00:22:20 --> 00:22:23] a true disbarred, I wanted to put the workforce there, [00:22:23 --> 00:22:25] but to ask them those questions as far as getting [00:22:25 --> 00:22:26] those hard answers. [00:22:26 --> 00:22:28] And this is one of the hardest things here in Valley [00:22:28 --> 00:22:32] I haven't been afraid to bring that up to the board to anybody [00:22:32 --> 00:22:33] you can forward. [00:22:33 --> 00:22:36] And I'm going to better expect myself [00:22:36 --> 00:22:41] to continue doing that moving forward. [00:22:41 --> 00:22:42] All right. [00:22:42 --> 00:22:43] I know the people in the back can't see me, [00:22:43 --> 00:22:44] so I wanted to stand up. [00:22:44 --> 00:22:45] Hello. [00:22:45 --> 00:22:46] Thank you all for joining us. [00:22:46 --> 00:22:48] Firstly, I want to congratulate each and everyone [00:22:48 --> 00:22:49] on your appointment. [00:22:49 --> 00:22:51] County supervisors are the cities. [00:22:51 --> 00:22:54] It's very great that we have a diverse group of people here. [00:22:54 --> 00:22:55] My name is Michael Llewellyn. [00:22:55 --> 00:22:59] I represent the City College of Patria, where I serve as mayor. [00:22:59 --> 00:23:02] I really do hope to learn from each and every one of you, [00:23:02 --> 00:23:04] hear your perspectives. [00:23:04 --> 00:23:06] At the end of the day, we represent different sectors, [00:23:06 --> 00:23:07] different governments. [00:23:07 --> 00:23:11] We have different ideas of what the future should hold [00:23:11 --> 00:23:12] for our children and grandchildren. [00:23:12 --> 00:23:15] So I really do appreciate you all coming [00:23:15 --> 00:23:16] and I look forward to the conversations [00:23:16 --> 00:23:21] while in the future. [00:23:21 --> 00:23:23] Dennis Morita, city manager of the city, [00:23:23 --> 00:23:25] co-present of Imperial. [00:23:26 --> 00:23:29] I think first of all, I wanna thank the county, [00:23:29 --> 00:23:30] none of us who'd be here, [00:23:30 --> 00:23:33] but for the actions taken by the county. [00:23:33 --> 00:23:38] And so I welcome the opportunity. [00:23:38 --> 00:23:44] I will say it's my experience that I always learn more [00:23:44 --> 00:23:46] when I'm listening than when I'm talking. [00:23:46 --> 00:23:49] And so it's my intention to do way more, [00:23:49 --> 00:23:50] I know what you think, [00:23:50 --> 00:23:54] I'm trying to do way more listening than talking. [00:23:55 --> 00:23:57] And I think the next item on the agenda [00:23:57 --> 00:23:59] is gonna be important, [00:23:59 --> 00:24:21] Because frankly, I don't know that it's realistic to think that in a few months we could come up with a recommendation to the board that dead centers have no place in the valley anymore than we could come up with a recommendation that is relocated next door to houses in the city. [00:24:21 --> 00:24:30] But what I hope we could accomplish is a structure that would allow for us to have answers. [00:24:30 --> 00:24:34] I've done a lot of reading of our data centers over the last year and a half. [00:24:34 --> 00:24:39] And what you could find whatever answer you're looking for. [00:24:39 --> 00:24:46] Are they noisy? Do the generators pollute? And you can, you'll find whatever answer it is. [00:24:46 --> 00:24:51] So my hope, maybe my target should be a bit higher, [00:24:51 --> 00:24:55] but my hope is that we can make recommendations [00:24:55 --> 00:25:01] to the calendar so that they can assess any industry. [00:25:01 --> 00:25:03] So everyone data centers, but in particular, [00:25:03 --> 00:25:04] we're here by data centers, [00:25:04 --> 00:25:08] that they can analyze data centers in a way [00:25:08 --> 00:25:12] and in an environment that they obtain all the information [00:25:12 --> 00:25:15] that is out there to be obtained [00:25:15 --> 00:25:18] for making a decision. [00:25:18 --> 00:25:24] Thank you for the opportunity to be here. [00:25:24 --> 00:25:26] Thank you, Dennis. [00:25:26 --> 00:25:27] Planting is Joe and Hawk. [00:25:27 --> 00:25:29] My background is in agriculture, I've [00:25:29 --> 00:25:35] spent at least 48 years in the end business. [00:25:35 --> 00:25:38] And I realize that representing the board of supervisors [00:25:38 --> 00:25:42] that are strong opinions about data standards. [00:25:42 --> 00:25:46] I also believe very strongly that our college should [00:25:46 --> 00:25:53] hold and be very respectful of each opinion around the stable and within the audience. [00:25:53 --> 00:26:00] Three things I would like to see, first of all, are my data centers to protect its residents. [00:26:00 --> 00:26:05] One of the things that we've heard loud and clear is that people need to feel safe in their homes. [00:26:05 --> 00:26:12] Number two, understand the impacts of land infrastructure and the resources within our county. [00:26:12 --> 00:26:19] As a grower, as a in the farming industry that is important to me as far as the water, [00:26:19 --> 00:26:23] the power, and taking care of our resource, the land that we have. [00:26:23 --> 00:26:27] I also would like to make sure that the public has a voice in this process. [00:26:27 --> 00:26:32] And seeing the number of people in the room gives me a pause for that, [00:26:32 --> 00:26:37] not pause, but gives me joy to know that everybody is involved. [00:26:37 --> 00:26:42] Another thing that I think is important is that there's collaboration. [00:26:42 --> 00:26:51] Last week's meeting on Tuesday, we saw collaboration in my mind that was very encouraging. [00:26:51 --> 00:27:00] Robert Powell made an addition to one of the updates in the ordinance to Jim Menick, our planning director, [00:27:00 --> 00:27:06] and it was well received and they both agreed that it should be added in the ordinance. [00:27:06 --> 00:27:11] And that's the kind of interaction I think we should have in the county. [00:27:11 --> 00:27:16] Not one of antagonism, not one of pointing out someone's faults and [00:27:16 --> 00:27:19] all the other things, but to work together. [00:27:19 --> 00:27:23] And so I am happy to be a part of this committee. [00:27:23 --> 00:27:24] I want to be a listener and [00:27:24 --> 00:27:28] want to do my part within the process. [00:27:28 --> 00:27:32] The other thing that I'd like to do and hear are experts in this field. [00:27:32 --> 00:27:37] And I think that's important that we have experts to come in and that we all are in the [00:27:37 --> 00:27:38] care. [00:27:38 --> 00:27:42] Hello everyone, my name is Mike Goodsell. [00:27:42 --> 00:27:45] I'm a councilman in the city of Oldville. [00:27:45 --> 00:27:51] This will be the beginning of, well, it's already been approved because no one met against [00:27:51 --> 00:27:52] me. [00:27:52 --> 00:27:57] So I'm going to start my fifth term in January on the council. [00:27:57 --> 00:28:02] I'm a recently retired 30 year educator in Imperial County. [00:28:02 --> 00:28:09] I serve regionally on the Southern California Association of Governments with John Grass [00:28:09 --> 00:28:15] and others from the county, and I serve also in the California Council of Governments. [00:28:15 --> 00:28:21] And so I know it's like to be in a room with a lot of folks trying to narrow down to decisions. [00:28:21 --> 00:28:26] And I know it can be difficult at times. [00:28:26 --> 00:28:30] But I don't see, I appreciate what Susan said at the beginning. [00:28:30 --> 00:28:37] Our role isn't to promote or to defeat the idea of data centers here. [00:28:37 --> 00:28:39] Our role is to find some facts. [00:28:39 --> 00:28:46] And I appreciate the point, and we should try both sides of each set of facts. [00:28:46 --> 00:28:50] That would be unfair and not transparent if we didn't. [00:28:50 --> 00:28:53] So that's what I hope to encourage us all to do. [00:28:53 --> 00:28:55] I encourage seeing who is in the room, [00:28:55 --> 00:29:03] and I encourage you all to represent the constituency that you are here to represent and that way we'll get a full [00:29:03 --> 00:29:08] area of what we need to pursue in our pursuit of those facts. Thank you. [00:29:08 --> 00:29:18] Most of you know me. I'm Haley Price. I'm the Imperial County Board of Supervisors for District 3. [00:29:18 --> 00:29:28] Currently a chairwoman on the board. I also want to thank everyone for being here tonight, both the public and all of you that have [00:29:28 --> 00:29:34] volunteer to take on this task. We have a lot of work to do. There is no deadline. [00:29:34 --> 00:29:43] If we need to go past January, we can go past January. I know that we are a [00:29:43 --> 00:29:48] center stage for many that are watching what's happening in Imperial [00:29:48 --> 00:29:55] County and I'm hoping that we can come to a place that those that are watching, [00:29:55 --> 00:30:02] whether it be local, state, federal, nationwide, whatever it is, is that they can see that [00:30:02 --> 00:30:12] we as a county can come together and work to find ways to come up with, you do the fact [00:30:12 --> 00:30:21] finding, do the work that we have a safe and responsible manner of which if there is [00:30:21 --> 00:30:30] a data center here or not that we can work together to develop those guidelines and those [00:30:32 --> 00:30:38] safeguards. And the other thing that I just want to say is that we're all equals here. [00:30:38 --> 00:30:44] All of us on this committee, there's no hierarchy. We'll have our chair, our vice chair, our [00:30:44 --> 00:30:50] secretary, but in this committee we're all equals and I hope that we can come together [00:30:50 --> 00:30:54] and collaborate and do the fact-finding, do the hard work, [00:30:54 --> 00:30:58] and bring back something that is beneficial [00:30:58 --> 00:31:00] to our entire county. [00:31:00 --> 00:31:04] Thank you. [00:31:04 --> 00:31:07] Michelle Lohlinger, Victoria Homes, [00:31:07 --> 00:31:11] building new homes in Imperial Valley for over 35 years. [00:31:13 --> 00:31:16] It came to my attention last year [00:31:16 --> 00:31:20] that a proposed data center was next to residents, [00:31:20 --> 00:31:24] 115 feet away. [00:31:24 --> 00:31:31] And pretty crazy to think that that could happen. [00:31:31 --> 00:31:35] I do wanna get into the facts of everything. [00:31:35 --> 00:31:37] I'm going to try to keep an open mind. [00:31:37 --> 00:31:41] I do have some questions about the bylaws [00:31:41 --> 00:31:45] and when I can ask those questions, [00:31:45 --> 00:31:49] because I know that they've already been approved. [00:31:49 --> 00:31:50] That is correct. [00:31:50 --> 00:31:53] The bylaws presented are approved by all of us. [00:31:53 --> 00:31:55] Are there questions that I can ask? [00:31:55 --> 00:31:57] There will be a section for you to ask. [00:31:57 --> 00:32:00] At this time it's an overview by Mayan. [00:32:00 --> 00:32:03] For the second, I would recommend to have [00:32:03 --> 00:32:06] those questions be asked to a more professional [00:32:06 --> 00:32:09] or a correct individual to answer your questions. [00:32:09 --> 00:32:11] Because tonight will be just an overview [00:32:11 --> 00:32:13] of what the five options is. [00:32:13 --> 00:32:14] Thank you for the review. [00:32:16 --> 00:32:19] I'm honored to be here with you all tonight [00:32:19 --> 00:32:23] and I look forward to educating myself [00:32:23 --> 00:32:24] and educating the public. [00:32:24 --> 00:32:28] Thank you. [00:32:28 --> 00:32:29] Your name's Angel Hernandez. [00:32:29 --> 00:32:32] I'm the Chief Executive Director for the Central Central [00:32:32 --> 00:32:35] and in that capacity I serve as the planning director [00:32:35 --> 00:32:38] for the city, so I'm just looking forward [00:32:38 --> 00:32:39] to working with everyone here in the group [00:32:39 --> 00:32:41] and the city members of the audience [00:32:41 --> 00:32:44] and everyone who has been in public comments. [00:32:45 --> 00:32:47] Hello, my name is Shinnia, [00:32:47 --> 00:32:48] I'm a resident in healthcare. [00:32:48 --> 00:32:50] I've been in the medical field [00:32:50 --> 00:32:52] for over 18 years. [00:32:52 --> 00:32:54] I've been passionate about my concerns, [00:32:54 --> 00:32:59] about the effects of the data center could bring to the valley. [00:32:59 --> 00:33:01] So I would be more tall [00:33:01 --> 00:33:03] if it was working collectively as a group [00:33:03 --> 00:33:05] to find parts of the facts that will either prove [00:33:05 --> 00:33:08] or disprove whether a data center belongs here. [00:33:08 --> 00:33:10] And I appreciate the county for agreeing [00:33:10 --> 00:33:13] to forming the committee. [00:33:13 --> 00:33:14] And I also appreciate the public [00:33:14 --> 00:33:17] because I believe they play a large part [00:33:17 --> 00:33:22] in the county agreeing to making this committee [00:33:22 --> 00:33:23] because of your voices. [00:33:23 --> 00:33:46] Hello, I'm Andy Schwartz. I represent organized labor in Imperial County that includes everybody from the workers in the fields all the way through healthcare, your law enforcement, and I'm also the president of the Imperial County Building and the Construction Trails Council. [00:33:46 --> 00:33:50] So I come from the building trades. [00:33:50 --> 00:33:55] I've been in the building trades as a heavy duty [00:33:55 --> 00:34:00] repairman for the last just over 40 years. [00:34:00 --> 00:34:04] My relatives were all in labor also. [00:34:04 --> 00:34:08] And I plan on answering any questions that I can, [00:34:08 --> 00:34:12] having to do with organized labor and with what [00:34:12 --> 00:34:15] we know about community benefits. [00:34:15 --> 00:34:18] And that's one of the things that we do in organized labor [00:34:18 --> 00:34:22] is make sure that there's community benefits that [00:34:22 --> 00:34:24] are addressed during these types of things. [00:34:24 --> 00:34:26] And thank you all for coming out. [00:34:26 --> 00:34:30] And I'm glad to be here. [00:34:30 --> 00:34:34] Sandy Fanel, I'm an ag business owner. [00:34:34 --> 00:34:38] I'm a resident of Northwest Imperial. [00:34:38 --> 00:34:43] My goal to be on this board is to research, learn, [00:34:43 --> 00:34:45] and hopefully advise appropriately. [00:34:45 --> 00:34:49] Did you have three major areas of concern? [00:34:49 --> 00:34:52] Agriculture depends on water. [00:34:52 --> 00:34:55] Water is a very scarce commodity from the valley, [00:34:55 --> 00:34:57] so that is one of my major concerns. [00:34:57 --> 00:35:00] Power and environmental impact. [00:35:00 --> 00:35:04] So hopefully we can learn a lot of information [00:35:04 --> 00:35:07] because most of us know very little. [00:35:07 --> 00:35:11] Thank you. [00:35:11 --> 00:35:13] Hi, my name is Jeffrey D. Miff. [00:35:13 --> 00:35:19] I would like to be the Energy Industry Committee member. [00:35:19 --> 00:35:21] I'd just like to thank the community [00:35:21 --> 00:35:24] for allowing me to serve on this committee. [00:35:25 --> 00:35:28] For myself, I've been doing renewable energy [00:35:28 --> 00:35:30] for the last 18 plus years. [00:35:30 --> 00:35:33] I've developed projects from California to Maine [00:35:33 --> 00:35:34] and most states in between. [00:35:35 --> 00:35:37] And like sitting in this committee, [00:35:37 --> 00:35:40] I've worked with a lot of communities over the years [00:35:40 --> 00:35:42] and addressing many of the same concerns [00:35:42 --> 00:35:44] that have been brought up here. [00:35:44 --> 00:35:47] So I welcome the opportunity to have these conversations [00:35:47 --> 00:35:52] and look forward to getting to the truth [00:35:52 --> 00:35:59] and working with the community to address your concerns. [00:35:59 --> 00:36:01] Good evening to fellow board members [00:36:01 --> 00:36:03] and members of the public. [00:36:04 --> 00:36:05] My name is John Grasse. [00:36:05 --> 00:36:08] I'm City Council for the City of Brawlin. [00:36:08 --> 00:36:13] And I'm also very grateful to have the opportunity [00:36:13 --> 00:36:17] the cylinders on this board, thank you to the supervisors [00:36:17 --> 00:36:19] to create this board. [00:36:19 --> 00:36:22] It's a great opportunity for us to delve into [00:36:22 --> 00:36:25] some very difficult, challenging issues [00:36:25 --> 00:36:28] and also to engage the public in likewise fashion. [00:36:30 --> 00:36:32] I've spent, I'm tired from the fear of [00:36:32 --> 00:36:35] feeling behavioral health, I spent over 35 years [00:36:35 --> 00:36:37] in the Louth field. [00:36:37 --> 00:36:41] One of the things that I learned over the years [00:36:41 --> 00:36:44] is that we can't really do much of anything [00:36:44 --> 00:36:49] without a good active or thorough assessment [00:36:49 --> 00:36:51] of what's going on, of all the facts, [00:36:51 --> 00:36:56] while we have concerns and issues that they before us. [00:36:57 --> 00:37:00] So we need to do a very thorough analysis [00:37:00 --> 00:37:02] of what's standing in front of us. [00:37:02 --> 00:37:04] So we have all the facts. [00:37:04 --> 00:37:06] I think we're all hungry for the facts. [00:37:06 --> 00:37:09] And at that point in time, we're in a much better position [00:37:09 --> 00:37:13] to be able to make some decisions about going forward. [00:37:13 --> 00:37:16] This is actually a very kind of exciting claim in a way [00:37:16 --> 00:37:19] because the landscape for technology [00:37:19 --> 00:37:22] is moving very quickly. [00:37:22 --> 00:37:25] It's a national debate, it's a statewide debate, [00:37:25 --> 00:37:27] there's laws that are being worked on [00:37:27 --> 00:37:30] in terms of addressing data centers. [00:37:30 --> 00:37:34] And so it is a good opportunity for us [00:37:34 --> 00:37:36] as residents of Imperial County to figure out [00:37:36 --> 00:37:40] what our relationship with this level of technology will be, [00:37:40 --> 00:37:44] what our relationship with AI will be, it will happen. [00:37:44 --> 00:37:48] And so I think that this is an exciting moment [00:37:48 --> 00:37:50] and I'm really excited to be here [00:37:50 --> 00:37:54] and that this cord will address this moment [00:37:54 --> 00:37:58] and come up with the facts to be able to deliver [00:37:58 --> 00:38:03] a usable, valuable product for the supervisors [00:38:03 --> 00:38:06] to make their decisions the day after tomorrow. [00:38:06 --> 00:38:14] So thank you very much for this opportunity. [00:38:14 --> 00:38:17] Thank you all for the introduction. [00:38:17 --> 00:38:19] I would like to introduce myself, [00:38:19 --> 00:38:22] Cynthia Medina, and the Board of Supervisors. [00:38:22 --> 00:38:27] As you may see, I am learning to 19 as I establish [00:38:27 --> 00:38:30] and do an overview for all advisory committees [00:38:30 --> 00:38:32] at the Board of Supervisors. [00:38:34 --> 00:38:37] Once a selection of officer is done, [00:38:37 --> 00:38:41] and then the main item is handover to the chair, [00:38:41 --> 00:38:48] I will be here for any questions, structure, or anything that you guys may be coming in [00:38:48 --> 00:38:51] and we'll be here for you to contact those who know the genders. [00:38:51 --> 00:38:55] But we will both be there as we decide on the answers. [00:38:55 --> 00:38:57] So we can decide. [00:38:57 --> 00:38:59] This is if you have any questions. [00:38:59 --> 00:39:00] Yes, absolutely. [00:39:00 --> 00:39:07] Okay, so I think with this group of many of us don't know each other. [00:39:07 --> 00:39:09] Many of us don't know each other. [00:39:09 --> 00:39:14] I'm wondering if I'd like to know who would be interrupted [00:39:14 --> 00:39:16] right before Chair or Vice Chair. [00:39:16 --> 00:39:20] Is that one of the parameters? [00:39:20 --> 00:39:23] Could we ask and know who is the president? [00:39:23 --> 00:39:25] We won't be discussing that on item eight, Miss Salah. [00:39:25 --> 00:39:27] I do have a little bit of a break on the explanation. [00:39:27 --> 00:39:32] So if we can wait for item eight and I can look at that. [00:39:32 --> 00:39:33] That would be good. [00:39:33 --> 00:39:36] Yes, I am. [00:39:36 --> 00:39:39] So at this time in the back of the period, [00:39:39 --> 00:39:43] You guys will find a resolution approved by the board [00:39:43 --> 00:39:48] on 16, 2026, 26 C, and it's the resolution [00:39:48 --> 00:39:50] of the Interpreter County Board of Supervisors [00:39:50 --> 00:39:53] establishing the data center advisory committee [00:39:53 --> 00:39:56] to advise regarding data centers, land use, [00:39:56 --> 00:40:01] zoning and policy options to the unimproperated areas [00:40:01 --> 00:40:02] of the interpreter county. [00:40:02 --> 00:40:05] This resolution is attached for your review. [00:40:05 --> 00:40:07] This is the establishment of the committee. [00:40:07 --> 00:40:10] but I would like to go over what I think committee [00:40:10 --> 00:40:12] are the bylaws. [00:40:12 --> 00:40:14] So the second document attached to your backup [00:40:14 --> 00:40:18] are the bylaws approved by the board of supervisors [00:40:18 --> 00:40:27] on June 14th, 2020. [00:40:27 --> 00:40:30] I will go ahead and start this with the overview. [00:40:30 --> 00:40:33] I will be reading the bylaws with you [00:40:33 --> 00:40:35] and if there are any questions, [00:40:35 --> 00:40:36] I will go ahead and take them and know them, [00:40:36 --> 00:40:40] but for the purpose of clarification [00:40:40 --> 00:40:43] if it's structure or it relates to the meeting structure, [00:40:43 --> 00:40:45] I will be more than glad to answer. [00:40:45 --> 00:40:48] If it's more in depth when it comes to charge, [00:40:48 --> 00:40:52] then I would ask for the committee to let me know [00:40:52 --> 00:40:53] and then we can melt down questions. [00:40:53 --> 00:40:55] And then for the next meeting, [00:40:55 --> 00:40:57] we can provide those individuals that will be able [00:40:57 --> 00:41:00] to fully answer your questions that you have [00:41:00 --> 00:41:04] in specific areas of their life. [00:41:04 --> 00:41:06] So I will go ahead and start. [00:41:06 --> 00:41:08] Starting with the name, the name of the committee [00:41:08 --> 00:41:11] shall be the data center advisory committee, [00:41:11 --> 00:41:14] The DCAC, and if I may, I will refer to it [00:41:14 --> 00:41:19] by its acronym, DCAC from here on. [00:41:19 --> 00:41:22] The purpose of the DCAC shall be to advise [00:41:22 --> 00:41:24] the board of supervisors on potential land use [00:41:24 --> 00:41:27] and zoning options relating to data permits [00:41:27 --> 00:41:30] developed in the unenquirberated areas [00:41:30 --> 00:41:33] of the Paracom. [00:41:33 --> 00:41:35] Again, I am three, the charge. [00:41:35 --> 00:41:38] This is the one where it might be specific questions [00:41:38 --> 00:41:39] if you have any on your phone [00:41:39 --> 00:41:42] and by the back of the next panel. [00:41:42 --> 00:41:45] This DCAC shall evaluate and provide recommendations [00:41:45 --> 00:41:48] to the board of supervisors regarding potential [00:41:48 --> 00:41:50] land use, zoning, and policy options [00:41:50 --> 00:41:52] relating to data center development [00:41:52 --> 00:41:55] in the unincorporated areas of Imperial County. [00:41:55 --> 00:41:58] In carrying out its charts, the DCAC [00:41:58 --> 00:42:00] shall evaluate and make recommendations [00:42:00 --> 00:42:01] regarding the following. [00:42:01 --> 00:42:06] A, potential amendments to the Imperial County General Plan. [00:42:06 --> 00:42:08] B, potential amendments to the Imperial County [00:42:08 --> 00:42:10] by ordinances. [00:42:10 --> 00:42:14] C, they use a specific class or the financials [00:42:14 --> 00:42:16] relating to location and regulation [00:42:16 --> 00:42:18] of data-centered development. [00:42:18 --> 00:42:21] D, the establishment of location or proximity standards [00:42:21 --> 00:42:24] relating to residential neighborhoods, schools, [00:42:24 --> 00:42:26] and other sensitive communities. [00:42:26 --> 00:42:29] E, the identification of areas that [00:42:29 --> 00:42:32] may be more appropriate for data-centered development [00:42:32 --> 00:42:35] based upon existing lineages, infrastructure, energy, [00:42:35 --> 00:42:39] resources and comfortability with surrounding issues. [00:42:39 --> 00:42:42] F, consideration of implementation options [00:42:42 --> 00:42:44] and the legal implications associated [00:42:44 --> 00:42:46] with any recommended amendments, [00:42:46 --> 00:42:49] including whether such amendments should apply [00:42:49 --> 00:42:53] prospectively only or illegally permissible [00:42:53 --> 00:42:55] to projects currently impossible. [00:42:55 --> 00:42:58] And D, any other recommendations [00:42:58 --> 00:43:01] to committee determinants of approval. [00:43:01 --> 00:43:04] The DCAC shall present its findings [00:43:04 --> 00:43:07] recommendations to the Board of Supervisors by January 1st, [00:43:07 --> 00:43:11] 2007 or as soon as they're after as they've been [00:43:11 --> 00:43:14] fully practical. [00:43:14 --> 00:43:18] The DCAC membership consists of 19 members. [00:43:18 --> 00:43:21] The members should be appointed by the Board of Supervisors [00:43:21 --> 00:43:24] unless otherwise indicated. [00:43:24 --> 00:43:27] The membership should be as follows. [00:43:27 --> 00:43:29] To members of the Board of Supervisors, [00:43:29 --> 00:43:31] seven members appointed by the seven [00:43:31 --> 00:43:34] incorporated cities within the County of Imperial [00:43:34 --> 00:43:37] with each city having one assignment. [00:43:37 --> 00:43:39] One representative from local government [00:43:39 --> 00:43:42] that is not an incorporated city. [00:43:42 --> 00:43:47] Two representatives of community interests. [00:43:47 --> 00:43:49] One representative from an environmental background [00:43:49 --> 00:43:51] or expertise. [00:43:51 --> 00:43:53] One representative from organized labor. [00:43:53 --> 00:43:56] One representative from health care community. [00:43:56 --> 00:43:59] One representative from the education community. [00:43:59 --> 00:44:02] One representative from non-profit organization. [00:44:02 --> 00:44:04] One representative from a business community. [00:44:04 --> 00:44:08] and I want to represent it from the Energy and Loose two section. [00:44:08 --> 00:44:10] At this time, we have one vacant position. [00:44:10 --> 00:44:14] City of Westmoreton has not provided their appointment, [00:44:14 --> 00:44:16] so just to have her still missing one member [00:44:16 --> 00:44:19] in the five-by-six department. [00:44:19 --> 00:44:21] Appointments in turn. [00:44:21 --> 00:44:24] Members of the DCAC are appointed by the Board of Supervisors [00:44:24 --> 00:44:27] except for the members representing the seven [00:44:27 --> 00:44:29] and incorporated cities, which will be appointed [00:44:29 --> 00:44:32] by the City Councils for those cities. [00:44:32 --> 00:44:34] The Board of Supervisors shall have a solo authority [00:44:34 --> 00:44:37] a terminal appointees for membership. [00:44:37 --> 00:44:40] A member may resign at any time by submitting [00:44:40 --> 00:44:43] a written resignation to the chair. [00:44:43 --> 00:44:47] The resignation shall be effective upon receipt [00:44:47 --> 00:44:50] unless a letter effective date is specified. [00:44:50 --> 00:44:52] Appointment straw and when the DCAC [00:44:52 --> 00:44:56] has accomplished its purpose and charges. [00:44:56 --> 00:44:56] Yes. [00:44:58 --> 00:45:02] Not a question but since we have two superwriters here, [00:45:02 --> 00:45:08] I would request that section 5B be either amended or moved entirely. [00:45:08 --> 00:45:20] If the city appoints a representative, it doesn't make sense that the court of supervisors has the sole authority to approve members of this committee. [00:45:20 --> 00:45:23] You have the authority to approve members of this committee. [00:45:23 --> 00:45:25] I wasn't appointed by the court of supervisors. [00:45:25 --> 00:45:26] I was appointed by the city. [00:45:26 --> 00:45:29] I would be a general on-stage in the case of the court of supervisors. [00:45:29 --> 00:45:34] And it should be councilor Davis to represent the court of supervisors. [00:45:34 --> 00:45:39] I think they answered your question. [00:45:39 --> 00:45:56] Mr. Lien, I'll go ahead and note down the request and then bring it up to the first person. [00:45:56 --> 00:46:01] Ms. Carras, do you mind if we end the, and that would be an opportunity for public comment? [00:46:01 --> 00:46:03] Perfect. Thank you. [00:46:03 --> 00:46:14] Okay, so if anyone else has any questions, so then we'll move to item six. [00:46:14 --> 00:46:20] officers this portion is important because today we you guys will be selecting your [00:46:20 --> 00:46:24] chair your life chair and your secretary [00:46:24 --> 00:46:36] I have a question about something that we're going to hear about, one of the items about the case. [00:46:36 --> 00:46:42] How do you also share this agreement with the supervisor, [00:46:42 --> 00:46:46] and also, can you share your comments on the readout? [00:46:46 --> 00:46:51] Right now, as it stands, we have a lot of 71 business things to come up with, [00:46:51 --> 00:46:59] the recommendations and the challenges. I think that the amount of things that we have to cover is quite frankly, under this thing. [00:46:59 --> 00:47:02] And if we continue as we are right now, [00:47:02 --> 00:47:04] then this is not going to be addressed [00:47:04 --> 00:47:06] unless the Worship Writers provide their own account. [00:47:06 --> 00:47:08] But who faces this? [00:47:08 --> 00:47:10] But as it stands, the January 1st, 2027, [00:47:10 --> 00:47:13] they've discounted the faith into the Bible. [00:47:13 --> 00:47:16] So I just want to flag that and make sure that [00:47:16 --> 00:47:18] either we extend that date, [00:47:18 --> 00:47:20] that the Worship Writers find it more appropriate [00:47:20 --> 00:47:22] for the three months, six months, [00:47:22 --> 00:47:23] or in indefinite terms. [00:47:23 --> 00:47:27] So we have a fully pledged response by this community, [00:47:27 --> 00:47:29] just so that we're not working in a rush, right? [00:47:29 --> 00:47:33] I think we're all here to get fully fleshed out answers [00:47:33 --> 00:47:34] for our community, that's our community [00:47:34 --> 00:47:36] is in that in front of us. [00:47:36 --> 00:47:40] So I think that we need to address that [00:47:40 --> 00:47:42] so that we're not working full speed [00:47:42 --> 00:47:44] and feel rushed to come to a certain termination [00:47:44 --> 00:47:47] by January 1st. [00:47:47 --> 00:47:49] Thank you, Mr. President. [00:47:49 --> 00:47:52] And I will pull up head and no head [00:47:52 --> 00:47:54] and bring it back the next meeting. [00:47:54 --> 00:47:56] Does my understanding that's January 1st [00:47:56 --> 00:47:58] or some thereafter I'll be doing it? [00:47:58 --> 00:48:01] But I will bring down the comments. [00:48:01 --> 00:48:06] Any other questions? [00:48:06 --> 00:48:09] No, I needed it. [00:48:09 --> 00:48:14] Or as soon as they're after, as recently as we'll be. [00:48:14 --> 00:48:25] But I will bring down. [00:48:25 --> 00:48:30] So then the officers for the CCAC shall be the chair, [00:48:30 --> 00:48:34] whose students should be to present at all DCAC meetings, [00:48:34 --> 00:48:37] service committees, folks person to the entire county [00:48:37 --> 00:48:41] or to supervisors, direct planning for community sessions, [00:48:41 --> 00:48:45] and presented planning to the Board of Supervisors. [00:48:45 --> 00:48:47] The Vice Chair will do this show fee [00:48:47 --> 00:48:51] to assist the Chair and and his or her absent [00:48:51 --> 00:48:52] serve as a chairperson. [00:48:52 --> 00:48:54] Assume the position of the chairperson [00:48:54 --> 00:48:59] in the event that chairperson leads the ECEAT. [00:48:59 --> 00:49:02] For the Secretary, the duty show fee [00:49:02 --> 00:49:03] to record minutes of all means, [00:49:03 --> 00:49:06] receive and transmit community correspondence [00:49:06 --> 00:49:08] and materials designated by numbers. [00:49:08 --> 00:49:10] Maintain a notebook of all minutes, [00:49:10 --> 00:49:13] the members correspondence and other information [00:49:13 --> 00:49:17] pertaining to the DAP. [00:49:17 --> 00:49:20] The chair, vice chair and secretary [00:49:20 --> 00:49:24] shall be elected at the DCAC's first regular meeting [00:49:24 --> 00:49:27] and shall serve until the DCAC has accomplished [00:49:27 --> 00:49:29] its purpose in charge. [00:49:29 --> 00:49:31] Vacancies in office shall be filled [00:49:31 --> 00:49:34] at the next regular meeting [00:49:34 --> 00:49:38] following the vacancy of an office. [00:49:38 --> 00:49:40] Are there any questions for this? [00:49:40 --> 00:49:47] I have questions on the secondary goals and responsibilities. [00:49:47 --> 00:49:54] Will there be support from the person taking minutes, recording, corresponding, will there [00:49:54 --> 00:49:56] be any official support? [00:49:56 --> 00:50:02] Seeing as this is a volunteer position, that seems like a lot of responsibility for an MP. [00:50:02 --> 00:50:03] Yes. [00:50:03 --> 00:50:08] For other advisory committees, the Director of the Board is a support committee. [00:50:08 --> 00:50:14] committee when it comes to minutes and agendas we do rely on the secretary for [00:50:14 --> 00:50:20] the committee we do the posting of the agenda we do the posting of the videos as [00:50:20 --> 00:50:27] this meeting will be recorded it will be posted as well but yes the secretary [00:50:27 --> 00:50:36] was in charge of agenda creation with the help of their chair and vice chair and then the court for the board is there for assistance and anything [00:50:36 --> 00:50:40] If for some reason the secretary cannot do the agenda, [00:50:40 --> 00:50:45] then of course the board comes in and will help the committee. [00:50:45 --> 00:50:46] Thank you for the clarification. [00:50:46 --> 00:50:49] Thank you. [00:50:49 --> 00:50:54] Any other questions? [00:50:54 --> 00:50:56] Speaking on the agenda, I mean it's in the recording [00:50:56 --> 00:50:59] that we're gonna, it's gonna be posted like post-emitting. [00:50:59 --> 00:51:04] Is there any moves or possible scenarios [00:51:04 --> 00:51:06] where we can make this accessible for like our Spanish [00:51:06 --> 00:51:08] if you can call me initially? [00:51:08 --> 00:51:10] I'm not sure. [00:51:10 --> 00:51:22] I can go ahead and look into that. [00:51:22 --> 00:51:26] We'll go ahead and move on to item seven, meeting. [00:51:26 --> 00:51:29] The meetings and proceedings of the DCAC [00:51:29 --> 00:51:32] shall be conducted in accordance with the RELP and Brown Act. [00:51:32 --> 00:51:36] The room in code section 5490. [00:51:36 --> 00:51:39] The DCAC shall meet as often as necessary [00:51:39 --> 00:51:43] to carry out its purpose in charge. [00:51:43 --> 00:51:45] Regular meetings shall be scheduled by the chair. [00:51:45 --> 00:51:48] In post-election with county staff, [00:51:48 --> 00:51:50] notice and attendance for regular meetings [00:51:50 --> 00:51:52] should be posted and distributed in accordance [00:51:52 --> 00:51:55] with the requirements of the RELF and Brown Act [00:51:55 --> 00:52:01] including at least 72 hours before the meeting. [00:52:01 --> 00:52:03] Special meetings may be called by the chair [00:52:03 --> 00:52:07] or by a majority of members in the DCAC. [00:52:07 --> 00:52:09] Notice of special meetings shall be provided [00:52:09 --> 00:52:11] in accordance with the RELF and Brown Act [00:52:11 --> 00:52:15] including at least 24 hours hour notice [00:52:15 --> 00:52:18] to each member and the public. [00:52:18 --> 00:52:22] All meetings of the DCAC shall be open to the public [00:52:22 --> 00:52:28] as other ones authorized by the law and should be held in facilities that are accessible to the public. [00:52:28 --> 00:52:32] Meeting agendas and notices should also be posted on the county's website. [00:52:32 --> 00:52:37] Meeting notices and agendas should identify the date, time and location of the meeting [00:52:37 --> 00:52:42] and should include a brief description of each item of assistance to be considered consistent with the [00:52:42 --> 00:52:45] broth and brown match. [00:52:45 --> 00:52:50] Upon the conclusion of my bibles, they are welcomed in training by our County Council staff [00:52:50 --> 00:52:56] council staff regarding the Brown Act and they have to just sort of ban the [00:52:56 --> 00:53:07] issue. It doesn't state anywhere the procedures of how you can put an item on to the agenda? [00:53:07 --> 00:53:16] We, I believe that when we do the training we can further discuss that portion [00:53:16 --> 00:53:28] with the nutrition of the agenda as our lens to the Brown Act. Today? Yes. Thank you. [00:53:28 --> 00:53:32] that the regular meeting shall be scheduled by the chair. [00:53:32 --> 00:53:37] Yet on our agenda item 8B is to select the meeting time. [00:53:38 --> 00:53:43] So I wonder what point it says that the chair [00:53:44 --> 00:53:48] will schedule the regular meetings. [00:53:48 --> 00:53:50] I wonder how that fits with the reason. [00:53:50 --> 00:53:51] I'll let her be. [00:53:51 --> 00:53:55] With on letter B, 8B, on our agenda [00:53:55 --> 00:53:59] is to select the meeting date and time. [00:53:59 --> 00:54:04] So if we do that, how does that fit with this charge [00:54:04 --> 00:54:09] in paragraph seven C where it says, [00:54:09 --> 00:54:23] we're going to read each of these people by the chair? [00:54:23 --> 00:54:24] I'm sorry, can I have a question on what [00:54:24 --> 00:54:27] the center's on, saying that then we're not. [00:54:27 --> 00:54:30] I have a B that says that we're going to [00:54:30 --> 00:54:33] place this board or committee is going to select [00:54:33 --> 00:54:37] the meeting date, time, and location. [00:54:37 --> 00:54:41] you just read under paragraph seven says, [00:54:41 --> 00:54:46] regular meeting shall be submitted by the chair. [00:54:46 --> 00:54:49] So yeah, so once you guys have a, [00:54:49 --> 00:54:51] once you guys select your officers, [00:54:51 --> 00:54:54] which is done, and please, we go back to [00:54:56 --> 00:54:59] the first portion of memetric, [00:54:59 --> 00:55:01] if you were selecting your officers [00:55:01 --> 00:55:04] in your first meeting, this is the first meeting, [00:55:04 --> 00:55:07] and then after that the chair will take over, [00:55:07 --> 00:55:10] and chair will be the one deciding all your meetings. [00:55:10 --> 00:55:12] And then your schedule, and I know what you're saying, [00:55:12 --> 00:55:17] but it's a discussion and the chair would be the one [00:55:17 --> 00:55:20] to proceed and schedule in those regular meetings. [00:55:20 --> 00:55:22] Okay, so what it said, so this committee [00:55:22 --> 00:55:25] isn't gonna be selecting? [00:55:25 --> 00:55:27] There will be a discussion, we need to, [00:55:27 --> 00:55:29] I believe what we need to know is the availability. [00:55:29 --> 00:55:33] It's a very big group, we need to know what date, [00:55:33 --> 00:55:35] so that maybe it's fair to take the action [00:55:35 --> 00:55:56] to select in that date. [00:55:56 --> 00:56:05] I'm recollecting that the ground act is out of the responsibility of the legislative body to set their own plan to a regular meeting. [00:56:05 --> 00:56:10] And so I don't want to waste time. [00:56:10 --> 00:56:13] I apologize for bringing it up. [00:56:13 --> 00:56:24] But if we're going to be in a day, what is the chair going to do about scheduling regular meetings in the near future? [00:56:24 --> 00:56:29] I think it's a very good point. [00:56:29 --> 00:56:31] Certainly the chair will be in charge [00:56:31 --> 00:56:32] of scheduling special meetings. [00:56:32 --> 00:56:36] I didn't intend on the agenda is to set a regular schedule [00:56:36 --> 00:56:38] for all future meetings. [00:56:38 --> 00:56:40] And then it does sound like something to comment [00:56:40 --> 00:56:43] is that the finalist will be looked at again. [00:56:43 --> 00:56:46] And I think that's a good section to take that piece out [00:56:46 --> 00:56:49] and discuss regular meetings being set [00:56:49 --> 00:56:51] by a regular schedule. [00:56:51 --> 00:56:53] Thank you. [00:56:53 --> 00:57:00] I have a question also under the area of meetings. [00:57:00 --> 00:57:03] I'm wondering if it's possible to have these meetings live through. [00:57:03 --> 00:57:07] We have a large public attending or either first meeting. [00:57:07 --> 00:57:11] If that was something possible, things could be live streamed. [00:57:11 --> 00:57:13] That would be very helpful. Thank you. [00:57:13 --> 00:57:18] Thank you. [00:57:18 --> 00:57:29] And again, there will be a training after I'm done with the [00:57:29 --> 00:57:34] by the council staff for burnings brown. [00:57:35 --> 00:57:42] And those that miss Michelle, I would be in second. [00:57:42 --> 00:57:45] I'm going forward to item eight, form and voting. [00:57:45 --> 00:57:50] 10 members of the DCAC shall consist of four. [00:57:50 --> 00:57:54] We accept as otherwise required by law or these by laws. [00:57:54 --> 00:57:56] And affirmative vote, it will open majority [00:57:56 --> 00:58:00] of the members present and voting at a meeting [00:58:00 --> 00:58:04] at which a form is present shall constitute [00:58:04 --> 00:58:06] and action of the DCAC. [00:58:06 --> 00:58:08] No official business shall be convicted [00:58:08 --> 00:58:11] in the absence of the form. [00:58:11 --> 00:58:14] Attendants, members are expected to attend [00:58:14 --> 00:58:16] all regular meetings and a member who is absent [00:58:16 --> 00:58:18] from three consecutive regular meetings [00:58:18 --> 00:58:20] without good cause may be recommended [00:58:20 --> 00:58:26] to the board of supervisors from the local DCAC. [00:58:26 --> 00:58:28] 10 committees, the DCAC may establish [00:58:28 --> 00:58:31] those committees or adult committees [00:58:31 --> 00:58:33] as it determines our necessary to carry out [00:58:33 --> 00:58:34] its charges. [00:58:34 --> 00:58:39] The appointments may be made by the Chair or on motion of any member of the committee. [00:58:39 --> 00:58:49] We each of the committees shall report its activity and recommendations to the DCAC at such times as the Chair may direct or the DCAC may require. [00:58:49 --> 00:59:02] And finally at their conversations appointments or the DCAC shall start without compensation. [00:59:02 --> 00:59:08] the attendance. Is that going to tie in to looking into when the force was [00:59:08 --> 00:59:12] going to run out of current degrees? Is that the force going to move? [00:59:12 --> 00:59:17] Are we going to address that also as a force? [00:59:17 --> 00:59:23] Hi, I'm going to type it out for you to live in test. [00:59:23 --> 00:59:30] Okay, at this time I will do all the new public comments. [00:59:30 --> 00:59:33] Can I have two questions? [00:59:33 --> 00:59:35] Yes, or you would have to come to the mic for some stage. [00:59:35 --> 00:59:49] Okay, and then I'm going to take a quick look at the record. [00:59:49 --> 00:59:51] Yeah, I'm just wondering at what point... [00:59:51 --> 00:59:54] Sir, may I speak to you for the record? [00:59:54 --> 00:59:57] I'll glance why I don't. [00:59:57 --> 01:00:08] I'm wondering when the members of the community will have input into the decision making process, [01:00:08 --> 01:00:15] either by meeting, attending the meetings of these 11 experts. [01:00:15 --> 01:00:19] I mean, to these people, are they experts in their centers? [01:00:19 --> 01:00:24] Or does anybody, I mean, there's certainly somebody there, right? [01:00:24 --> 01:00:25] Yes, sir. [01:00:25 --> 01:00:29] So, this is the first meeting where we're doing the structure. [01:00:29 --> 01:00:32] Second meeting, we'll start our working session. [01:00:32 --> 01:00:36] That may bring those points to conversation at the meeting. [01:00:36 --> 01:00:39] I think we'll be able to answer that. [01:00:39 --> 01:00:42] I believe it is based on the discussion [01:00:42 --> 01:00:44] during our board approval of bylaws [01:00:44 --> 01:00:46] and the establishment of the committee. [01:00:46 --> 01:00:47] There should be experts. [01:00:47 --> 01:00:49] There should be exhibition members [01:00:49 --> 01:00:51] that will be joining on the second meeting. [01:00:51 --> 01:00:54] So there will be an additional. [01:00:54 --> 01:00:57] Is there anybody who's not an expert [01:00:57 --> 01:01:02] or who does nothing about data centers on the committee? [01:01:02 --> 01:01:06] I would be able to answer that question. [01:01:06 --> 01:01:09] Well, how about the people who originally voted [01:01:09 --> 01:01:15] to have the data center on Aten and Cross? [01:01:15 --> 01:01:20] Wouldn't that be considered a non-starter [01:01:20 --> 01:01:27] to be on the committee? [01:01:27 --> 01:01:30] Because they broke the law, and everybody knows that. [01:01:30 --> 01:01:32] And then they do a good round of committee [01:01:32 --> 01:01:34] to plan a data center. [01:01:34 --> 01:01:39] I mean, not just the ignorance of what a data center is [01:01:39 --> 01:01:42] to put it right across the street. [01:01:42 --> 01:01:44] Imagine data center right across the street [01:01:44 --> 01:01:46] from the community. [01:01:46 --> 01:01:49] So why should that be allowed? [01:01:49 --> 01:01:51] I'll note down on the appointments. [01:01:51 --> 01:01:53] At this time, do you have any other comments [01:01:53 --> 01:01:57] regarding the violence or even the discrimination? [01:01:57 --> 01:02:03] How would I know when you will decide at which point [01:02:03 --> 01:02:07] the public will have input? [01:02:07 --> 01:02:09] You told me that you would have that next time you leave. [01:02:09 --> 01:02:11] If the committee will be meeting [01:02:11 --> 01:02:13] and there will be working sessions [01:02:13 --> 01:02:15] and more information will be provided at this time [01:02:15 --> 01:02:17] when we are structuring the committee, [01:02:17 --> 01:02:19] we're getting the office of law [01:02:19 --> 01:02:22] giving by loss provided to public [01:02:22 --> 01:02:23] and the committee as well. [01:02:23 --> 01:02:27] But yes, I would recommend to follow the meeting. [01:02:27 --> 01:02:29] So how do I be notified [01:02:29 --> 01:02:32] if I want to end that? [01:02:32 --> 01:02:34] Today there will be a discussion [01:02:34 --> 01:02:36] of a potential set date and time [01:02:36 --> 01:02:38] and location of this meeting. [01:02:38 --> 01:02:39] So that would be a start [01:02:39 --> 01:02:44] And obviously all agendas are posted online. [01:02:44 --> 01:02:47] That information will be also public. [01:02:47 --> 01:02:50] So you will be notified through posting those agendas. [01:02:50 --> 01:02:52] And again, an item will be discussed today [01:02:52 --> 01:02:56] to potentially have a step, date, and time. [01:02:56 --> 01:03:00] And is that information going to be available [01:03:00 --> 01:03:03] on the Board of Supervisors website? [01:03:03 --> 01:03:04] Yes. [01:03:04 --> 01:03:05] Okay. [01:03:05 --> 01:03:07] And that says it enough. [01:03:07 --> 01:03:24] Thank you. [01:03:24 --> 01:03:25] So. [01:03:25 --> 01:03:31] I don't know where this connection is, [01:03:31 --> 01:03:33] so this is going to go to the board [01:03:33 --> 01:03:37] and the rest of Sheridan will bring it to their attention. [01:03:37 --> 01:03:41] But with respect to the charge of this committee, [01:03:41 --> 01:03:45] it was my understanding that the purpose of this committee [01:03:45 --> 01:03:49] is to do fact-finding on what our Valley can sustain [01:03:49 --> 01:03:53] with respect to water, with respect to energy, [01:03:53 --> 01:03:57] with respect to environment. [01:03:57 --> 01:04:01] going over potential amendments, going over codes [01:04:01 --> 01:04:05] and ordinances and anything legal, they have staff for that. [01:04:05 --> 01:04:08] And that is not the purpose of if the data center, [01:04:08 --> 01:04:13] if our Valley can sustain the data center or three or seven. [01:04:14 --> 01:04:19] So I recommend that the charge be readdressed [01:04:19 --> 01:04:22] because the purpose, it's my understanding [01:04:22 --> 01:04:24] and I could be wrong, but it's my understanding [01:04:24 --> 01:04:29] that the purpose of this committee is to do research [01:04:30 --> 01:04:34] and provide facts on what our value can be stated. [01:04:34 --> 01:04:37] What the pros and cons are for the environment, [01:04:37 --> 01:04:40] for education, the whole thing. [01:04:40 --> 01:04:42] This part is just for reference. [01:04:42 --> 01:04:45] There is a resolution attached to the back of material [01:04:45 --> 01:04:49] against the Board of Truth, 16226. [01:04:49 --> 01:04:51] This item on Board of Supervisors, [01:04:51 --> 01:04:53] we've done that in the space of discussions. [01:04:53 --> 01:05:00] After that discussion, the establishment of the State Data Center was created. [01:05:00 --> 01:05:06] For the questions regarding charts, again I would go to the next meeting. [01:05:06 --> 01:05:12] And there is a section that says any other recommendations that may be determined appropriately. [01:05:12 --> 01:05:15] It's fine to do those, but there's one other. [01:05:15 --> 01:05:18] I just want to say that we spoke just because they don't need to do a number of ordinances. [01:05:18 --> 01:05:20] We have staff for that. [01:05:20 --> 01:05:22] In my opinion. [01:05:22 --> 01:05:23] Thank you. [01:05:30 --> 01:05:31] Hi, Kimberly Palacios. [01:05:31 --> 01:05:34] Just a quick question, you said you're still missing [01:05:34 --> 01:05:35] the appointment from Westmoreland? [01:05:35 --> 01:05:36] That is correct. [01:05:36 --> 01:05:37] To my knowledge, I might be wrong, [01:05:37 --> 01:05:39] but I'm pretty sure the State Council [01:05:39 --> 01:05:41] had already approved one of the applicants, [01:05:41 --> 01:05:42] Joaquin Plancela. [01:05:42 --> 01:05:45] So have they just not sent the name to you [01:05:45 --> 01:05:47] or was there an issue with this appointment? [01:05:47 --> 01:05:50] There was an application back in my office [01:05:50 --> 01:05:51] in Westmoreland. [01:05:51 --> 01:05:53] The last application I received was [01:05:53 --> 01:05:55] they did not have an appointment here [01:05:55 --> 01:05:59] and that they would proceed in getting our names [01:05:59 --> 01:06:00] as an age book. [01:06:00 --> 01:06:02] Okay, can I ask when that was? [01:06:02 --> 01:06:06] The last year or from them? [01:06:06 --> 01:06:08] I don't have the exact time right now, [01:06:08 --> 01:06:11] but it was the week that someone was appointment [01:06:11 --> 01:06:14] and then it just went to the court. [01:06:14 --> 01:06:17] Okay, so that's the information I have. [01:06:17 --> 01:06:22] Okay, got it, thank you. [01:06:22 --> 01:06:26] I think it's already in the bylaws, [01:06:26 --> 01:06:32] But I just wanted to be spoken into the public record that whatever this committee finds, [01:06:32 --> 01:06:37] whether it pros and cons, that when it says like any other recommendations, the committee [01:06:37 --> 01:06:42] turns appropriate, that that also includes that we're going to look into research and [01:06:42 --> 01:06:50] bringing communities that might have adopted a prohibition of data center development. [01:06:50 --> 01:06:56] Like I said, it's going to be a city council voted to vote for it. [01:06:56 --> 01:06:59] to enact one of these prohibitions. [01:06:59 --> 01:07:02] So I just want to make sure that it's opening to the record, [01:07:02 --> 01:07:03] that that is one of the available options [01:07:03 --> 01:07:09] this community can take as well. [01:07:09 --> 01:07:10] Yeah, and to that effect, [01:07:10 --> 01:07:12] I'm all agreeing with what they were talking about, [01:07:12 --> 01:07:13] and I think I just wanted to kind of, [01:07:13 --> 01:07:14] for my clarification, [01:07:16 --> 01:07:18] I want to make sure any recommendations [01:07:18 --> 01:07:21] that the committee determines appropriate. [01:07:21 --> 01:07:24] If ultimately this committee finds [01:07:24 --> 01:07:26] that there shall not be a data center, [01:07:26 --> 01:07:28] is that an option that we have as well? [01:07:28 --> 01:07:36] Because as it reads more like the decision has already been made, and it's just up to us to decide where. [01:07:36 --> 01:07:39] That's kind of, I wouldn't have an issue with that. [01:07:39 --> 01:07:40] That's my problem. [01:07:40 --> 01:07:52] If this committee decides ultimately that there shouldn't be a data center, is that something that is at our power and our expression to say moving forward, that's how it goes. [01:07:52 --> 01:07:57] At this time I will take down that information and I will get back to you guys for the second meeting. [01:07:57 --> 01:07:59] I thought again this is under charge. [01:07:59 --> 01:08:07] I am not an expert. I am not the one to call or do any type of things that related to charge. [01:08:07 --> 01:08:11] But I will note it down and I will bring it back. [01:08:11 --> 01:08:20] So, if you have any questions, is there something? [01:08:20 --> 01:08:23] I'm talking to you guys today. [01:08:23 --> 01:08:24] Bye. [01:08:24 --> 01:08:25] Okay. [01:08:25 --> 01:08:28] My name's Michael. I'm going to write this. [01:08:28 --> 01:08:32] And I just had a couple of questions for clarification. [01:08:32 --> 01:08:35] I believe I understood council when they came up here [01:08:35 --> 01:08:40] that there will be a mechanism or the committee [01:08:40 --> 01:08:44] will have the ability to amend the bylaws. [01:08:44 --> 01:08:45] It is what I understood. [01:08:45 --> 01:08:48] So I'm asking for clarification on that. [01:08:48 --> 01:08:53] And secondly, as the committee is doing their work, [01:08:53 --> 01:09:11] work. Will there be reports coming out when they cover a certain aspect of the duties or will the report not come out until the board or the committee has finalized all their work? [01:09:11 --> 01:09:16] Your first question, yes, the vitals may be revised. [01:09:16 --> 01:09:19] The chair would have to take the item on the agenda [01:09:19 --> 01:09:23] for discussion, but somebody has to discuss the changes [01:09:23 --> 01:09:24] and approve the changes. [01:09:24 --> 01:09:27] And then once that happens, then those recommendations [01:09:27 --> 01:09:30] from the advisory committee go before the board [01:09:30 --> 01:09:32] of supervisors at the end of the day. [01:09:32 --> 01:09:35] The vitals are approved by the board of supervisors. [01:09:35 --> 01:09:38] So any changes that they may need a vote, [01:09:38 --> 01:09:45] motion is second approval if they pass the recommendations and they move on my end or [01:09:45 --> 01:09:49] receive them and I will take them before the board is supermitted for approval. [01:09:49 --> 01:09:57] Yeah because my concern is that they are formulated in such a way as where they are [01:09:57 --> 01:10:04] pretty much given directives to the committee on what the parameters are of their duties. [01:10:04 --> 01:10:12] that you're going to find out which lots or land is appropriate for a data center. [01:10:12 --> 01:10:21] And other things, so this committee may find that there is no land that's appropriate, but so whatever. [01:10:21 --> 01:10:27] And so it's already outlined on the bylaws what their function is going to be. [01:10:27 --> 01:10:37] So that's a concern of mine, especially when there's been a lot of voicing from the community [01:10:37 --> 01:10:42] that they wanted the voices heard and that there should be a committee formed. [01:10:42 --> 01:10:47] And I thank the board for taking that decision and for these communities. [01:10:47 --> 01:10:50] They're one of the people that are taking this time out of their day. [01:10:50 --> 01:10:54] And here I appreciate that 100%. [01:10:54 --> 01:11:00] But because of what is the atmosphere that's taking place, [01:11:01 --> 01:11:04] the residents just want transparency. [01:11:04 --> 01:11:09] And they wanna know that there was a due diligence done here. [01:11:10 --> 01:11:14] And because I would hate for this committee [01:11:16 --> 01:11:21] to be used as a pond so that the board of supervisors [01:11:21 --> 01:11:23] and say, look, we did our part. [01:11:23 --> 01:11:27] We took the recommendations of this committee [01:11:27 --> 01:11:30] and we're gonna implement them. [01:11:30 --> 01:11:33] But yet they gave a directive as to what, [01:11:33 --> 01:11:35] how they're gonna proceed. [01:11:35 --> 01:11:37] So they're gonna be used as state codes [01:11:37 --> 01:11:42] and I wanna try to avoid the transparency as a key here. [01:11:42 --> 01:11:43] So yeah. [01:11:43 --> 01:11:44] So this time you have your check for a minute [01:11:44 --> 01:11:46] and I want to clarify the details [01:11:46 --> 01:11:49] of our working document. [01:11:49 --> 01:11:51] Right now I'm doing an overview. [01:11:51 --> 01:11:54] I'm not noting the questions that are on, [01:11:54 --> 01:11:56] but we cannot make any changes [01:11:56 --> 01:11:57] and are any recommendations today. [01:11:57 --> 01:12:00] This is just an overview. [01:12:00 --> 01:12:01] Yes, Mr. Biddle. [01:12:01 --> 01:12:02] I'm sorry. [01:12:02 --> 01:12:02] I'm sorry. [01:12:02 --> 01:12:04] I'm sorry. [01:12:04 --> 01:12:07] That I heard of Fabio and Gevec regarding charge [01:12:07 --> 01:12:09] and any other recommendations [01:12:09 --> 01:12:11] because the committee determines appropriate. [01:12:11 --> 01:12:14] If you were to find that the Davis Center [01:12:14 --> 01:12:16] isn't a good idea to, [01:12:16 --> 01:12:19] he places the value that would be acknowledged. [01:12:19 --> 01:12:24] That's why part of my introduction included my hope is for us as a group to find precedent [01:12:24 --> 01:12:29] information and whether to prove or to disprove whether that center becomes here. [01:12:29 --> 01:12:30] Finally, I'd like to follow up. [01:12:30 --> 01:12:31] Thank you for that. [01:12:31 --> 01:12:42] So I appreciate that Mr. Morales clarifying that point about what we could amend these [01:12:42 --> 01:12:48] because I could see it being quite cumbersome for us to amend the Imperial County General [01:12:48 --> 01:12:53] Plan or amend the Imperial County Code of Five ordinances. [01:12:53 --> 01:12:56] I really think that we as a committee have to roll up our sleeves and get to work [01:12:56 --> 01:13:02] inside what will work and what will work because we can postulate like hey that [01:13:02 --> 01:13:07] might not work well let's find out what will work and then let's respond and [01:13:07 --> 01:13:13] there's some great ideas being shared already but we need to get to the work [01:13:13 --> 01:13:30] I'd like to know what the resources are that have already been collected for us to look at [01:13:30 --> 01:13:42] I'll give you an example. I was on a site council in New Orleans. I hold a site in First Grade. [01:13:42 --> 01:13:51] I went to that site council and they read to me, it's like they read to us today. [01:13:51 --> 01:13:58] All these things we had to do, all the things that we were supposed to be able to make choices over [01:13:58 --> 01:14:06] and select. That meeting came in, the school principal read to us [01:14:06 --> 01:14:14] And I would ask this question, what can we do with this one? [01:14:14 --> 01:14:16] Now that's mandate part. [01:14:16 --> 01:14:18] Next one, mandate. [01:14:18 --> 01:14:19] Mandate. [01:14:19 --> 01:14:24] Finally on the third meeting, I stood up and I think, silently, [01:14:24 --> 01:14:31] like I'm just ready to hear, and I asked, so what's not [01:14:31 --> 01:14:32] mandate? [01:14:32 --> 01:14:34] Let's skip all this other stuff. [01:14:34 --> 01:14:36] I don't want to hear about it. [01:14:36 --> 01:14:41] I want to know what we can make a decision about. [01:14:41 --> 01:14:46] On that side, council, there was $2,500 total. [01:14:46 --> 01:14:49] And they were going to drag us through 10 years [01:14:49 --> 01:14:56] to do this little search to find $2,500. [01:14:56 --> 01:14:59] So if a lot of this stuff is already predetermined [01:14:59 --> 01:15:01] and we can't change it, we don't [01:15:01 --> 01:15:04] need to really be going through that. [01:15:04 --> 01:15:14] We need to determine what we can change, what we can have our advice as good for, and we [01:15:14 --> 01:15:18] need to not waste no time. [01:15:18 --> 01:15:27] So what resources do you have that we should study before we come back to this meeting? [01:15:27 --> 01:15:31] One of my concerns is that the public concerns need to be recorded. [01:15:31 --> 01:15:35] It needs to be written down. [01:15:35 --> 01:15:38] Everybody is entitled to their opinion. [01:15:38 --> 01:15:42] there's only one set of facts. [01:15:42 --> 01:15:45] So we need to establish what we're talking about. [01:15:45 --> 01:15:51] Okay. [01:15:51 --> 01:15:56] Sada? [01:15:56 --> 01:15:59] Yes, I just wanna reference the charge. [01:15:59 --> 01:16:01] You can just be kind of discussed now [01:16:01 --> 01:16:04] and kind of maybe echo a little bit with Mr. Narvey said. [01:16:04 --> 01:16:06] I think we should make it very clear, [01:16:06 --> 01:16:08] both to the public that our charge [01:16:08 --> 01:16:12] is to potentially amend the Imperial County General Plan [01:16:12 --> 01:16:15] and it is to amend the codified ordinance. [01:16:15 --> 01:16:19] So as we discussed data centers in general [01:16:19 --> 01:16:23] and we begin to really get to the issues [01:16:23 --> 01:16:27] with electricity, land use, at the end of the day [01:16:27 --> 01:16:30] it would be to give recommendations [01:16:30 --> 01:16:35] to the board of supervisors to update these general plans. [01:16:35 --> 01:16:36] So that is the intent. [01:16:36 --> 01:16:37] So I think it should be very clear [01:16:37 --> 01:16:39] it was brought up in public comment [01:16:39 --> 01:16:41] but I think also being very clear to us [01:16:41 --> 01:16:44] that that is the discretion that we have [01:16:44 --> 01:16:46] as the sport is providing those recommendations [01:16:46 --> 01:16:59] on laws that govern land use in Newquail County. [01:16:59 --> 01:17:01] Carry on with that. [01:17:01 --> 01:17:05] We only can advise the board of supervisors. [01:17:05 --> 01:17:07] We're not making any decisions here. [01:17:07 --> 01:17:08] No. [01:17:08 --> 01:17:09] That is correct. [01:17:09 --> 01:17:10] We're an advisory committee. [01:17:10 --> 01:17:13] Yeah. [01:17:13 --> 01:17:24] Decision number three. [01:17:24 --> 01:17:25] Thank you. [01:17:25 --> 01:17:27] My name is Terri LaViano-Liz. [01:17:27 --> 01:17:28] I'm a member of the community. [01:17:28 --> 01:17:30] I'm a member of the telecom. [01:17:30 --> 01:17:32] I just want to bring the board's attention [01:17:32 --> 01:17:37] to the in bylaws section nine in her attendance. [01:17:38 --> 01:17:41] So it says, members are expected to attend regular meetings. [01:17:41 --> 01:17:42] Any member who has absent [01:17:42 --> 01:17:45] from three consecutive meetings without good cause. [01:17:45 --> 01:17:47] I think we should be a little cautious [01:17:47 --> 01:17:48] about using this language. [01:17:48 --> 01:17:50] And I think we should just remove it altogether. [01:17:50 --> 01:17:53] I think if somebody misses a meeting entirely, [01:17:53 --> 01:17:57] I think it should be not whether it's a good cause [01:17:57 --> 01:18:00] because then you can get it to semantics [01:18:00 --> 01:18:01] rather than to the action. [01:18:01 --> 01:18:04] And then I think we need to remove the section [01:18:04 --> 01:18:09] where I think it's to the benefit of the DCAC [01:18:09 --> 01:18:11] to remove the portion where it says, [01:18:11 --> 01:18:13] maybe recommended to the Board of Supervisors [01:18:13 --> 01:18:15] for removal of the DCAC. [01:18:15 --> 01:18:17] I believe that the action should be taken [01:18:17 --> 01:18:21] by the community itself to remove or to add members, [01:18:21 --> 01:18:23] not by the Board of Supervisors [01:18:23 --> 01:18:25] because then that can cause a little more, [01:18:25 --> 01:18:28] it can be a little more disproportionate representation. [01:18:28 --> 01:18:30] And then I have a question. [01:18:30 --> 01:18:31] I don't know if you're able to answer it [01:18:31 --> 01:18:34] or many of the other board supervisors are, [01:18:34 --> 01:18:36] but I understand that this is an advisor committee, [01:18:36 --> 01:18:38] so no action can be taken, [01:18:38 --> 01:18:40] but to my understanding, [01:18:40 --> 01:18:43] the committee will be hearing from subject matter experts, [01:18:43 --> 01:18:46] and I have a question. [01:18:46 --> 01:18:48] Are those subject matter experts, [01:18:48 --> 01:18:50] like who determines whether subject matter experts are? [01:18:50 --> 01:18:53] And the reason I ask this is because [01:18:54 --> 01:18:56] data centers are such a novel, [01:18:56 --> 01:18:59] new thing coming up in our communities, [01:18:59 --> 01:19:00] and so how do we determine that? [01:19:00 --> 01:19:04] My concern is that if we take subject matter experts, [01:19:04 --> 01:19:06] it's going to be individuals solely from industry. [01:19:06 --> 01:19:11] It's going to be individuals that have a bias [01:19:11 --> 01:19:13] because they are economically motivated [01:19:13 --> 01:19:17] to provide very specific information to the board [01:19:17 --> 01:19:19] or to this advisory committee. [01:19:19 --> 01:19:24] And so I caution how we define as experts. [01:19:24 --> 01:19:26] Maybe that's something that you guys can kind of get [01:19:26 --> 01:19:30] together and figure out by yourselves, [01:19:30 --> 01:19:33] Whether I think my recommendation would be to go through, [01:19:33 --> 01:19:36] I know a couple of weeks ago I was lucky to attend [01:19:36 --> 01:19:41] a UCSC and UC Inland Empire Labor Center, [01:19:41 --> 01:19:43] the data center symposium where they brought people [01:19:43 --> 01:19:45] from all across the country. [01:19:45 --> 01:19:48] And I really recommend you reach out to researchers [01:19:48 --> 01:19:49] in that area. [01:19:49 --> 01:19:52] They have a broad swath of people from candidates [01:19:52 --> 01:19:54] to people that do research [01:19:54 --> 01:19:57] and are compensated to do research on universities. [01:19:57 --> 01:20:00] And they brought a lot of interesting case studies [01:20:00 --> 01:20:03] about data centers in communities not only in California [01:20:03 --> 01:20:05] but across the country. [01:20:05 --> 01:20:07] And that's what I personally would recommend [01:20:07 --> 01:20:09] as a subject matter expert, [01:20:09 --> 01:20:11] who will be researchers from universities. [01:20:11 --> 01:20:15] I would really, really recommend this advisor committee [01:20:15 --> 01:20:19] to steer away from compensated members [01:20:19 --> 01:20:22] or people that are working with industry [01:20:22 --> 01:20:29] just to get facts along with the state. [01:20:29 --> 01:20:30] Thank you. [01:20:30 --> 01:20:37] I might be getting ahead of myself here, but so I know that tonight I remember there can [01:20:37 --> 01:20:43] be changes to the violence and whatnot, so when we determine when the next meeting will [01:20:43 --> 01:20:48] be, is that when we collectively will take all these things that are being written down [01:20:48 --> 01:20:53] into consideration and then take it to the put a surprise or some proof possibly at the [01:20:53 --> 01:20:57] end of the next meeting, like I just want clarification on when these changes will [01:20:57 --> 01:20:59] possibly be reflected. [01:20:59 --> 01:21:04] The way I see it is on your agenda, meeting number two. [01:21:04 --> 01:21:08] If the chair, whoever becomes chair, [01:21:08 --> 01:21:10] is comfortable in bringing this bylaws [01:21:10 --> 01:21:15] for again, all the matters that you guys discussed [01:21:15 --> 01:21:18] and recommended changes, then it's discussed [01:21:18 --> 01:21:20] on your second meeting. [01:21:20 --> 01:21:23] If there's a motion to second and a full approval [01:21:23 --> 01:21:26] and the motion passes, then those recommended changes [01:21:26 --> 01:21:28] will go before the board is supervised [01:21:28 --> 01:21:32] as soon as I receive those revisions from this committee. [01:21:32 --> 01:21:38] You have another question. [01:21:38 --> 01:21:43] Is there, has there been any competitive analysis [01:21:43 --> 01:21:47] on data centers here? [01:21:47 --> 01:21:49] I mean, are we even competitive? [01:21:49 --> 01:21:52] Are you even a place that data center would be more? [01:21:52 --> 01:21:55] I'm sorry, so I want to be able to answer you that question. [01:21:55 --> 01:21:57] But we will move it down and this will be coming. [01:21:57 --> 01:22:00] But is, have you generated any reference materials [01:22:00 --> 01:22:04] such like that with counting periods and liberation? [01:22:04 --> 01:22:14] I will bring back an answer. [01:22:14 --> 01:22:15] Two things. [01:22:15 --> 01:22:17] First of all, I'm sorry, Henry. [01:22:17 --> 01:22:20] I think what you're asking is, are we [01:22:20 --> 01:22:23] competitive with our electric rates [01:22:23 --> 01:22:24] and that type of thing? [01:22:24 --> 01:22:26] Is that what you're asking? [01:22:26 --> 01:22:30] Much broader questions as it's land use, [01:22:30 --> 01:22:35] it's property tax, it's sales tax, it's extraction taxes [01:22:35 --> 01:22:41] on energy, it's transportation and fuel, [01:22:41 --> 01:22:42] it's all of those things. [01:22:42 --> 01:22:46] We bring together in a competitive analysis, [01:22:46 --> 01:22:50] do we even measure up? [01:22:50 --> 01:22:52] Are we just wasting our time doing this [01:22:52 --> 01:22:56] because really there's not a customer. [01:22:56 --> 01:22:59] After a great structure that we have, [01:22:59 --> 01:23:02] why would anyone want to come here? [01:23:02 --> 01:23:06] That's really something that's important. [01:23:06 --> 01:23:10] Do we even have a headspace in the natural gas pipeline [01:23:10 --> 01:23:13] that runs down the spine of this valley [01:23:13 --> 01:23:21] even generating more power. You realize that we're very short of power here. We [01:23:21 --> 01:23:26] can't even hardly transport a transport power here. Anytime you go to build up a [01:23:26 --> 01:23:31] small business you run right into a couple hundred thousand dollar built [01:23:31 --> 01:23:36] provisioning power even more. So that's what I'm talking about. Are we [01:23:36 --> 01:23:43] competitive? Shouldn't we be competitive? Shouldn't we have extra power to [01:23:43 --> 01:23:46] to build new business. [01:23:46 --> 01:23:49] Even, I mean, we're talking about a data center, [01:23:49 --> 01:23:55] but if you want to process agricultural crops, [01:23:55 --> 01:23:58] I know people that have to set up presses [01:23:58 --> 01:24:00] and process in the ways of many years [01:24:00 --> 01:24:05] to get power to run those facilities. [01:24:05 --> 01:24:09] And it's not easy, I know it's not. [01:24:09 --> 01:24:13] And I dare say we're not competitive. [01:24:13 --> 01:24:16] I think you should be more concerned about not getting [01:24:16 --> 01:24:18] one than being able to get one. [01:24:21 --> 01:24:25] I don't, I dare say we're not very excited. [01:24:25 --> 01:24:30] We're way off, we're way off the scale. [01:24:30 --> 01:24:34] So just to comment, I don't know [01:24:34 --> 01:24:37] when IED had a speaker that came in, [01:24:37 --> 01:24:40] he was supposedly, he was very neutral. [01:24:40 --> 01:24:42] And so some of those are the questions [01:24:42 --> 01:24:44] that you're asking, are we committed? [01:24:44 --> 01:24:48] I think it would be a good experience for us to bring in [01:24:48 --> 01:24:51] individuals like that to say, hey listen, [01:24:51 --> 01:24:53] Crow Valley is not a good fit, [01:24:53 --> 01:24:55] the Crow. Valley is a good fit, whatever. [01:24:55 --> 01:25:00] But bring those people in and let them share [01:25:00 --> 01:25:03] with us and assess those things. [01:25:03 --> 01:25:11] Yeah, we should be assessing that here too. [01:25:11 --> 01:25:13] Want to hear more about that? [01:25:13 --> 01:25:16] But no, I just think we should be assessing [01:25:16 --> 01:25:18] whether we're fit or not. [01:25:18 --> 01:25:21] I think that we're not afraid. [01:25:21 --> 01:25:23] I think that our costs are too high, [01:25:23 --> 01:25:25] or too far away from power. [01:25:25 --> 01:25:31] We have restrictions and policy from the state [01:25:31 --> 01:25:34] that doesn't allow us to really participate. [01:25:34 --> 01:25:36] We should be more concerned about that [01:25:36 --> 01:25:40] than what we spent our time on. [01:25:40 --> 01:25:45] And I realized that the siting of that data center [01:25:45 --> 01:25:45] was poor. [01:25:48 --> 01:25:49] It broke the wrong place. [01:25:49 --> 01:25:52] But in Carroll County, it needs to be competitive. [01:25:52 --> 01:25:57] But that place, that was never gonna work. [01:25:57 --> 01:26:01] It needs to be competitive, but also we've been a target [01:26:01 --> 01:26:05] for over a year now with these data centers. [01:26:05 --> 01:26:09] And I think what this advisory committee is here to do [01:26:09 --> 01:26:14] is to look at and give regulations [01:26:14 --> 01:26:16] of where it could go or where it couldn't go. [01:26:16 --> 01:26:20] And saying that we have the capacity [01:26:20 --> 01:26:22] to do all these things. [01:26:22 --> 01:26:25] I can't answer that, but I can't answer [01:26:25 --> 01:26:31] that we have been targeted and they're knocking on our door. [01:26:31 --> 01:26:35] So to say that we're, you know, [01:26:35 --> 01:26:37] oh, don't worry about it, that's kind of what I got. [01:26:37 --> 01:26:39] Don't worry about it, they're not gonna come. [01:26:39 --> 01:26:41] I'm not saying that at all. [01:26:41 --> 01:26:42] Okay, I'll be back. [01:26:42 --> 01:26:45] I'm gonna take the agriculture for a second. [01:26:45 --> 01:26:47] Can we discuss it? [01:26:48 --> 01:26:50] Or we get to plan out a place. [01:26:50 --> 01:26:52] Mr. Hamlin was calling for I apologize. [01:26:52 --> 01:26:56] I am being asked that we structure back to our agenda. [01:26:56 --> 01:27:00] The bylaws are still on the table right now. [01:27:00 --> 01:27:03] We did a revision that we have been here, [01:27:03 --> 01:27:06] sorry we discussed it. [01:27:06 --> 01:27:08] It can come back to your guys's committee [01:27:08 --> 01:27:11] for further discussion, for their corrections, [01:27:11 --> 01:27:13] for their questions, and in part, [01:27:13 --> 01:27:15] I'm sorry that's something that the community [01:27:15 --> 01:27:19] will discuss on your guys's time in the back. [01:27:19 --> 01:27:23] So if there are any other questions regarding the bios, [01:27:23 --> 01:27:26] I will pick them if not, and then I will go in and ask [01:27:26 --> 01:27:30] our attorney council staff to provide us with the brown [01:27:30 --> 01:27:31] opinion. [01:27:31 --> 01:27:32] One more question. [01:27:32 --> 01:27:33] Yes, Mr. Anthony? [01:27:33 --> 01:27:35] Under charge is under charge. [01:27:35 --> 01:27:38] I guess maybe I'm not reading that, [01:27:38 --> 01:27:43] but has provided an expert to counsel. [01:27:43 --> 01:27:45] There is a question for the committee [01:27:45 --> 01:27:50] is to have an expert for you guys to learn and hear from the expert. [01:27:50 --> 01:27:54] But that's a discussion that you will have during your work in the future. [01:27:54 --> 01:27:59] Thank you. [01:27:59 --> 01:28:09] Just saying earlier, I'm here with my husband's teacher voice. [01:28:09 --> 01:28:11] So if everybody can hear me, I'll walk you down the microphone. [01:28:11 --> 01:28:13] If you can't hear me, I will. [01:28:13 --> 01:28:14] We can hear you. [01:28:14 --> 01:28:15] Thank you. [01:28:15 --> 01:28:16] All right. [01:28:16 --> 01:28:18] There you go. [01:28:18 --> 01:28:24] So good evening, everyone. [01:28:24 --> 01:28:25] My name is Chris Becker. [01:28:25 --> 01:28:27] I'm Senior Deputy County Counsel and the County Counsel's [01:28:27 --> 01:28:29] Office of the National Committee of the Imperial. [01:28:29 --> 01:28:34] We have a very, very brief presentation on the Brown Act [01:28:34 --> 01:28:37] and the Press and the Public Records Act. [01:28:37 --> 01:28:40] So, there we go. [01:28:41 --> 01:28:43] So welcome to the committee. [01:28:43 --> 01:28:48] As a public body, this committee is guided by the Brown Act [01:28:48 --> 01:28:51] as well as the Public Records Act. [01:28:51 --> 01:28:55] So the Brown Act is California's open longing [01:28:55 --> 01:28:56] of a meeting lot, [01:28:56 --> 01:28:58] for local governmental bodies. [01:28:58 --> 01:29:00] And this committee that you sit on [01:29:00 --> 01:29:02] is a local governmental body. [01:29:02 --> 01:29:04] This whole premise is very simple, [01:29:04 --> 01:29:07] that the public's business gets conducted in public. [01:29:07 --> 01:29:10] The borough act itself lives in the government code, [01:29:10 --> 01:29:13] starting with section five, four, nine, five, zero. [01:29:13 --> 01:29:16] Each of you have been provided with the entire statutory [01:29:17 --> 01:29:22] breakdown of the borough act as part of this training. [01:29:23 --> 01:29:25] So the legislative frame of borough act, [01:29:25 --> 01:29:28] the way it did because it's on matters. [01:29:28 --> 01:29:30] The words of public agencies exist [01:29:30 --> 01:29:33] to aid in the conduct of the people's business [01:29:33 --> 01:29:35] and then our deliberations and actions [01:29:35 --> 01:29:37] have to be taken openly. [01:29:37 --> 01:29:39] As with the people in delegating authority [01:29:39 --> 01:29:41] do not give their public service the right [01:29:41 --> 01:29:43] to decide what is good for the people to know [01:29:43 --> 01:29:44] and what is not. [01:29:44 --> 01:29:46] So the mindset is not one amount [01:29:46 --> 01:29:48] of how to keep private, it's the reverse. [01:29:48 --> 01:29:52] Openness is the default and the exceptions are narrow. [01:29:52 --> 01:29:54] Keeping that framing in most of the specific world [01:29:54 --> 01:29:59] of the public today will make into a sense. [01:29:59 --> 01:30:02] So this matters to you because you [01:30:02 --> 01:30:03] should think that an act is protecting [01:30:03 --> 01:30:05] two favorite months to public trust. [01:30:05 --> 01:30:08] And you, the same rules that keep the meetings open, [01:30:08 --> 01:30:12] also keep your decisions valid and defensible. [01:30:12 --> 01:30:15] Follow them and your actions will hold up. [01:30:15 --> 01:30:16] Will the judge follow them? [01:30:16 --> 01:30:18] The consequences of the removal? [01:30:18 --> 01:30:20] A violation can point the action that the committee took. [01:30:20 --> 01:30:22] It can invite lawsuits, including ones [01:30:22 --> 01:30:25] where we end up paying the other side's attorney's fees. [01:30:25 --> 01:30:26] and then the narrow side of cases, [01:30:26 --> 01:30:28] it can't bring an individual member [01:30:28 --> 01:30:30] on the hook for a misdemeanor. [01:30:30 --> 01:30:33] But here's the part I want you most to hear. [01:30:33 --> 01:30:35] Almost none of this is bad faith. [01:30:35 --> 01:30:37] The violations we see are unintentional. [01:30:37 --> 01:30:40] A quick hallway conversation, a reply all email [01:30:40 --> 01:30:42] that turns into a discussion, [01:30:42 --> 01:30:45] or taking up something that was not on an agenda. [01:30:45 --> 01:30:46] Small, ordinary moments, [01:30:46 --> 01:30:48] that's exactly what this training is about, [01:30:48 --> 01:30:52] learning to spot those traps before you step into them. [01:30:52 --> 01:30:55] So here is public policy, body discovery. [01:30:55 --> 01:30:57] One of the most common misconceptions [01:30:57 --> 01:31:00] is that this rule applies only when the county board [01:31:00 --> 01:31:01] of supervisors meets. [01:31:01 --> 01:31:03] But that is not correct. [01:31:03 --> 01:31:05] It applies to the legislative body. [01:31:05 --> 01:31:07] And that term is much broader than the means [01:31:07 --> 01:31:09] that we're in the order. [01:31:09 --> 01:31:11] It suits in commissions, committees, boards, [01:31:11 --> 01:31:13] and other bodies that the county creates, [01:31:13 --> 01:31:15] whether they're permanent pictures or something [01:31:15 --> 01:31:19] separate person, both a single temporary purpose. [01:31:19 --> 01:31:21] The county created it as soon as it's held by the [01:31:21 --> 01:31:25] program that the public record jagged in that summer to do otherwise. [01:31:25 --> 01:31:28] So the practical takeaway, please don't assume that this community is out of [01:31:28 --> 01:31:32] the rules when you doubt and when if you are doubtful, [01:31:32 --> 01:31:36] other parties cover up the area that's covered and ask before you act. [01:31:38 --> 01:31:39] So it counts as a meeting. [01:31:40 --> 01:31:47] The word a meeting is a gathering of a majority of the members at the same [01:31:47 --> 01:31:50] and at the same place, and that includes my phone and radio, [01:31:50 --> 01:31:53] to hear, discuss, deliberate, or tap on anything [01:31:53 --> 01:31:56] within the body's jurisdiction. [01:31:56 --> 01:31:57] This committee currently consists of 18 [01:31:57 --> 01:32:00] of which are they increased to 19. [01:32:00 --> 01:32:03] Either way, your quarry, your majority, is 10. [01:32:04 --> 01:32:07] So what's not on that list is vote. [01:32:07 --> 01:32:09] You don't need a vote, you don't need a form call, [01:32:09 --> 01:32:13] you don't need a formal setting or an agenda in front of you. [01:32:13 --> 01:32:15] If the majority of you are talking about committee business [01:32:15 --> 01:32:17] of a coffee, that is a meeting. [01:32:17 --> 01:32:21] Legally the same as sitting at the status. [01:32:21 --> 01:32:24] So the most common violations are not formal ones. [01:32:24 --> 01:32:26] They are the informal gatherings where [01:32:26 --> 01:32:28] nobody thought of themselves as a meeting, [01:32:28 --> 01:32:31] as that is defined in the ground-up. [01:32:31 --> 01:32:33] There are some express cardouts in their common sense. [01:32:33 --> 01:32:36] You can all attend the same conference [01:32:36 --> 01:32:38] or sit in on another agency's public meeting [01:32:38 --> 01:32:41] without that becoming a meeting of your coffee. [01:32:41 --> 01:32:43] As long as you don't start discussing [01:32:43 --> 01:32:46] your own agency's business amongst yourself. [01:32:46 --> 01:32:48] The moment a majority of you turn to each other [01:32:48 --> 01:32:51] and take up your own business, you then have [01:32:51 --> 01:32:54] to be run into a problem with the ground. [01:32:54 --> 01:32:56] So the practical rule is count heads. [01:32:56 --> 01:32:58] Anytime, 10 or more of you are together, [01:32:58 --> 01:33:00] anywhere in any medium, be conscious [01:33:00 --> 01:33:02] that your own business is off limits [01:33:02 --> 01:33:06] unless you're properly in this community. [01:33:06 --> 01:33:08] So serial meetings, this is the principle [01:33:08 --> 01:33:10] that ties the infection together. [01:33:10 --> 01:33:13] A majority can only act indirectly [01:33:13 --> 01:33:16] that has the power to do so directly. [01:33:16 --> 01:33:18] You cannot get around the open reading rule [01:33:18 --> 01:33:21] by breaking the conversation into pieces. [01:33:21 --> 01:33:23] That's what the app calls a serial meeting, [01:33:23 --> 01:33:26] using a series of communications to reach [01:33:26 --> 01:33:29] a collective agreement outside of a noticed meeting. [01:33:29 --> 01:33:31] It does not matter if it's one on one talks, [01:33:31 --> 01:33:34] phone calls, emails, texts, or go between [01:33:34 --> 01:33:36] passing or going around. [01:33:36 --> 01:33:37] If the effect is that a majority [01:33:37 --> 01:33:40] arrives at a conference, that is prohibited. [01:33:40 --> 01:33:43] So two forms to watch for of serial meetings [01:33:43 --> 01:33:47] included a Daisy chain, A tells B and B tells C. [01:33:47 --> 01:33:50] So no two of you are ever in the same room together [01:33:50 --> 01:33:53] but the consensus still travels down line. [01:33:53 --> 01:33:54] The second is polling. [01:33:54 --> 01:33:57] A staff member or a third party going, [01:33:57 --> 01:33:59] member to member asking where you stand. [01:33:59 --> 01:34:01] Both are violations even though they feel efficient [01:34:01 --> 01:34:02] and harmless. [01:34:03 --> 01:34:05] So three rules. [01:34:05 --> 01:34:07] One, don't get replied to all with your views [01:34:07 --> 01:34:09] on agenda items that were applied all for it [01:34:09 --> 01:34:11] is a classic serial meaning. [01:34:11 --> 01:34:13] Two, don't forward one number to pin you [01:34:13 --> 01:34:15] to another number at the moment you relay a name, [01:34:15 --> 01:34:19] you become the go-between and the app for Hedonist. [01:34:19 --> 01:34:21] And three, as soon as every email or text [01:34:21 --> 01:34:23] that you send about community business, [01:34:23 --> 01:34:25] this public record could be disclosed [01:34:25 --> 01:34:27] and you'll come back to that when we talk about [01:34:27 --> 01:34:29] the Mother Brother Act. [01:34:29 --> 01:34:32] The safe habit to adopt is if it is about community business [01:34:32 --> 01:34:33] and it is headed to your colleagues, [01:34:33 --> 01:34:39] take it to the notice leading instead of the email inbox. [01:34:39 --> 01:34:42] There's four types of meetings. [01:34:42 --> 01:34:44] And the noticed rules and what you're allowed to do [01:34:44 --> 01:34:46] differ in each. [01:34:46 --> 01:34:47] So we're going to walk through them [01:34:47 --> 01:34:50] because that's going to up as a common source of trouble. [01:34:50 --> 01:34:53] The workforce meeting, of course, is your regular meeting [01:34:53 --> 01:34:55] with your kind of your place, your fixing your pants, [01:34:55 --> 01:34:58] either by order, resolution, or by laws. [01:34:58 --> 01:35:01] And the agenda goes up 72 hours ahead. [01:35:01 --> 01:35:03] At a recommendation, you can take up anything [01:35:03 --> 01:35:05] on that post to be done. [01:35:05 --> 01:35:07] That wasn't about the extent of what I was going to go [01:35:07 --> 01:35:10] to the bylaws in this training. [01:35:10 --> 01:35:12] So it doesn't really answer Ms. Oliver's question [01:35:12 --> 01:35:15] about who can put Biden's home in the agenda. [01:35:16 --> 01:35:18] There have been a lot of discussion [01:35:18 --> 01:35:19] about how many of the bylaws, [01:35:19 --> 01:35:21] and I think that's a little past and taken, [01:35:21 --> 01:35:24] is that it should be clear within the bylaws [01:35:24 --> 01:35:26] who can approach the chair [01:35:26 --> 01:35:29] and ask if it's something equivalent of the agenda, [01:35:29 --> 01:35:31] and it should also be made clear [01:35:31 --> 01:35:33] whether the chair has any discussion [01:35:33 --> 01:35:36] to decide what does or does not [01:35:36 --> 01:35:38] go on the issue and that's something that will, [01:35:38 --> 01:35:41] to note to the taken and should be addressed [01:35:41 --> 01:35:43] for your next review of the bylaws. [01:35:43 --> 01:35:44] I don't know if that counts as a, [01:35:44 --> 01:35:46] something that's not very, [01:35:46 --> 01:35:48] something that's not enough to help, [01:35:48 --> 01:35:49] but you're hoping that it will. [01:35:49 --> 01:35:51] You'd like to add something to the event, [01:35:51 --> 01:35:56] so I need to know what your process is. [01:35:56 --> 01:35:58] So tonight's the, [01:35:58 --> 01:36:02] oh, okay, so the bylaws don't necessarily [01:36:02 --> 01:36:03] address that right now, [01:36:03 --> 01:36:06] but your concern has been noted in it, [01:36:06 --> 01:36:09] and the lecture that the, when the bylaws are revised [01:36:09 --> 01:36:10] based on all of the comments from all [01:36:10 --> 01:36:12] of the committee members tonight, [01:36:12 --> 01:36:13] is that question is it. [01:36:13 --> 01:36:15] Thank you. [01:36:15 --> 01:36:17] So next meeting is a special meeting. [01:36:17 --> 01:36:20] That's what you call a meeting when some, [01:36:20 --> 01:36:22] so you cannot wait for the next regular meeting. [01:36:22 --> 01:36:25] It goes on 24 hours written notice, [01:36:25 --> 01:36:27] close to 24 hours ahead, [01:36:27 --> 01:36:30] and the, and the notice has to state the business. [01:36:30 --> 01:36:32] The key limitation is that you could only do the business [01:36:32 --> 01:36:36] described in the notice for a special meeting and nothing else. [01:36:36 --> 01:36:38] So you can't say, well, we're all here. [01:36:38 --> 01:36:42] Let's also discuss that a special meeting. [01:36:42 --> 01:36:45] An emergency meeting is a genuinely narrow tool, [01:36:45 --> 01:36:48] a work stoppage, a disaster of public facilities [01:36:48 --> 01:36:50] that demand plot action. [01:36:50 --> 01:36:54] The notice is reduced to as little as one hour to the media [01:36:54 --> 01:36:57] and the business is limited to the emergency itself. [01:36:57 --> 01:36:59] We're finding a adjourned meeting [01:36:59 --> 01:37:03] the continuation of a meeting that you already started, [01:37:03 --> 01:37:06] picked up in a stated later time and place, [01:37:06 --> 01:37:09] what you can do carries on from the original meeting. [01:37:09 --> 01:37:12] The takeaway I would leave with you is that the more compressed [01:37:12 --> 01:37:15] the notice, the narrower the scope of what you can do [01:37:15 --> 01:37:16] in the meeting, that there are meetings [01:37:16 --> 01:37:19] giving the most latitude, special and emergency meetings [01:37:19 --> 01:37:22] walking into the stated business. [01:37:22 --> 01:37:26] When you're doubt asked staff which type of meeting [01:37:26 --> 01:37:30] you're in before you leave and you're talking. [01:37:30 --> 01:37:32] So agenda posting requirements, [01:37:32 --> 01:37:36] the specific posting requirements for regular meeting [01:37:36 --> 01:37:38] agenda is important to come up to the agenda [01:37:38 --> 01:37:40] to really be matter of. [01:37:40 --> 01:37:43] It has to be posted at least 72 hours in advance [01:37:43 --> 01:37:46] and in two places, so more freely accessible [01:37:46 --> 01:37:49] to the public and on the agency's website, [01:37:49 --> 01:37:51] both posting on the door of the site [01:37:51 --> 01:37:54] or on the site, but not a public spot [01:37:54 --> 01:37:57] is not satisfied the agenda goes to rule. [01:37:57 --> 01:38:00] Each item needs a brief general description [01:38:00 --> 01:38:02] of the general item. [01:38:02 --> 01:38:05] Four items is 20 words or fewer. [01:38:05 --> 01:38:06] The test is functional. [01:38:06 --> 01:38:08] Is it enough to tell them work in public [01:38:08 --> 01:38:10] which are actually going to discuss? [01:38:10 --> 01:38:13] That applies to closed session items too. [01:38:13 --> 01:38:15] They get described even with a discussion [01:38:15 --> 01:38:18] in closed session itself is private. [01:38:18 --> 01:38:20] For special meeting of timeline compressors, [01:38:20 --> 01:38:22] the agenda and the notice go up at each 20 collage [01:38:22 --> 01:38:27] head and you're limited to the business described. The practical have it here is to [01:38:27 --> 01:38:32] exist they catch all item descriptions if the wording is not genuinely tell the [01:38:32 --> 01:38:35] public what's coming it's a defecative agenda and not [01:38:35 --> 01:38:45] congeveredized whatever action you take on that item. So the this is the rule [01:38:45 --> 01:38:48] that protects the Sunni to our pharmacy is heard about if it's not on the [01:38:48 --> 01:38:52] coast of the agenda the committee may not take action on it and may not hold [01:38:52 --> 01:38:57] and the public was told what you'd be discussing [01:38:57 --> 01:39:00] and you'd have to stay within that. [01:39:00 --> 01:39:02] Now that doesn't mean you'd have to sit in silence [01:39:02 --> 01:39:03] when something comes up. [01:39:03 --> 01:39:05] You can briefly respond to public comment, [01:39:05 --> 01:39:07] ask a question, even share it forward [01:39:07 --> 01:39:10] or for a matter of a staff for a future agenda. [01:39:10 --> 01:39:12] What you can't do is start debating it [01:39:12 --> 01:39:14] or deciding it. [01:39:14 --> 01:39:17] The line is between acknowledging something [01:39:17 --> 01:39:19] and taking it out. [01:39:19 --> 01:39:21] So when a member of the public raises a great point [01:39:21 --> 01:39:23] during public comment about something [01:39:23 --> 01:39:25] that is not on the agenda. [01:39:25 --> 01:39:28] The right move is not to solve it on the spot. [01:39:28 --> 01:39:31] The right move is to say, let's put that on a future agenda [01:39:31 --> 01:39:33] or staff, can you please look into that? [01:39:33 --> 01:39:35] That instinct will keep you completely [01:39:35 --> 01:39:36] at the ground. [01:39:36 --> 01:39:38] There are narrow exceptions where you can add [01:39:38 --> 01:39:41] off agenda and are deliberately hard to meet. [01:39:41 --> 01:39:44] One is where the majority declares an emergency [01:39:44 --> 01:39:46] and two is a two-thirds finding [01:39:46 --> 01:39:48] that immediate action is needed [01:39:48 --> 01:39:51] on something that arose after the agenda was posted. [01:39:52 --> 01:39:54] It needs to be a supermajority and it [01:39:54 --> 01:39:57] has to have a reason why the agenda was posted. [01:39:57 --> 01:40:00] And then third, if it's a properly continued item [01:40:00 --> 01:40:03] from an earlier meeting that can be discussed outside [01:40:03 --> 01:40:07] those off-agenda items of agenda. [01:40:07 --> 01:40:10] Off-agenda action waits for the next agenda. [01:40:10 --> 01:40:14] So the takeaways, when doubt don't act, refer it forward. [01:40:14 --> 01:40:16] When it's agendized that is almost all [01:40:16 --> 01:40:18] of the situation I assume. [01:40:18 --> 01:40:22] So the public's right at public meetings. [01:40:22 --> 01:40:24] The public has three core rights at your meetings [01:40:24 --> 01:40:26] and it helps to think of them as attend, [01:40:26 --> 01:40:28] comment, and record. [01:40:28 --> 01:40:28] First, attend. [01:40:28 --> 01:40:31] Every open session is open to anyone. [01:40:31 --> 01:40:33] You don't have to sign in. [01:40:33 --> 01:40:35] They don't have to state their name to be signed in. [01:40:35 --> 01:40:37] Chief, can we offer it, but it can never be [01:40:37 --> 01:40:39] a condition of attending? [01:40:39 --> 01:40:42] Second, it's common that you write every meeting agenda [01:40:42 --> 01:40:44] has to get the public a chance to address you [01:40:44 --> 01:40:47] on any item within your jurisdiction. [01:40:47 --> 01:40:48] You can set reasonable time limits [01:40:48 --> 01:40:50] to keep those orders. [01:40:50 --> 01:40:52] that here's the part they want to stress. [01:40:52 --> 01:40:55] You may not prohibit the contents of the comments. [01:40:55 --> 01:40:57] Even when the content is pointing, [01:40:57 --> 01:41:00] you can regulate the time and manner [01:41:00 --> 01:41:02] without the viewpoint. [01:41:02 --> 01:41:05] Unless the viewpoint consists of true threats of force [01:41:05 --> 01:41:08] or violence or use of force or conduct [01:41:08 --> 01:41:10] that actually disrupts the meaning, [01:41:10 --> 01:41:13] fails to be part of legal law for the court regulation [01:41:13 --> 01:41:15] or willful group interruption [01:41:15 --> 01:41:17] that makes the meeting unfeasible. [01:41:17 --> 01:41:20] Cutting someone off because of what they are saying [01:41:20 --> 01:41:22] to our committees get into real trouble. [01:41:22 --> 01:41:24] The meeting there is recorded. [01:41:24 --> 01:41:28] Any attendee can audio or video record an open meeting. [01:41:28 --> 01:41:30] You can only stop it if you make a reasonable finding [01:41:30 --> 01:41:33] that the recording is actually disrupting the meeting. [01:41:33 --> 01:41:35] And that's a genuine disruption, [01:41:35 --> 01:41:38] not just your discomfort at being filmed. [01:41:38 --> 01:41:40] So the unifying takeaway is your authority [01:41:40 --> 01:41:45] is over time and ordered, not content for access. [01:41:45 --> 01:41:47] You can regulate how the public participates [01:41:47 --> 01:41:49] if you cannot regulate whether they do [01:41:49 --> 01:41:53] or what they say. [01:41:53 --> 01:41:54] So closed sessions are allowed. [01:41:54 --> 01:41:56] Everything that sets apart is not openness, [01:41:56 --> 01:41:58] so we can talk about the exception, [01:41:58 --> 01:42:00] which is closed session or sometimes [01:42:00 --> 01:42:02] called executive session. [01:42:02 --> 01:42:04] These are the narrow windows where you're allowed [01:42:04 --> 01:42:05] to meet privately. [01:42:05 --> 01:42:07] Then the key word is narrow. [01:42:07 --> 01:42:09] You can build a closed session only for the specific [01:42:09 --> 01:42:11] subjects that the statute lists, [01:42:11 --> 01:42:15] not whenever a topic feels sensitive or awkward. [01:42:15 --> 01:42:17] This can likely not have closed sessions [01:42:17 --> 01:42:19] on its agendas given its function, [01:42:19 --> 01:42:21] but I will address some of the common exceptions. [01:42:21 --> 01:42:22] There's the personnel exception, [01:42:22 --> 01:42:25] which is the important employment evaluation [01:42:25 --> 01:42:27] disciplinary dismissal of an employee [01:42:27 --> 01:42:29] or hearing complaints against one. [01:42:29 --> 01:42:32] There's the pending litigation exception [01:42:32 --> 01:42:35] where you can confer privately with legal counsel [01:42:35 --> 01:42:37] when discussing it in open [01:42:37 --> 01:42:39] with prejudice to agencies position. [01:42:39 --> 01:42:41] That point is to protect legal strategy [01:42:41 --> 01:42:44] not to hide the fact that litigation exists. [01:42:44 --> 01:42:46] Another common exception [01:42:46 --> 01:42:50] in terms of negotiations and labor negotiations, [01:42:50 --> 01:42:52] and a handful of other recent categories [01:42:52 --> 01:42:54] of the common thread is that these situations [01:42:54 --> 01:42:56] will have a discussion with other mind [01:42:56 --> 01:42:59] of the very thing it's going to accomplish. [01:42:59 --> 01:43:01] But the part that I want to bring up [01:43:01 --> 01:43:04] is even the closed session item has to be described [01:43:04 --> 01:43:05] on the post-agenda. [01:43:05 --> 01:43:07] Part of the CIFI to the discussion, [01:43:07 --> 01:43:09] not to the fact that it's happening. [01:43:09 --> 01:43:11] The public still gets to know your meeting [01:43:11 --> 01:43:13] and it doesn't turn what about. [01:43:13 --> 01:43:15] So the takeaway is the closed session [01:43:15 --> 01:43:18] in the short fixed list, if your topic isn't on it, [01:43:18 --> 01:43:20] if you're on it, send it over to the session. [01:43:20 --> 01:43:23] But if you're unsure, whether something quantifies [01:43:23 --> 01:43:28] task capital before you clear the room, not after you. [01:43:28 --> 01:43:31] Close session allows you to privacy for the discussion. [01:43:31 --> 01:43:34] It does not allow you secrecy about the outcomes. [01:43:34 --> 01:43:35] When you take an action in close session, [01:43:35 --> 01:43:37] the committee has to come back out [01:43:37 --> 01:43:39] and publicly report it along with the vote [01:43:39 --> 01:43:41] or extension of each member present. [01:43:41 --> 01:43:43] So if you approve any action behind closed doors, [01:43:43 --> 01:43:46] to the public who have learned what you decided [01:43:46 --> 01:43:48] and how you should be voted. [01:43:48 --> 01:43:50] So the deliberation stays confidential, [01:43:50 --> 01:43:53] but the action and the votes come out into the element. [01:43:53 --> 01:43:55] Part of seeking the answer to conversation [01:43:55 --> 01:43:57] is not the decision alone. [01:43:57 --> 01:44:00] And no decision can ever be made by secret talent. [01:44:00 --> 01:44:02] Whether it's preliminary straw hole or the final vote, [01:44:02 --> 01:44:04] every member's position has to be [01:44:04 --> 01:44:05] a forgivable to that member. [01:44:05 --> 01:44:07] Anonymous voting does not have any place [01:44:07 --> 01:44:09] in this particular committee. [01:44:09 --> 01:44:11] The flip side of the confidentiality coin [01:44:11 --> 01:44:16] is what second closed session needs to stay in closed session. [01:44:16 --> 01:44:19] Disclosing those discussions in itself by the act [01:44:19 --> 01:44:22] and can wait for agencies to turn client privilege, which [01:44:22 --> 01:44:25] is exactly the protection of closed session, [01:44:25 --> 01:44:27] it was created to preserve it. [01:44:27 --> 01:44:29] So leaking closed session content [01:44:29 --> 01:44:30] does not just reach trust. [01:44:30 --> 01:44:32] It can strip away the legal cover [01:44:32 --> 01:44:35] if the whole committee was delighted with our work. [01:44:35 --> 01:44:38] So the takeaway is to report the result faithfully [01:44:38 --> 01:44:40] to protect the discussion completely [01:44:40 --> 01:44:44] and never vote in a way that fights where you stood. [01:44:44 --> 01:44:48] So remote participation, we can go to that briefly. [01:44:48 --> 01:44:51] The rules here are more flexible than they used to be, [01:44:51 --> 01:44:54] which then makes them easier to get wrong. [01:44:54 --> 01:44:56] So starting with standard teleconferencing, [01:44:56 --> 01:44:58] it is allowed that on conditions, [01:44:58 --> 01:45:02] the agenda has to be posted at each remote location, [01:45:02 --> 01:45:04] each of those locations has to be open to the public, [01:45:04 --> 01:45:06] and every vote is taken by a roll call. [01:45:06 --> 01:45:08] In other words, if you're calling in from home, [01:45:08 --> 01:45:13] that spot becomes a public meeting location for that meeting. [01:45:13 --> 01:45:15] Over the years, California is later [01:45:15 --> 01:45:18] about more flexible or more participation options. [01:45:19 --> 01:45:22] One you probably live through is emergency teleconferencing [01:45:22 --> 01:45:24] available during a complaint or emergency [01:45:24 --> 01:45:27] to a meeting person who posts imminent teleconferencing [01:45:27 --> 01:45:28] to be risked. [01:45:28 --> 01:45:31] That flexibility is not automatic or permanent [01:45:31 --> 01:45:33] in subject to periodic refinings. [01:45:33 --> 01:45:35] So the committee has to keep it further [01:45:35 --> 01:45:39] conditions so far that you can do that here at the council. [01:45:39 --> 01:45:41] Several of these provisions were amended [01:45:41 --> 01:45:43] in the fact of January 1st, 2026. [01:45:43 --> 01:45:46] So this is really a moving area of the law. [01:45:46 --> 01:45:49] Before you rely on any remote format [01:45:49 --> 01:45:51] which location is posted, the trial should apply. [01:45:51 --> 01:45:53] It's what findings you need. [01:45:53 --> 01:45:55] You need to confirm the current procedure [01:45:55 --> 01:45:57] with your committee's council. [01:45:57 --> 01:46:00] Don't run this year's meeting on last year's rulebook. [01:46:00 --> 01:46:03] So the takeaway is remote participation is available [01:46:03 --> 01:46:04] when it comes to the screens. [01:46:04 --> 01:46:07] public access at your location and local folks. [01:46:07 --> 01:46:09] And the specifics are in flux. [01:46:09 --> 01:46:11] When in doubt, a remote format, [01:46:11 --> 01:46:14] checkmate helps out. [01:46:14 --> 01:46:16] So what actually happens when the act is violated? [01:46:16 --> 01:46:17] If the latter are consequences, [01:46:17 --> 01:46:20] it helps to see all three rounds. [01:46:20 --> 01:46:21] The first is pure and correct. [01:46:21 --> 01:46:24] It's actually a protection for you as a committee. [01:46:24 --> 01:46:26] Before anyone can see it, avoid an action [01:46:26 --> 01:46:28] in the district attorney or any interested person [01:46:28 --> 01:46:31] has to send a written demand that identifies [01:46:31 --> 01:46:33] the violation and the committee gets a chance to fix it. [01:46:33 --> 01:46:35] That's your offer. [01:46:35 --> 01:46:37] A lot of honest mistakes never become lost [01:46:37 --> 01:46:39] because the agency took the demand seriously [01:46:39 --> 01:46:41] and corrected course. [01:46:41 --> 01:46:44] If it isn't fewer, then you move to civil actions. [01:46:44 --> 01:46:46] A court can step in with a mandamus, [01:46:46 --> 01:46:48] injunct it or declare it as already relief, [01:46:48 --> 01:46:51] meaning it can order you to stop or undo an action [01:46:51 --> 01:46:53] that you improperly took. [01:46:53 --> 01:46:56] And please note this, that a purgator of the state [01:46:56 --> 01:46:58] can recover attorney's fees, [01:46:58 --> 01:47:00] so the cost isn't just reversing your decision, [01:47:00 --> 01:47:03] It can also be paying the other side's equal bills. [01:47:03 --> 01:47:05] So the last one is criminal, [01:47:05 --> 01:47:08] and I want to be precise about how narrow that is [01:47:08 --> 01:47:10] because it often gets overstated. [01:47:10 --> 01:47:14] It's a misdemeanor only where a member attends a meeting [01:47:14 --> 01:47:17] where an action is taken in violation of the act [01:47:17 --> 01:47:20] and does so intending to deprive the public [01:47:20 --> 01:47:22] of information the member knows [01:47:22 --> 01:47:25] or has reason to know and the public is entitled to. [01:47:25 --> 01:47:28] That is a specific intent standard. [01:47:28 --> 01:47:31] this aimed at deliberate concealment, [01:47:31 --> 01:47:35] not at the honest, hallway conversation mistakes [01:47:35 --> 01:47:37] that we've been talking about during this training. [01:47:37 --> 01:47:40] So to take great ties back to where we started, [01:47:40 --> 01:47:42] most violations are unintentional, [01:47:42 --> 01:47:43] and the current correct process exists [01:47:43 --> 01:47:46] precisely to fix those unintentional mistakes. [01:47:46 --> 01:47:48] Take it to the end, let it seriously, [01:47:48 --> 01:47:49] we've been counseled early, [01:47:49 --> 01:47:51] and the vast majority of problems get resolved [01:47:51 --> 01:47:53] long before our courtrooms, [01:47:53 --> 01:47:57] or they've been criminal, is ever in the picture. [01:47:57 --> 01:48:00] So, committee member views and notes about the Brown Act. [01:48:00 --> 01:48:02] If you forget everything else from this treaty, [01:48:02 --> 01:48:05] please take this to this review. [01:48:05 --> 01:48:09] They are the whole orientation to still in two products. [01:48:09 --> 01:48:12] On the due side, it really comes down to one instinct, [01:48:12 --> 01:48:14] keep the business in the room, [01:48:14 --> 01:48:16] keep your discussion and your decisions [01:48:16 --> 01:48:18] in the notes meeting when they belong. [01:48:18 --> 01:48:19] When the new topic surfaces, [01:48:19 --> 01:48:21] insist it go on a future agenda, [01:48:21 --> 01:48:23] rather than taking it up on the spot. [01:48:23 --> 01:48:26] Treat every email and text about committee businesses [01:48:26 --> 01:48:29] if it was, if it will one day be a public record [01:48:29 --> 01:48:30] because it can be. [01:48:30 --> 01:48:32] And when you're heading into court session [01:48:32 --> 01:48:33] or so they have a remote meeting, [01:48:33 --> 01:48:36] ask counsel first, not after. [01:48:36 --> 01:48:41] On the don't side, notice that these are, excuse me, [01:48:41 --> 01:48:44] notice that these are mostly the small everyday moves [01:48:44 --> 01:48:45] that trap sweet over good. [01:48:45 --> 01:48:47] Don't discuss committee business [01:48:47 --> 01:48:51] with the majority outside of meeting and before. [01:48:51 --> 01:48:54] Don't apply all or four members' views [01:48:54 --> 01:48:56] on agenda items, don't act on something [01:48:56 --> 01:48:58] It isn't on the agenda and don't disclose what the said [01:48:58 --> 01:49:01] in the process of discussion. [01:49:01 --> 01:49:03] So here's your writing thread through both collos. [01:49:03 --> 01:49:07] Almost none of this required you to be a Brown Act expert. [01:49:07 --> 01:49:08] It requires one reflex. [01:49:08 --> 01:49:10] When in doubt, take it to the notice meeting [01:49:10 --> 01:49:12] and ask your counsel. [01:49:12 --> 01:49:15] Do that and you'll steer clear of nearly every violation [01:49:15 --> 01:49:16] that we have covered. [01:49:18 --> 01:49:19] That's the promise that we started, [01:49:19 --> 01:49:21] that these rules protect the public's trust [01:49:21 --> 01:49:23] and they protect you. [01:49:23 --> 01:49:25] They keep your decisions valid, defensible, [01:49:25 --> 01:49:26] and above question. [01:49:26 --> 01:49:28] All of the habits on this slide in the act [01:49:28 --> 01:49:30] sucks feeling one set of traps [01:49:30 --> 01:49:32] and starts looking the way it's meant to [01:49:32 --> 01:49:33] as your protection. [01:49:34 --> 01:49:37] So we've spent the beginning part of this training [01:49:37 --> 01:49:38] on how you meet in the opening. [01:49:38 --> 01:49:40] The California Public Records Act [01:49:40 --> 01:49:43] is the other half of opening government. [01:49:43 --> 01:49:45] How the public sees your records. [01:49:45 --> 01:49:46] And it's not just a statute, [01:49:46 --> 01:49:49] it rests on a constitutional right of access [01:49:49 --> 01:49:51] to government records written into Article I, [01:49:51 --> 01:49:54] Section III of the California Constitution. [01:49:54 --> 01:49:56] That constitutional footing matters [01:49:56 --> 01:49:57] because of how the courts read it. [01:49:57 --> 01:50:00] Access provisions are construed broadly. [01:50:00 --> 01:50:05] So the basic rule is to almost always lean on, [01:50:05 --> 01:50:08] lean from the scale towards disclosure. [01:50:08 --> 01:50:10] When a record is a close call, [01:50:10 --> 01:50:13] the little means towards releasing it, not the holding up. [01:50:13 --> 01:50:15] For the citation minded, [01:50:15 --> 01:50:16] the California Couples Records Act [01:50:16 --> 01:50:18] now lives in the government code starting at section [01:50:18 --> 01:50:23] seven nine two zero point zero zero zero. [01:50:23 --> 01:50:27] If you previously learned the CPRA at section 6250 [01:50:27 --> 01:50:29] in following, you're not wrong. [01:50:29 --> 01:50:31] It was recodified in 2023. [01:50:31 --> 01:50:35] So the old numbers were renumbered, [01:50:35 --> 01:50:37] but the substance did carry over. [01:50:37 --> 01:50:38] So don't be thrown at the seat, [01:50:38 --> 01:50:41] both citations floating around. [01:50:41 --> 01:50:43] The takeaway to carry into the next two slides [01:50:43 --> 01:50:44] is that the vault is open. [01:50:44 --> 01:50:46] It's just as the readings. [01:50:46 --> 01:50:49] The question isn't why should the public get this? [01:50:49 --> 01:50:53] It is, is there a specific reason they can't? [01:50:53 --> 01:50:55] So it counts as a public record. [01:50:55 --> 01:50:57] It's any writing in that expressly includes emails, [01:50:57 --> 01:51:00] texts, and recordings that the agency prepared, [01:51:00 --> 01:51:03] owns, uses, or retains in the conduct [01:51:03 --> 01:51:05] of the public's business. [01:51:05 --> 01:51:08] You don't have to do the one that created it. [01:51:08 --> 01:51:11] If your agency and your committee uses it [01:51:11 --> 01:51:13] or holds onto it for public business, [01:51:13 --> 01:51:14] it can be a public record. [01:51:14 --> 01:51:17] This is exactly why it was mentioned earlier [01:51:17 --> 01:51:19] to treat your emails and texts as public. [01:51:19 --> 01:51:22] It's not a figure of speech under this definition. [01:51:22 --> 01:51:25] A text about committee business on a personal phone [01:51:25 --> 01:51:27] can be a disposable public record. [01:51:27 --> 01:51:29] The medium doesn't shield it. [01:51:29 --> 01:51:31] The subject matter is what controls it. [01:51:31 --> 01:51:34] So one firm element is the agency doesn't have to create [01:51:34 --> 01:51:36] a record that does not already exist. [01:51:36 --> 01:51:38] The public records act is a right to obtain [01:51:38 --> 01:51:41] existing records, not a right to make the agency [01:51:41 --> 01:51:45] generate new analyses or answer questions. [01:51:45 --> 01:51:47] On timing, it is clock. [01:51:47 --> 01:51:50] The agency has 10 days to determine whether a request [01:51:50 --> 01:51:53] seeks discloseable records and they must notify [01:51:53 --> 01:51:56] the request of a visit in 10 days. [01:51:56 --> 01:51:59] However, that 10 day period is the decision deadline [01:51:59 --> 01:52:01] not necessarily the production deadline. [01:52:01 --> 01:52:05] In unusual circumstances, the 10 days can be extended [01:52:05 --> 01:52:06] to 14 days. [01:52:06 --> 01:52:09] Once the records are identified as non-exempt, [01:52:09 --> 01:52:10] they have to be produced properly [01:52:10 --> 01:52:13] to get out within 10 days, but properly. [01:52:13 --> 01:52:15] So the takeaway of it from this is that [01:52:15 --> 01:52:17] the definition of a record is broad, [01:52:17 --> 01:52:20] the clock starts fast and then we're folding [01:52:20 --> 01:52:22] And withholding is the neural exception [01:52:22 --> 01:52:26] that has to be justified line by line, never to be false. [01:52:26 --> 01:52:29] So let me close the loop on something [01:52:29 --> 01:52:31] I can talk to you about, your personal phone [01:52:31 --> 01:52:33] and your personal accounts. [01:52:33 --> 01:52:35] When a public official or an employee [01:52:35 --> 01:52:36] uses a personal account or a device [01:52:36 --> 01:52:39] to communicate about the conduct of public business, [01:52:39 --> 01:52:41] those rights may be subject to disclosure [01:52:41 --> 01:52:43] under the Public Records Act. [01:52:43 --> 01:52:46] It's the subject, not the device that controls. [01:52:46 --> 01:52:49] So using your personal phone, email, or private messaging [01:52:49 --> 01:52:52] half does not put committee business beyond public's reach. [01:52:52 --> 01:52:55] There is no personal device loophole. [01:52:55 --> 01:52:56] If it's about the public's business, [01:52:56 --> 01:52:59] or you type it, it does not say that from the sort of. [01:52:59 --> 01:53:02] And here's where the two laws we've covered today come together. [01:53:02 --> 01:53:05] We've received emails and texts that create the serial [01:53:05 --> 01:53:06] reading risk of the grant. [01:53:06 --> 01:53:09] There are also public records of the public record tax. [01:53:09 --> 01:53:12] Boycareless group tax can be both a grant by addition [01:53:12 --> 01:53:14] and a disposable record. [01:53:14 --> 01:53:16] Two separate slurs, one message. [01:53:16 --> 01:53:20] which is why the safest habit is also the simplest habit. [01:53:20 --> 01:53:22] Conduct committee business in the meeting [01:53:22 --> 01:53:25] and assume everything you write about it is public. [01:53:25 --> 01:53:27] Do those two paints, they're protected [01:53:27 --> 01:53:31] under both laws and laws. [01:53:31 --> 01:53:36] Any questions? [01:53:36 --> 01:53:37] Maybe. [01:54:05 --> 01:54:07] So we are also going to be overview [01:54:07 --> 01:54:11] of formation of committee and include violence. [01:54:11 --> 01:54:15] Then we move down to item eight, [01:54:15 --> 01:54:18] discussion and action items. [01:54:18 --> 01:54:23] where I am 8A, the New Mons selection of officers. [01:54:23 --> 01:54:28] At this time, I do have simple but common, [01:54:28 --> 01:54:30] and I wanna verify that you have eight. [01:54:30 --> 01:54:31] This is like the eight, [01:54:31 --> 01:54:34] but I'm not sure if it's 8A or 8B. [01:54:34 --> 01:54:35] Mr. Tyson? [01:54:37 --> 01:54:38] A. [01:54:38 --> 01:54:40] Mr. Gannon? [01:54:40 --> 01:54:41] Mr. Gannon. [01:54:41 --> 01:54:42] Okay. [01:54:42 --> 01:54:43] So our first speaker, [01:54:43 --> 01:54:45] I'll take a comment first when I know [01:54:45 --> 01:54:50] our first speaker is Steve Tyson. [01:54:50 --> 01:54:52] I'm going to go ahead and make a selection of models. [01:54:52 --> 01:54:53] Sure. [01:54:53 --> 01:54:59] Great. [01:54:59 --> 01:55:01] Well, yeah, let's get on Jay Tyson. [01:55:01 --> 01:55:02] Sounds pretty interesting. [01:55:02 --> 01:55:06] If you talk about it, because there's a lot of things anyway [01:55:06 --> 01:55:10] that have happened over the last 10 months. [01:55:10 --> 01:55:14] Yeah, I mean just the CQRAs, 24 days, [01:55:14 --> 01:55:17] I mean I've waited like 7 CQRAs done with this [01:55:17 --> 01:55:19] 4-simletons. [01:55:19 --> 01:55:24] So, just having these students right here, [01:55:24 --> 01:55:29] I think is a injustice to this whole committee anyway. [01:55:29 --> 01:55:31] Because they report back to the office. [01:55:31 --> 01:55:33] Mr. Tyson, the item that's recorded. [01:55:33 --> 01:55:35] Yeah, I know what I'm going to talk about. [01:55:35 --> 01:55:36] Talk about it. [01:55:36 --> 01:55:45] You know, it's supervised twice. [01:55:45 --> 01:55:48] You voted for the illegal law firm. [01:55:48 --> 01:55:49] OK, you did. [01:55:49 --> 01:55:53] And I watched the developer sitting in the front row. [01:55:53 --> 01:55:55] OK, he's hypercosas. [01:55:55 --> 01:55:59] He donated $4,000 to your campaign. [01:55:59 --> 01:56:03] And you possibly could have broke the living net. [01:56:03 --> 01:56:05] So I don't know if you should be in the summer. [01:56:05 --> 01:56:07] I really don't. [01:56:07 --> 01:56:14] That's a big question right now. [01:56:14 --> 01:56:16] Have you accepted campaign contributions from the government? [01:56:16 --> 01:56:17] I'm Chair Kyson. [01:56:17 --> 01:56:20] Again, I am going to ask you to focus on the Zodiac [01:56:20 --> 01:56:21] Chair of all the guests. [01:56:21 --> 01:56:23] Which is Chair, Vice Chair, and Secretary. [01:56:23 --> 01:56:25] Yeah, the Chair. [01:56:25 --> 01:56:28] I think I think I don't think she's going through this. [01:56:28 --> 01:56:29] I'm sure. [01:56:29 --> 01:56:30] At this time, we're not. [01:56:30 --> 01:56:31] We don't have a chair. [01:56:31 --> 01:56:35] And it's expressing your opinion on. [01:56:35 --> 01:56:36] On the chair, right? [01:56:36 --> 01:56:38] On who to vote for and who not to, right? [01:56:38 --> 01:56:39] That's correct. [01:56:39 --> 01:56:39] OK, great. [01:56:39 --> 01:56:42] So I'm saying I don't want people to vote for a pay device. [01:56:42 --> 01:56:44] Is that OK? [01:56:44 --> 01:56:48] OK, that's what I'm saying. [01:56:48 --> 01:56:56] For like 10 months, we were lied to. [01:56:56 --> 01:56:59] It was in secret. [01:56:59 --> 01:57:01] This whole thing that we're here because of this, [01:57:01 --> 01:57:05] we're here because of the court decision, right? [01:57:05 --> 01:57:09] And once again, I'm gonna agree with Mr. Handy. [01:57:09 --> 01:57:10] This is putting the cart before the warts. [01:57:10 --> 01:57:13] Once again, it really is. [01:57:13 --> 01:57:16] It really feels like it. [01:57:16 --> 01:57:18] It feels like political custody. [01:57:18 --> 01:57:20] So, and she just went through all this stuff [01:57:20 --> 01:57:24] with the Brown Act and your privacy [01:57:24 --> 01:57:27] and your discussion, who you're gonna talk to. [01:57:27 --> 01:57:29] Well, I mean, just these two folks sitting here, [01:57:29 --> 01:57:36] When they go back to their office, how are they not going to talk about it? [01:57:36 --> 01:57:43] To the person who's connected with Mr. Rocheteville. [01:57:43 --> 01:57:48] We have some serious issues happening in this county right now. [01:57:48 --> 01:57:49] And it's not just this. [01:57:49 --> 01:57:58] And not with people, with the agency. [01:57:58 --> 01:58:01] We don't want, you know, we waste time. [01:58:01 --> 01:58:03] We don't want this to keep being a waste of time. [01:58:03 --> 01:58:05] We want to be productive here. [01:58:05 --> 01:58:08] And you want to find somebody who's really going to do a good job. [01:58:49 --> 01:58:51] that it is set for insurance too. [01:58:51 --> 01:58:53] So I have a problem with that. [01:58:53 --> 01:58:55] Now I do have a problem with the fact [01:58:55 --> 01:58:58] that this Board of Advisory had to apply [01:58:58 --> 01:59:01] to the County Board of Supervisors. [01:59:01 --> 01:59:03] It had to have the applications to you [01:59:03 --> 01:59:06] and you had to approve those applications. [01:59:06 --> 01:59:09] Therefore it's not really an advisory board. [01:59:09 --> 01:59:12] You've approved the people you want to advise you. [01:59:12 --> 01:59:14] I have a problem with that, I really do. [01:59:14 --> 01:59:18] I don't understand how the entity [01:59:18 --> 01:59:21] that is so involved with this data center, [01:59:21 --> 01:59:23] the approval of, the approval of, [01:59:23 --> 01:59:25] the problem that we've had before, [01:59:25 --> 01:59:28] could be in any position on the board right now, [01:59:28 --> 01:59:31] be it chairperson, vice chair, or anything. [01:59:31 --> 01:59:33] You're too involved in the bottom layer [01:59:33 --> 01:59:35] of this to be objective. [01:59:35 --> 01:59:38] Now, everybody here represents a different segment, [01:59:38 --> 01:59:40] be it a labor, be it a town, be it whatever. [01:59:40 --> 01:59:42] We live out in the middle of nowhere, [01:59:42 --> 01:59:43] so like I said, I really don't know [01:59:43 --> 01:59:45] who represents us. [02:00:15 --> 02:00:17] I do have a problem that the board supervisor [02:00:17 --> 02:00:19] is being on this board, chairperson, [02:00:19 --> 02:00:22] any type of officiation. [02:00:22 --> 02:00:24] It's not personal. [02:00:24 --> 02:00:26] I think it's a contradiction. [02:00:26 --> 02:00:30] I think that the conflicts are just too much to overcome. [02:00:30 --> 02:00:32] So that's my opinion on that. [02:00:32 --> 02:00:35] And I like to say, I need some clarification on who I would [02:00:35 --> 02:00:37] give any advice to that I have or any information [02:00:37 --> 02:00:39] that I have in that. [02:00:39 --> 02:00:41] Like I said, we're in the middle of nowhere. [02:00:41 --> 02:00:42] We've blown everybody. [02:00:42 --> 02:00:43] We've blown the middle of it. [02:00:43 --> 02:00:46] So these things need to be clarified. [02:00:46 --> 02:00:47] Thanks. [02:00:47 --> 02:00:48] Thank you. [02:00:48 --> 02:00:51] Thank you. [02:00:51 --> 02:00:53] The House has a little bit of comment. [02:00:53 --> 02:00:59] The presidential officers. [02:00:59 --> 02:01:01] We will now move on to the discussion [02:01:01 --> 02:01:03] of the selection of officers. [02:01:03 --> 02:01:04] This is the air. [02:01:04 --> 02:01:05] Yes. [02:01:05 --> 02:01:07] The air is very long. [02:01:07 --> 02:01:10] So I'm wondering, again, I'm not [02:01:10 --> 02:01:12] interested in becoming chair of the student council. [02:01:12 --> 02:01:15] I'm not interested in becoming chairman. [02:01:15 --> 02:01:18] But I would like to know who is so we could at least [02:01:18 --> 02:01:24] have an idea of who someone would vote for. [02:01:24 --> 02:01:30] And so, I mean, is that within the parameters of the? [02:01:30 --> 02:01:34] So as the clerk of the board and as the person who's [02:01:34 --> 02:01:36] writing this advisory right now, I [02:01:36 --> 02:01:40] did try to make this a little easier. [02:01:40 --> 02:01:43] It is a 19-member committee. [02:01:43 --> 02:01:47] So I did prepare a voting card for members [02:01:47 --> 02:01:50] to have in front of you with your name stated. [02:01:50 --> 02:01:53] And you guys will be able to do a voting [02:01:53 --> 02:01:57] of your chair, vice chair, secretary. [02:01:57 --> 02:02:01] And as soon as you're done with your voting card, [02:02:01 --> 02:02:03] staff will be picking it up, telling us the votes, [02:02:03 --> 02:02:07] and then the votes will come up and discreet. [02:02:07 --> 02:02:10] Based on that results, we can then either, [02:02:10 --> 02:02:12] if the committee is okay, [02:02:12 --> 02:02:16] motion to approve the chair, the vice chair, [02:02:16 --> 02:02:18] and Secretary that obtained the majority vote [02:02:18 --> 02:02:22] based on this committee, there will be the question [02:02:22 --> 02:02:25] whether they want to start prior to us taking a vote. [02:02:25 --> 02:02:27] So if that is something that the committee [02:02:27 --> 02:02:30] is comfortable with, I'm writing with the voting parts [02:02:30 --> 02:02:31] and we can move forward. [02:02:31 --> 02:02:33] So we just write down who. [02:02:33 --> 02:02:37] Yes, you'll be able to select a staff will tally [02:02:37 --> 02:02:47] and then it will show on the screen. [02:02:47 --> 02:02:52] Okay, everybody understanding what the public's saying, [02:02:52 --> 02:02:59] I think we all applied understanding that there is going to be service responsibilities that we're going to have. [02:02:59 --> 02:03:11] I think everybody came in here or should have come in here with the thought that there is a possibility that you may be selected as chair, vice chair, and secretary. [02:03:11 --> 02:03:17] I don't think anybody here should be in a position to say not me, [02:03:17 --> 02:03:22] but I think I am in agreement to say there are certain people that probably shouldn't [02:03:22 --> 02:03:27] be in the chair position or otherwise just based on the fact that they have other titles [02:03:27 --> 02:03:31] within the county that also affect the disease. [02:03:31 --> 02:03:36] Okay? So I think if we're all in agreement with that, [02:03:36 --> 02:03:40] you know, I think everybody should be open to saying we may be selected [02:03:40 --> 02:03:44] And just understand that if this committee says, you know, [02:03:44 --> 02:03:47] we believe in you to be the chair of the vice chair, [02:03:47 --> 02:03:58] that we understand that we are doing that for specific reasons. [02:03:58 --> 02:04:02] Just for the record, and for the view that have a concern, [02:04:02 --> 02:04:06] I am not interested in becoming the chairperson of this committee. [02:04:06 --> 02:04:10] And I don't appreciate false information. [02:04:10 --> 02:04:11] Also, I'm hearing a 4,000. [02:04:11 --> 02:04:14] I am speaking. [02:04:14 --> 02:04:16] I don't appreciate false information being [02:04:16 --> 02:04:18] said about myself. [02:04:18 --> 02:04:21] We can talk later, but the comments that you made [02:04:21 --> 02:04:22] are not true. [02:04:22 --> 02:04:25] Just so the committee is aware, OK? [02:04:25 --> 02:04:28] So, and that's what I'm hoping from this group. [02:04:28 --> 02:04:32] And we can stop all this misinformation, [02:04:32 --> 02:04:33] and we can get to work. [02:04:33 --> 02:04:36] There's a lot that needs to get done in, yes, [02:04:36 --> 02:04:37] a short amount of time. [02:04:37 --> 02:04:41] But if we need more time, we'll take it. [02:04:41 --> 02:04:42] Mr. Happy? [02:04:42 --> 02:04:46] I'll introduce you to the whole issue. [02:04:46 --> 02:04:57] Can you, my question is how the gender community [02:04:57 --> 02:05:01] is going to be open for the leaders? [02:05:01 --> 02:05:06] So as the by all staff, based on what we went through, [02:05:06 --> 02:05:11] the officers, the chair, duties shall be presided, [02:05:11 --> 02:05:13] shall be presided at all DCAC meetings, [02:05:13 --> 02:05:15] serve as committees, vote the person [02:05:15 --> 02:05:18] to the entire county board of supervisors, [02:05:18 --> 02:05:21] direct planning for community sessions [02:05:21 --> 02:05:23] and present its findings to the board of supervisors. [02:05:23 --> 02:05:25] That's pertaining to the chair. [02:05:25 --> 02:05:29] The vice chair, Judith Chobhich, who assists the chair [02:05:29 --> 02:05:33] and in his or her absence, our last chairperson. [02:05:33 --> 02:05:35] As soon as the decision of the chairperson [02:05:35 --> 02:05:39] and the event that the chairperson leaves the DCAC [02:05:39 --> 02:05:41] and the secretary, Judith Chobhich, [02:05:41 --> 02:05:45] shall be to record meetings, minutes of all meetings, [02:05:45 --> 02:05:47] receive and transmit committee correspondence [02:05:47 --> 02:05:50] and materials, designated by members. [02:05:50 --> 02:05:52] Maintain the books of all minutes, [02:05:52 --> 02:05:55] agenda for respondents and then information [02:05:55 --> 02:06:03] pertaining to the GCAC. [02:06:03 --> 02:06:04] We'll get to you. [02:06:04 --> 02:06:09] I just have a quick question. [02:06:09 --> 02:06:11] Are we going to know who's running [02:06:11 --> 02:06:14] or are we just putting down names and then? [02:06:14 --> 02:06:17] No, so if I may, I can add. [02:06:17 --> 02:06:17] This is a sample. [02:06:17 --> 02:06:21] I have one with your names already inputted. [02:06:21 --> 02:06:28] So basically, just so that we can see, you have your member. [02:06:28 --> 02:06:31] And if you want them to be chair, vice chair, and secretary, [02:06:31 --> 02:06:32] you would select. [02:06:32 --> 02:06:37] This is for the well-off members. [02:06:37 --> 02:06:44] Before we conduct the balloting, [02:06:44 --> 02:06:46] I would like to hear from whoever's [02:06:46 --> 02:06:51] interested in being a chair before I vote for whoever [02:06:51 --> 02:06:52] I think of being. [02:06:52 --> 02:06:55] So I'd like to use the opportunity to members [02:06:55 --> 02:06:58] interested in doing it to voice [02:06:58 --> 02:07:00] why they're interested in being the chair, [02:07:00 --> 02:07:03] vice chair, and secretary. [02:07:03 --> 02:07:05] I mean we have one market with [02:07:05 --> 02:07:07] calling before you go. [02:07:07 --> 02:07:12] Thank you very much Robert how I live in [02:07:12 --> 02:07:16] Imperial again I want to make sure that I thank all of you for showing that through [02:07:16 --> 02:07:20] community and it's just great. There's been a few [02:07:20 --> 02:07:24] people that I've gotten to know through the over the last couple of months [02:07:24 --> 02:07:28] that have certainly had an ability to disseminate a lot of [02:07:28 --> 02:07:32] information and are definitely [02:07:32 --> 02:07:37] well first in the issue of data centers and people that I trust to look out for [02:07:37 --> 02:07:42] the public which is your main charge at least to serve the public. So I'll just go [02:07:42 --> 02:07:47] down down the list of people that might consider being on the board the first [02:07:47 --> 02:07:54] most Christian. I think she'd be but I know it's standing remember. Second one, Miss Edwards. [02:07:54 --> 02:07:56] I think you'd be really good. [02:07:56 --> 02:08:00] I think it'd be good if you want to consider it. [02:08:00 --> 02:08:02] Also, Gilbert, yeah, I think you'd [02:08:02 --> 02:08:06] be a great chair or vice chair. [02:08:06 --> 02:08:09] I want to make sure that I didn't miss anybody. [02:08:09 --> 02:08:12] The rest of you vote Mr. Marie also. [02:08:12 --> 02:08:15] The rest of you that I just haven't had much interaction [02:08:15 --> 02:08:19] with, probably many of you are very well qualified also. [02:08:19 --> 02:08:23] Did I mention Michelle Hollinger also going to be brought up? [02:08:23 --> 02:08:26] So anyway, those are my thoughts. [02:08:26 --> 02:08:27] Thank you. [02:08:27 --> 02:08:28] Thank you, Mr. Hoss. [02:08:28 --> 02:08:29] Just a comment. [02:08:29 --> 02:08:33] I think we've heard from the public and also a couple [02:08:33 --> 02:08:35] of already committing members that we're all [02:08:35 --> 02:08:36] going to vote for the ballot. [02:08:36 --> 02:08:39] But I also agree with Mr. Hoss's idea. [02:08:39 --> 02:08:43] And this might get us about whatever's actually [02:08:43 --> 02:08:44] interested in becoming whether it's [02:08:44 --> 02:08:46] chair, secretary, or vice chair, [02:08:46 --> 02:08:48] so that we can all visually make the arguments [02:08:48 --> 02:08:49] of why you're interested in that position. [02:08:49 --> 02:08:50] I think that's a great idea. [02:08:50 --> 02:08:52] And we should both do it in that way. [02:08:52 --> 02:08:54] because I wouldn't want to nominate Mr. George, [02:08:54 --> 02:08:56] but like chair, and like he's actually [02:08:56 --> 02:08:58] present on the position. [02:08:58 --> 02:09:00] So I think that we should move forward. [02:09:00 --> 02:09:01] We've got Peggy, I think, to talk about that [02:09:01 --> 02:09:03] over in a long time. [02:09:03 --> 02:09:04] So I think that's good. [02:09:04 --> 02:09:07] If I may, I would ask for Ms. Umartree [02:09:07 --> 02:09:10] if you could start, or whoever is interested, [02:09:10 --> 02:09:14] take the mic and what's your... [02:09:16 --> 02:09:18] Okay, just, I have a quick question. [02:09:18 --> 02:09:19] I don't know if this is more appropriate [02:09:19 --> 02:09:28] for legal counsel but in the round of training specifically it says like no secretive voting. [02:09:28 --> 02:09:30] It's not a secret valid attack. [02:09:30 --> 02:09:32] How will it open? [02:09:32 --> 02:09:34] It will be open and will be posted. [02:09:34 --> 02:09:39] You will see everything clearly and if you, other records will be kept in my custody. [02:09:39 --> 02:09:41] It's not a secret vote. [02:09:41 --> 02:09:43] How will we as the public view what you see? [02:09:43 --> 02:09:49] You will see as we are inputting the information that we're telling you will be seen in life. [02:09:49 --> 02:09:51] Thank you for the question. [02:09:51 --> 02:09:56] And who voted for it? [02:09:56 --> 02:10:00] Well, I am actually interested in being the chair of the data [02:10:00 --> 02:10:02] center committee. [02:10:02 --> 02:10:06] I'm going to sit in the hall and then, of course, [02:10:06 --> 02:10:10] please determine if you see me to be fit to be the chair. [02:10:10 --> 02:10:12] I will say it is a huge responsibility for anybody [02:10:12 --> 02:10:14] who takes on the chair, the co-chair, [02:10:14 --> 02:10:15] especially the secretary. [02:10:15 --> 02:10:18] That is a lot of work that I'm actually [02:10:18 --> 02:10:21] willing to take on any of those hats and service [02:10:21 --> 02:10:27] the community. So a little bit quickly about myself. So I do have an academic [02:10:27 --> 02:10:32] background. I graduated from San Diego State where I double major in psychology and [02:10:32 --> 02:10:36] environmental studies with a minor in counseling social change. I also have a [02:10:36 --> 02:10:40] master's degree in social science, a troubled state university. It's also [02:10:40 --> 02:10:43] interdisciplinary between the environmental sciences and the social [02:10:43 --> 02:10:47] sciences. I work for the University of California, agriculture [02:10:47 --> 02:10:49] and natural resources, I've already mentioned that. [02:10:49 --> 02:10:53] And a lot of my day job is actually facilitating issues [02:10:53 --> 02:10:57] around conflict resolution and discussion and facilitation. [02:10:57 --> 02:11:00] So it's something I'm very comfortable doing. [02:11:00 --> 02:11:02] I have also spent time, you know, there's a lot of people [02:11:02 --> 02:11:05] here that have been elected officials that have played [02:11:05 --> 02:11:10] this role in other public forums, but I have also served [02:11:10 --> 02:11:12] at the Air Pollution Control District for three, four, [02:11:12 --> 02:11:13] or three years. [02:11:13 --> 02:11:16] I was part of AB 617 when that started. [02:11:16 --> 02:11:19] I'm not sure if you're familiar with the Air Districts [02:11:19 --> 02:11:21] AB 617 committee. [02:11:21 --> 02:11:23] It was a lot more contentious actually than this, [02:11:23 --> 02:11:25] the praising when that started. [02:11:25 --> 02:11:29] And then also I'm part of the ICOE local planning [02:11:29 --> 02:11:31] council committee as a parent. [02:11:31 --> 02:11:34] So I'm very familiar with the structure of the Brown Act. [02:11:34 --> 02:11:35] I've been formally trained to the Brown Act [02:11:35 --> 02:11:38] and I feel very comfortable with setting up agendas [02:11:38 --> 02:11:41] and minutes and then working very closely with the clerk. [02:11:41 --> 02:11:44] Lastly, I do want to hand on some of the comments [02:11:44 --> 02:11:47] made by the public where I have been very vocal [02:11:47 --> 02:11:52] about my criticalness of data center development [02:11:52 --> 02:11:53] in Imperial County. [02:11:53 --> 02:11:55] I'm not shy of that. [02:11:55 --> 02:11:58] And I have also been very vocal at board of supervisor [02:11:58 --> 02:11:59] meetings. [02:11:59 --> 02:12:02] I was very vocal about wanting to have this committee [02:12:02 --> 02:12:04] established, but also pushing forth [02:12:04 --> 02:12:09] a more trying to protect people while we deliberate how [02:12:09 --> 02:12:10] we feel about data centers. [02:12:10 --> 02:12:13] So I just want to say that I've been part of this dialogue [02:12:13 --> 02:12:17] from November it feels like and it's going on a year. [02:12:17 --> 02:12:20] So I'm just welcome in service of being the chair [02:12:20 --> 02:12:22] of the board or the co-chair. [02:12:22 --> 02:12:26] I think the day I'm more about doing the work, [02:12:26 --> 02:12:28] my actions speak louder than when I speak. [02:12:28 --> 02:12:31] So I prefer to just taking the notes, [02:12:31 --> 02:12:34] help facilitating and moving us forward as elected. [02:12:34 --> 02:12:37] So that's my little spiel why I feel like [02:12:37 --> 02:12:47] I should be the chair of this committee. [02:12:47 --> 02:12:49] This is your idea. [02:12:49 --> 02:12:53] Do we plan on going all officers at once [02:12:53 --> 02:12:56] or chair only in the vice chair next? [02:12:56 --> 02:13:01] Just because I wanted to throw my head in for vice chair. [02:13:01 --> 02:13:02] I would follow up. [02:13:02 --> 02:13:06] Anyone who is interested in having a position as an officer [02:13:06 --> 02:13:07] would make their comments. [02:13:07 --> 02:13:08] That's what I would. [02:13:08 --> 02:13:09] OK, perfect. [02:13:09 --> 02:13:12] So hello, everyone. [02:13:12 --> 02:13:14] I'm too short. [02:13:14 --> 02:13:15] My name is Michael Luella. [02:13:15 --> 02:13:15] I'm from Palo Pat. [02:13:15 --> 02:13:19] I serve as mayor and also vice chair of the Imperial County [02:13:19 --> 02:13:22] local agency formation commission. [02:13:22 --> 02:13:24] I'm also a member of the Imperial County [02:13:24 --> 02:13:26] Water Force and Economic Development Youth Committee. [02:13:26 --> 02:13:31] So it's very critical that we set our future generations up [02:13:31 --> 02:13:34] for success through economic development. [02:13:34 --> 02:13:39] But there are some concerns multiple. [02:13:39 --> 02:13:42] Before I graduated high school, both my parents passed away [02:13:42 --> 02:13:46] and my mom left me the greatest gift that she could. [02:13:46 --> 02:13:47] My little brother and I promised her [02:13:47 --> 02:13:49] that I would always be there for him. [02:13:49 --> 02:13:55] And when I see any project, any factor of governance that threatens his life or [02:13:55 --> 02:13:59] my cousins, your family's questions must be asked. [02:13:59 --> 02:14:04] So I just wanted to address the comment that was mentioned earlier, [02:14:04 --> 02:14:16] but I would be willing to serve in any capacity the committee wishes. [02:14:16 --> 02:14:20] Speaking of, I'll say this much, I'm not interested in running for chair. [02:14:20 --> 02:14:26] But my job as a union rep for teachers is the heavy one. [02:14:26 --> 02:14:28] there's a heavy load to that. [02:14:28 --> 02:14:29] We don't have fixed hours. [02:14:29 --> 02:14:30] It's not a nine five job. [02:14:31 --> 02:14:33] It does entail several things. [02:14:34 --> 02:14:35] If you have a little bit of experience, [02:14:35 --> 02:14:39] I am the chair for the safety committee or the county [02:14:39 --> 02:14:42] on that and even that sometimes even as limited as that one [02:14:42 --> 02:14:45] is it still sometimes takes some time. [02:14:45 --> 02:14:47] Having said that though, [02:14:47 --> 02:14:49] I think I pride myself on doing my due diligence [02:14:49 --> 02:14:52] when it comes to reviewing everything, [02:14:52 --> 02:14:55] getting as much information out as possible, [02:14:55 --> 02:15:00] making sure that I'm looking into whatever somebody's telling me. [02:15:00 --> 02:15:03] I don't take anything just with a grain of salt. [02:15:03 --> 02:15:06] I am going to look into it and do my due diligence. [02:15:06 --> 02:15:09] And whether it's appropriate or not, maybe they can tell me. [02:15:09 --> 02:15:14] But I think for me, based on the backgrounds of everybody, [02:15:14 --> 02:15:19] as a committee member here, I would say, [02:15:19 --> 02:15:23] or shall the average, to be Chair Michael Llewellyn, [02:15:23 --> 02:15:26] to be vice chair and senior secretary. [02:15:26 --> 02:15:29] That would be my recommendation for you guys [02:15:29 --> 02:15:33] to both have a base on the history [02:15:33 --> 02:15:38] and the information that they are able to gather [02:15:38 --> 02:15:48] and give out and the experience they have behind them. [02:15:48 --> 02:15:53] I didn't catch the chair. [02:15:53 --> 02:15:56] Should we have a first comment? [02:15:56 --> 02:16:01] Well, as I've heard a lot of people control [02:16:01 --> 02:16:05] One more time. [02:16:05 --> 02:16:15] Well as I said earlier, I've got a lot of experience here locally and regionally and across the state and leadership. [02:16:15 --> 02:16:30] I, as an educator, served as a negotiator for employees, associations, well in those cases. [02:16:30 --> 02:16:38] And I'd like to be chair because I'm from Hobill and Hobill hasn't taken a position, pro or con. [02:16:38 --> 02:16:42] We tend to stay out of the fight for the most part. [02:16:42 --> 02:16:48] Hobill goes about their business and doesn't make a lot of noise over there, but we've made things done. [02:16:48 --> 02:16:51] And that's what I'd like to do for you here. [02:16:51 --> 02:16:55] I'll hear everybody's position. [02:16:55 --> 02:17:00] and I will not try to direct you in any direction, [02:17:01 --> 02:17:05] but I will gather the information and work well with you [02:17:05 --> 02:17:09] in order to move this to a good conclusion. [02:17:10 --> 02:17:11] It's gonna be difficult. [02:17:11 --> 02:17:14] We don't need to kid ourselves at all [02:17:14 --> 02:17:20] because there's passion for this on every side. [02:17:20 --> 02:17:24] But we do deserve the opportunity [02:17:24 --> 02:17:25] to give it its full look, [02:17:25 --> 02:17:27] And that's what I would want to do. [02:17:27 --> 02:17:30] I would start from any particular position, [02:17:30 --> 02:17:34] but I would guide you through the process as your chair. [02:17:34 --> 02:17:43] Thank you. [02:17:43 --> 02:17:44] Thank you. [02:17:44 --> 02:17:49] I appreciate those I mentioned [02:17:49 --> 02:17:52] and they seem to be positively changed, [02:17:52 --> 02:18:02] but I would want to be in a different position. [02:18:04 --> 02:18:07] I would not be able to chair this. [02:18:07 --> 02:18:09] I wouldn't mind the vice chair's bottom. [02:18:09 --> 02:18:10] I'm going to be open. [02:18:10 --> 02:18:13] I mean, you've gone until October 8th. [02:18:13 --> 02:18:17] So probably this will be one medium. [02:18:17 --> 02:18:18] And so I would say I would be more than happy [02:18:18 --> 02:18:23] that everybody, vice chair, I would have a mind. [02:18:23 --> 02:18:25] You don't want to see my writing or recommend a doctor [02:18:25 --> 02:18:28] so you wouldn't want me as a therapy. [02:18:28 --> 02:18:32] But I do appreciate everybody and thank you. [02:18:33 --> 02:18:41] That's a lot of time. [02:18:41 --> 02:18:43] And it's just, my phone's gonna be on the thing. [02:18:43 --> 02:18:44] I'm gonna go up and do this. [02:18:44 --> 02:18:52] I just put myself out there and if you think I'm somebody that could help shepherd this [02:18:54 --> 02:19:01] process along, I'll be up to you. My name is John Redass, sitting on the Broadway City [02:19:01 --> 02:19:07] Council, retired from the County of Imperial Behavioral, worked in the middle of the field [02:19:07 --> 02:19:14] for over 35 or plus years. I have a bachelor's degree, two master's degrees, and served [02:19:14 --> 02:19:18] and served on, currently serving on the Southern Calvary [02:19:18 --> 02:19:23] Association of Governments, the CEDHD Committee, [02:19:23 --> 02:19:25] and the Air Pollution Control District, [02:19:25 --> 02:19:29] the AB617 advisory board. [02:19:29 --> 02:19:34] And so, quite a bit of experience in dealing with groups [02:19:34 --> 02:19:37] and running meetings. [02:19:37 --> 02:19:41] But I see my role in this as being to make sure [02:19:41 --> 02:19:44] that the playing field is level [02:19:44 --> 02:19:46] and we are receiving all the information [02:19:46 --> 02:19:48] that we can get our hands on. [02:19:48 --> 02:19:53] So that the table is set for making good decisions. [02:19:53 --> 02:19:57] And I see it as where the chair, vice chair position [02:19:57 --> 02:20:03] would be a place to make sure that our process is organized [02:20:03 --> 02:20:07] and directionally oriented or going down the direction. [02:20:07 --> 02:20:10] Not necessarily, you don't want to be in position [02:20:10 --> 02:20:12] of lobbying anybody, but making sure [02:20:12 --> 02:20:18] that the information is received and formulated [02:20:18 --> 02:20:22] into a code of document that's usable. [02:20:22 --> 02:20:27] I do believe that these positions have some responsibility [02:20:27 --> 02:20:31] organizing the group and its workflow. [02:20:31 --> 02:20:35] And so that's where I see the role shaping up to be. [02:20:35 --> 02:20:38] So I'm sure it would tire out. [02:20:38 --> 02:20:41] I would learn a pretty good war as time goes along, [02:20:41 --> 02:20:42] which just says it's not true. [02:20:42 --> 02:20:46] That's why I see the officers role being in this corner. [02:20:46 --> 02:20:51] It's making sure this committee stays on task, stays on mission, [02:20:51 --> 02:20:55] and stays on time, whatever that time frame might be. [02:20:55 --> 02:20:58] So that's my position at this point. [02:20:58 --> 02:21:06] Thank you. [02:21:06 --> 02:21:11] So John, would you like to be chair of the committee? [02:21:11 --> 02:21:13] I would be chair of the committee. [02:21:13 --> 02:21:17] Chair. [02:21:17 --> 02:21:23] I think that we have to establish why we're here [02:21:23 --> 02:21:25] in the first place. [02:21:25 --> 02:21:29] And unfortunately, we're not here because the county wanted [02:21:29 --> 02:21:30] to create its disunity. [02:21:30 --> 02:21:32] We're here because the county was forced [02:21:32 --> 02:21:35] to create disunity because of an overwhelming interest [02:21:35 --> 02:21:40] from the public to understand this issue at death. [02:21:40 --> 02:21:41] Remember how this started? [02:21:41 --> 02:21:44] This started because the disunity developer wanted [02:21:44 --> 02:21:46] to establish California's largest [02:21:46 --> 02:21:48] and the right in people's backers. [02:21:48 --> 02:21:51] So frankly, there's a lot more that is done [02:21:51 --> 02:21:53] to protect our residents. [02:21:53 --> 02:21:55] And I think that whoever is chair [02:21:57 --> 02:22:01] will speak volumes into restoring public trust [02:22:01 --> 02:22:02] into the community. [02:22:02 --> 02:22:05] So that is why I believe that whoever is chair [02:22:05 --> 02:22:08] should not be the county or the city [02:22:08 --> 02:22:11] or someone that's in the council. [02:22:11 --> 02:22:12] I think we should speak volumes [02:22:12 --> 02:22:15] and restore a little bit of public trust [02:22:15 --> 02:22:16] to let people know. [02:22:16 --> 02:22:19] the chair of this committee comes from the committee. [02:22:19 --> 02:22:21] And I think that's why I do with, [02:22:22 --> 02:22:25] Ms. Agal, who just shared a very expensive [02:22:25 --> 02:22:26] and impressive resume, [02:22:26 --> 02:22:29] we'll make a great fit for that. [02:22:29 --> 02:22:44] I just wanted to express that. [02:22:44 --> 02:22:48] So at this time, I have everyone in the House of Rachel, [02:22:48 --> 02:23:15] the voting board, I will have my staff distribute [02:23:15 --> 02:24:34] this meeting with the state. [02:24:34 --> 02:24:38] Conversation, might as well do this. [02:24:38 --> 02:24:40] For me, I'm going to get this guy here, [02:24:40 --> 02:24:42] to do this or something. [02:24:42 --> 02:24:45] you guys are going over the selection of offices. [02:24:45 --> 02:24:48] And I think this board, [02:24:48 --> 02:24:50] I don't know if you've already seen a lot of people [02:24:50 --> 02:24:51] here and there, [02:24:51 --> 02:24:55] but I think my opinion would be those that should be on top [02:24:55 --> 02:24:57] would be the ones that are pushing this. [02:24:57 --> 02:25:00] So the committee, or any support of action [02:25:00 --> 02:25:01] towards the data center, [02:25:01 --> 02:25:04] I support these two fellow calisthenics, [02:25:04 --> 02:25:06] I say to myself, [02:25:06 --> 02:25:08] I believe we have to spearhead this committee. [02:25:08 --> 02:25:10] So we try to have the front-runner speed [02:25:10 --> 02:25:13] of people that have been outspoken, [02:25:13 --> 02:25:18] the organizers and the ones that have gotten us to this point. [02:25:18 --> 02:25:20] I hope we can all be here to make the right decision [02:25:20 --> 02:25:21] for the people. [02:25:21 --> 02:25:24] Like if we apply to be here, hopefully we're [02:25:24 --> 02:25:26] here in the best attention. [02:25:26 --> 02:25:29] You're like, I'm not going to go any further. [02:25:29 --> 02:25:30] Thank you for back in the data center, [02:25:30 --> 02:25:33] being against the opposition, being [02:25:33 --> 02:25:35] for the opposition. [02:25:35 --> 02:25:38] I just want to reiterate data centers are a huge part [02:25:38 --> 02:25:41] of surveillance in America and abroad, [02:25:41 --> 02:25:45] as well as the infrastructure for military action [02:25:45 --> 02:25:47] and tactical decisions done by the US [02:25:47 --> 02:25:49] or just very militarily right now. [02:25:49 --> 02:25:53] There's a really intense mission from the military. [02:25:53 --> 02:25:56] So the items of recording selection of officers, [02:25:56 --> 02:25:58] chair of my, chair of the committee. [02:25:58 --> 02:26:01] I think this ties in very well with the committee [02:26:01 --> 02:26:03] and whoever is in charge of this committee [02:26:03 --> 02:26:05] because data centers are violent around the world [02:26:05 --> 02:26:08] and this committee should be those that seek [02:26:08 --> 02:26:12] unity, peace and the betterment for everyone else. [02:26:12 --> 02:26:13] Thank you. [02:26:13 --> 02:26:13] Thank you. [02:26:13 --> 02:26:16] Thank you, Ms. Barby. [02:26:16 --> 02:26:54] Mr. Winston, everyone's been mentioned, going to stand. [02:26:54 --> 02:26:56] So we'll go ahead and take just a quick second [02:26:56 --> 02:26:57] to get a telly. [02:26:57 --> 02:27:01] We will put it on the screen and we'll get it there as well. [02:27:01 --> 02:27:10] We are ready. [02:27:10 --> 02:27:10] Thank you. [02:27:10 --> 02:27:11] Thank you. [02:27:11 --> 02:27:11] Thank you. [02:27:11 --> 02:27:12] Thank you. [02:27:22 --> 02:27:24] Thank you. [02:27:24 --> 02:27:26] Thank you. [02:27:36 --> 02:27:42] Committee members, I would like to recommend from our great hearing the layout of the [02:27:42 --> 02:27:44] tally of the votes. [02:27:44 --> 02:27:48] If you see we hired committee members who were present and voted. [02:27:48 --> 02:27:55] for vice-presidential and as we scroll over you guys will get to see the results [02:27:55 --> 02:28:05] because the votes for chair there is a tie between Mike Goodsell with eight votes and [02:28:05 --> 02:28:13] Christian Michelle Sanalo eight votes then for vice chair we have a tie as well [02:28:13 --> 02:28:21] Mr. Michael Snell with four votes and Mr. Michael Leigh-En is four votes as well. [02:28:21 --> 02:28:29] And for the majority of the central secretary, we did have a majority on Mr. John Karras. [02:28:29 --> 02:28:36] At this time, I am ready if you guys want to re-vote on the top two. [02:28:36 --> 02:28:40] And then we can move forward. That way again, I have another ballot. [02:28:40 --> 02:28:47] can do a second round just including the top two on both chair and right [02:28:47 --> 02:28:58] chair. Let's say Mr. Mitts-Ellen is both. I'm sorry? What happens? [02:29:28 --> 02:29:30] Okay, you guys will get a second. [02:29:30 --> 02:29:33] Can we just do hands up? [02:29:33 --> 02:29:35] We'll go along fast quicker. [02:29:47 --> 02:29:50] We could also move with motion. [02:29:50 --> 02:29:55] Someone is interested in doing motion with the results that we have. [02:29:55 --> 02:30:04] I'll make a motion to make a member of the San Jose National [02:30:04 --> 02:30:07] Center, it would send a message to the community and the people [02:30:07 --> 02:30:10] who started the building public trust that a member of the [02:30:10 --> 02:30:16] community still wants to be in this community. [02:30:16 --> 02:30:21] I'll just, this stage of certification, just one [02:30:21 --> 02:30:26] motion for chair. You guys want to take an individual? [02:30:26 --> 02:30:29] I have a motion on the floor by Mr. Alonso-Nanis to [02:30:29 --> 02:30:33] appoint a man Christian Saigado as chair and I have a [02:30:33 --> 02:30:41] Second, by Ms. Martin, I will go ahead and take a vote. [02:30:42 --> 02:30:55] Second, Peggy Price, John Hock, Mark Hemby, [02:30:58 --> 02:31:06] Anne Michelle Hollinger, Flavio Vinalba, Christian Salado, [02:31:07 --> 02:31:17] Andrew Schwartz, Sheila K. Edwards, Mauritory Marcus, [02:31:18 --> 02:31:28] Sandy Fanon, Jeffrey Nimm, John Frost, [02:31:31 --> 02:32:46] I like to make a motion for Vice Chair for the Board of Trustees. [02:32:46 --> 02:32:51] I'd like to make a motion for Vice Chair for Mike Goodsell. [02:32:59 --> 02:33:03] Motion by Ms. Marjorie to appoint Mr. Goodsell as, [02:33:03 --> 02:33:06] I'm sorry Ms. Marjorie to appoint Mr. Goodsell [02:33:06 --> 02:33:12] as the Vice Chair, second by Ms. Sunil. [02:33:12 --> 02:33:13] And we'll take another roll call. [02:33:13 --> 02:33:20] Peggy Craig, John Locke. [02:33:20 --> 02:33:22] Yes. [02:33:22 --> 02:33:24] Mark Hemby. [02:33:24 --> 02:33:26] Yes. [02:33:26 --> 02:33:28] And Ms. John Hollinger. [02:33:28 --> 02:33:30] Yes. [02:34:24 --> 02:34:27] I'm going to count just to make it up here. [02:34:27 --> 02:34:54] One note, motion passes. [02:34:54 --> 02:34:59] At this time I will take a motion for secretary. [02:34:59 --> 02:35:02] I'm motioned for John Brass, the secretary. [02:35:02 --> 02:35:05] Second. [02:35:05 --> 02:35:07] Second. [02:35:07 --> 02:35:13] I will motion by this envelope to appoint Mr. John Brass as the secretary [02:35:13 --> 02:35:16] and then second by Mr. V. Hadova. [02:35:16 --> 02:35:25] I have to take one more time. [02:35:25 --> 02:35:31] Yes. [02:35:31 --> 02:35:36] Yes. [02:35:36 --> 02:35:40] Yes. [02:35:40 --> 02:35:44] Yes. [02:35:44 --> 02:35:46] Yes. [02:35:46 --> 02:35:50] Yes. [02:35:50 --> 02:35:54] Yes. [02:35:54 --> 02:35:57] Yes. [02:35:57 --> 02:35:59] Yes. [02:35:59 --> 02:36:03] Yes. [02:36:15 --> 02:36:23] Uncle Ed Rindes, Mike Fitzsall, Dennis Maria. [02:36:23 --> 02:36:29] Okay, we have another 7, 16 years, one no, motion passes. [02:36:29 --> 02:36:38] For full disclosure, our chair is Christian Salgado, [02:36:38 --> 02:36:43] our vice chair is Mike Fitzsall, and our secretary is John Brooks. [02:36:43 --> 02:36:52] If this time is up, I will ask her if you want to proceed with the meeting, or would you like to finalize the meeting tonight? [02:36:52 --> 02:37:14] I'll hold it to a note and see if that's fine. [02:37:14 --> 02:37:19] I thought you were going to do the meeting? [02:37:19 --> 02:37:21] I thought you were going to do the office. [02:37:21 --> 02:37:22] Yeah. [02:37:22 --> 02:37:27] I thought if you wanted to proceed with the meeting, or if you wanted me to. [02:37:27 --> 02:37:29] I would like to end this. [02:37:29 --> 02:37:30] I'm sorry. [02:37:30 --> 02:37:31] I'm sorry. [02:37:31 --> 02:37:32] I'm sorry. [02:37:35 --> 02:37:37] I know you can't come in. [02:37:37 --> 02:37:38] I'm trying to get out though. [02:37:38 --> 02:37:39] I'm sorry. [02:37:39 --> 02:37:40] I'm sorry. [02:37:40 --> 02:37:41] I'm sorry. [02:37:41 --> 02:37:42] I'm sorry. [02:37:42 --> 02:37:42] I'm sorry. [02:37:42 --> 02:37:43] Okay. [02:37:46 --> 02:37:47] So moving on. [02:37:49 --> 02:37:50] Item 8B. [02:37:50 --> 02:37:53] So like the meeting takes time and notation [02:37:53 --> 02:37:57] for the committee and I know that there [02:37:57 --> 02:37:59] We're going to be some changes on the bike also. [02:37:59 --> 02:38:01] I'm not sure if this is something you guys [02:38:01 --> 02:38:03] want to discuss tonight or we're going [02:38:03 --> 02:38:05] to be on the discussion, but we do [02:38:05 --> 02:38:11] have to set our next meeting date, time, and location. [02:38:11 --> 02:38:14] I will connect for a discussion. [02:38:14 --> 02:38:17] Is there a role for everybody to do the third search? [02:38:17 --> 02:38:19] Is there a role for everybody to do the third search? [02:38:19 --> 02:38:22] So do you guys continue to have to be on the same place? [02:38:22 --> 02:38:24] I tell you for me it's not I. [02:38:24 --> 02:38:27] I would be very nervous as usual. [02:38:27 --> 02:38:29] You can book all of us. [02:38:29 --> 02:38:40] If I may, I'm the advisory committee and under the words held in assistance at this time I [02:38:40 --> 02:38:45] do have other committees already set and I can provide you with a calendar. [02:38:45 --> 02:38:54] So and bear with me but I have second Thursday at 6pm taken, third Thursday at 6pm taken, [02:38:54 --> 02:38:59] for Thursday at 6pm taken, for Monday at 6pm taken. [02:38:59 --> 02:39:14] So Tuesday is on my board of supervisors meeting and I don't have an end time, so I would [02:39:14 --> 02:39:19] need to commit to it Tuesday and I'll be able to come in. [02:39:19 --> 02:39:25] Can we take a little discussion on a recurring date and time in the schedule of next meeting? [02:39:25 --> 02:39:28] We can't do that. [02:39:28 --> 02:39:33] So I worked to go ahead and be able to get a comment on it. [02:39:33 --> 02:39:39] Can we at least those set a time for potential next meeting so that we can move forward? [02:39:39 --> 02:39:41] Data time? [02:39:41 --> 02:39:50] Are we really only going to meet once a month? [02:39:50 --> 02:39:51] No. [02:39:51 --> 02:39:53] We have a lot of work to do. [02:39:53 --> 02:39:56] It's open to discussion. [02:39:56 --> 02:39:59] If it's every week, if it's every two weeks, I'm just like, [02:39:59 --> 02:40:07] I just like the time that I am already. [02:40:07 --> 02:40:11] Same time, building, place, like next Thursday work, [02:40:11 --> 02:40:14] work, work, work, work, work, work, work, work, work. [02:40:14 --> 02:40:16] So we can get the meeting date and final. [02:40:16 --> 02:40:17] Next Thursday? [02:40:17 --> 02:40:19] Yeah, same place, time, and first week. [02:40:19 --> 02:40:20] We have a lot of work. [02:40:20 --> 02:40:24] Yeah, we're all here. [02:40:24 --> 02:40:26] The electives are in. [02:40:26 --> 02:40:28] I would advise not in the next day since I'm [02:40:28 --> 02:40:30] doing the most of the work. [02:40:30 --> 02:40:31] David, I'm sorry. [02:40:31 --> 02:40:33] I mean, I'm not that challenge or ready [02:40:34 --> 02:40:36] with the date so that we take a conflict [02:40:36 --> 02:40:40] and we do want to stay on Thursday. [02:40:40 --> 02:40:43] I mean, if anything, I will make myself available [02:40:43 --> 02:40:47] for this committee and have staff members [02:40:47 --> 02:40:49] deliver my letters to committees, [02:40:49 --> 02:40:51] but there's some board members that start [02:40:51 --> 02:40:54] on the committees that are in such a bubble. [02:40:54 --> 02:40:57] Can I propose October 1st? [02:40:57 --> 02:41:20] I can do that too. I think I'm going to leave it up to an email from myself and the secretary [02:41:20 --> 02:41:50] I would say this is what I was hearing about this in my opinion. [02:41:50 --> 02:41:53] And I think October 1st and now, [02:41:53 --> 02:41:55] or at least the next meeting, [02:41:57 --> 02:41:59] have the clerk send us all of the openings [02:41:59 --> 02:42:02] that they have available and for us to come prepared [02:42:02 --> 02:42:06] on the first to decide officially then bi-weekly [02:42:06 --> 02:42:10] and what dates on that by-weekly. [02:42:10 --> 02:42:12] Because at least that way now we'll have [02:42:12 --> 02:42:14] counters of availability. [02:42:14 --> 02:42:16] Where are the locations correct as well? [02:42:16 --> 02:42:20] Yes, I'm not a real deal on this one. [02:42:20 --> 02:42:26] Well, everything's been changed between now and into the year, quite a bit, because we've got holidays and things that we're gonna be working through. [02:42:26 --> 02:42:37] So, I think if we just put that person after this and we can change the set and then we're gonna have to take the time to do them. [02:42:37 --> 02:42:40] We're gonna have to do them all together. [02:42:40 --> 02:42:47] So, maybe it's important that we're gonna have to take them off. [02:42:47 --> 02:42:49] Then just a little bit of this kind of happening. [02:42:49 --> 02:42:52] What about medics? [02:43:35 --> 02:43:37] people are out. [02:43:37 --> 02:43:43] I forgot Monday the 28th. [02:43:43 --> 02:43:45] But you only need 10 people to attend, right? [02:43:45 --> 02:43:46] For a board? [02:43:46 --> 02:43:47] Yes. [02:43:47 --> 02:43:52] Because otherwise you might not be able to attend. [02:43:52 --> 02:43:54] So that's a cherished one. [02:43:54 --> 02:43:58] How much Monday do I have to attend? [02:43:58 --> 02:44:00] I just have to check for a minute already of this room. [02:44:00 --> 02:44:05] You guys might continue to meet. [02:44:05 --> 02:44:11] Right now we're going to be waiting for the room to be cleared. [02:44:11 --> 02:44:14] I feel like it is going to be very challenging. [02:44:14 --> 02:44:20] But we are happy to make sure we can set the forum. [02:44:20 --> 02:44:20] Can you see us? [02:44:20 --> 02:44:23] Can I put a little first on it? [02:44:23 --> 02:44:25] We are just going to first look at the end of September [02:44:25 --> 02:44:26] of the 28th. [02:44:26 --> 02:44:29] By the end of September of the 28th? [02:44:29 --> 02:44:32] Or talk over the first was another one, [02:44:32 --> 02:44:35] but it worked for a few minutes. [02:44:35 --> 02:44:36] Can you make a second? [02:44:36 --> 02:44:38] I'll see you in a minute. [02:44:38 --> 02:44:41] So we're about to turn on the 28th. [02:44:41 --> 02:44:43] We're going to hear from the talk about the 28th. [02:45:24 --> 02:45:31] I would be dealing with everybody else today. [02:45:31 --> 02:45:48] That sounds like a better date than the motor. [02:45:48 --> 02:45:50] The point is we're not setting a date. [02:45:50 --> 02:45:52] Like we're not setting specific dates, [02:45:52 --> 02:45:54] we're just saying the next meeting. [02:45:54 --> 02:45:57] Yeah, we're just like taking the motion. [02:45:57 --> 02:46:00] I'll see what it's gonna be. [02:46:00 --> 02:46:01] Yeah, whatever. [02:46:01 --> 02:46:02] Yeah, okay. [02:46:02 --> 02:46:03] Yeah. [02:46:03 --> 02:46:06] I'm sorry, who motions? [02:46:06 --> 02:46:09] Who motions for the 20? [02:46:09 --> 02:46:10] Who motions for the 20? [02:46:10 --> 02:46:12] Is that even by any means? [02:46:12 --> 02:46:17] Edwards, Peggy and Price? [02:46:17 --> 02:46:19] Yes. [02:46:19 --> 02:46:20] John Hall? [02:46:20 --> 02:46:22] Yeah. [02:46:22 --> 02:46:23] Mark Habbins. [02:46:23 --> 02:46:24] Yeah. [02:46:24 --> 02:46:26] And Michelle Holger. [02:46:26 --> 02:46:27] Yes. [02:46:27 --> 02:46:28] Bob W. Bricaldo. [02:46:28 --> 02:46:29] Yes. [02:46:29 --> 02:46:31] Christiane Salvello. [02:46:31 --> 02:46:33] Yes. [02:46:33 --> 02:46:34] Andrew Schwartz. [02:46:34 --> 02:46:36] Yes. [02:46:36 --> 02:46:38] Shagan K. Edwards. [02:46:38 --> 02:46:39] Yes. [02:46:39 --> 02:46:41] So, Martry Marquez. [02:46:41 --> 02:46:43] Yes. [02:46:43 --> 02:46:44] Sandy Prenow. [02:46:44 --> 02:46:45] Yes. [02:46:45 --> 02:46:46] Jeffrey Newman. [02:46:46 --> 02:46:47] Yes. [02:46:47 --> 02:46:48] John Brax. [02:46:48 --> 02:46:49] Yes. [02:46:49 --> 02:46:50] Hugh Rick from the Salerno. [02:46:50 --> 02:46:51] Yes. [02:46:51 --> 02:46:52] Michael Riem. [02:46:52 --> 02:46:54] Yes. [02:46:54 --> 02:46:55] Uncle Hernandez. [02:46:55 --> 02:46:56] Yes. [02:47:35 --> 02:47:47] Mr. Dyson, those comments for this committee, [02:47:47 --> 02:47:50] I'm going to state one more time that those comments were not [02:47:50 --> 02:47:51] true. [02:47:51 --> 02:47:53] I will talk to you after this meeting. [02:47:53 --> 02:47:55] But the comments that you've made about me breaking the [02:47:55 --> 02:48:01] mean act, accepting donations from a data center developer [02:48:01 --> 02:48:02] is not true. [02:48:02 --> 02:48:04] So I just want this committee to know that. [02:48:04 --> 02:48:07] And I don't appreciate the misinformation being stated up here. [02:48:07 --> 02:48:13] So, and again, I'll say again that I hope that we stay away from those kinds of things. [02:48:13 --> 02:48:18] And if they are stated that we correct them as misinformation and not factual. [02:48:18 --> 02:48:18] Thank you.
