We're gonna get started today with the Imperial County Dada Center committee. [00:00:11 --> 00:00:17] So I just want to welcome everyone, members of the public, as well as all the committee members. [00:00:17 --> 00:00:20] Thank you for taking the time today so that we can meet. [00:00:20 --> 00:00:25] I now just start with our next item, just a quick roll call of everyone that is present. [00:00:25 --> 00:00:30] I will start with this payday price present. John Hogg, [00:00:30 --> 00:00:35] Mark, Mark Candy, Michelle Hollinger. [00:00:35 --> 00:00:36] Here. [00:00:36 --> 00:00:38] Flavio Grigouda. [00:00:39 --> 00:00:42] Christian Zalado here. [00:00:42 --> 00:00:44] Andrew Schwartz. [00:00:45 --> 00:00:46] Sheila Edwards. [00:00:46 --> 00:00:47] Sheila. [00:00:47 --> 00:00:48] Project. [00:00:48 --> 00:00:49] Sheila. [00:00:49 --> 00:00:52] And they also make an else negative for Arizona, [00:00:52 --> 00:00:54] so I might have to leave at around seven o'clock. [00:00:54 --> 00:00:55] Okay, there. [00:00:55 --> 00:00:57] Thank you for letting me know. [00:00:57 --> 00:01:02] And we had Marjorie Muckins. [00:01:02 --> 00:01:03] Here. [00:01:03 --> 00:01:11] I'm sorry. No, I can't pronounce it for right. [00:01:11 --> 00:01:14] Yeah. [00:01:14 --> 00:01:17] No. [00:01:17 --> 00:01:20] No. [00:01:20 --> 00:01:23] No. [00:01:23 --> 00:01:26] No. [00:01:26 --> 00:01:29] No. [00:01:29 --> 00:01:32] No. [00:01:32 --> 00:01:44] Maria. Here. It looks like for the Secretary it's just John, Mark, Andrew, Marjorie, and [00:01:44 --> 00:02:00] Ola, Marjorie. So we have a form, so we will continue with our meeting today. Our next [00:02:00 --> 00:02:12] thing we'll have, Mike Giselle will be leading us in the Pledge of Allegiance. [00:02:12 --> 00:02:22] The state of America and the Republic for which it stands, one nation, under God and indivisible, [00:02:22 --> 00:02:25] with liberty and justice for all. [00:02:25 --> 00:02:42] Our next item on the agenda, item four, I'd like to just get off the meeting and welcome [00:02:42 --> 00:02:45] everyone into what the data center committee is. [00:02:45 --> 00:02:49] I just wanted to reiterate the purpose and charge of the data center committee, [00:02:49 --> 00:02:52] especially for those in the public that had not joined us last time. [00:02:52 --> 00:02:55] And so I'll just kind of repeat that. [00:02:55 --> 00:02:58] So the purpose of the data center advisory committee [00:02:58 --> 00:03:01] shall be to advise the Board of Supervisors [00:03:01 --> 00:03:03] on potential land use and zoning options [00:03:03 --> 00:03:05] relating to data center development [00:03:05 --> 00:03:08] within the unincorporated areas of Imperial County. [00:03:08 --> 00:03:09] So that is the purpose [00:03:09 --> 00:03:12] of the data center advisory committee. [00:03:12 --> 00:03:15] Our charge is the data center advisory committee [00:03:15 --> 00:03:18] shall evaluate and provide recommendations [00:03:18 --> 00:03:22] to the Board of Supervisors regarding potential land use, [00:03:22 --> 00:03:26] and policy options related to data center development [00:03:26 --> 00:03:29] within the unincorporate areas of Imperial County. [00:03:29 --> 00:03:31] And I am gonna read out relatively the, [00:03:31 --> 00:03:32] in carrying out these charges, [00:03:32 --> 00:03:35] the data center advisory committee shall evaluate [00:03:35 --> 00:03:37] and make recommendations regarding the following. [00:03:37 --> 00:03:39] Potential amendments to the Imperial County [00:03:39 --> 00:03:42] general plan, potential amendments [00:03:42 --> 00:03:44] to the Imperial County codified ordinance, [00:03:44 --> 00:03:46] see the use of specific plans [00:03:46 --> 00:03:49] or other planning tools relating to location [00:03:49 --> 00:03:52] and regulation of data center development, [00:03:52 --> 00:03:56] the establishment of locations or proximity standards [00:03:56 --> 00:03:58] relating to residential neighborhoods, [00:03:58 --> 00:04:01] schools and other sensitive uses. [00:04:01 --> 00:04:05] E, the identification of areas that may be more appropriate [00:04:05 --> 00:04:08] for data center development based on existing land use, [00:04:08 --> 00:04:10] infrastructure, energy resources [00:04:10 --> 00:04:13] and compatibility with surrounding areas. [00:04:13 --> 00:04:16] F, consideration of implementation options [00:04:16 --> 00:04:18] and legal implementation associated [00:04:18 --> 00:04:21] with any recommendation, amendments include [00:04:21 --> 00:04:25] whether such amendments should apply prospectively, [00:04:25 --> 00:04:30] only or where legal permissible to projects [00:04:30 --> 00:04:32] currently in process. [00:04:32 --> 00:04:34] And then our last one is any other recommendations [00:04:34 --> 00:04:37] that committee determines appropriate. [00:04:37 --> 00:04:40] So that's our task as the, [00:04:40 --> 00:04:42] that's our charge as the data center advisory committee. [00:04:42 --> 00:04:44] So for just to kind of, you know, [00:04:44 --> 00:04:46] that we're all aware kind of what our purpose is [00:04:46 --> 00:04:48] for these meetings. [00:04:48 --> 00:04:52] So, now we're going to move on to our public comments. [00:04:52 --> 00:04:57] I will, for the public comment, I will call out your name. [00:04:57 --> 00:05:05] You will have three minutes for public comment due to this public meeting being a special meeting. [00:05:05 --> 00:05:08] Hey, can you switch? I can hear the background right now. [00:05:08 --> 00:05:10] Yeah, so a little bit of information. [00:05:10 --> 00:05:12] So this was going to be a regular meeting. [00:05:12 --> 00:05:19] However, when the posting of the data center by the committee agenda was posted on Friday, [00:05:19 --> 00:05:24] the website was not sufficient or was there was issues with the website that it didn't [00:05:24 --> 00:05:27] validate this as a regular meeting. [00:05:27 --> 00:05:32] In communication with the clerk, I decided in order to continue with the meeting, we [00:05:32 --> 00:05:34] would make it a special meeting. [00:05:34 --> 00:05:38] So then the posting was made on Saturday, made to the public. [00:05:38 --> 00:05:42] However, it does limit public comment to strictly the items [00:05:42 --> 00:05:45] on the agenda following the county's policy [00:05:45 --> 00:05:48] and the Brown Act on special agendas. [00:05:49 --> 00:05:51] So I just wanna make, so just reiterate that the public [00:05:51 --> 00:05:54] will have an opportunity to address the committee members [00:05:54 --> 00:05:57] only concerning any item on this agenda [00:05:57 --> 00:06:00] before or during consideration of the item. [00:06:00 --> 00:06:02] So I know some people have put in public comment [00:06:02 --> 00:06:04] for just general public comment [00:06:04 --> 00:06:05] and then again for a specific item. [00:06:05 --> 00:06:09] so you will be called multiple times to speak today. [00:06:09 --> 00:06:11] So since I agree that third, [00:06:11 --> 00:06:16] I will start with our first member of the public. [00:06:16 --> 00:06:20] It will be Christopher Scree. [00:06:20 --> 00:06:24] If you were the last one to come in, I would. [00:06:24 --> 00:06:27] So I mean, I feel free to stop me at any point. [00:06:27 --> 00:06:31] I don't want to, I was not prepared [00:06:31 --> 00:06:32] for a special meeting today, [00:06:32 --> 00:06:35] but so I'm not super familiar with this. [00:06:35 --> 00:06:37] So at any point I'm off task. [00:06:37 --> 00:06:39] please feel free to say I will not be insulted. [00:06:42 --> 00:06:45] I might be kind of quick. [00:06:45 --> 00:06:51] Anyway, well, I want to start by talking [00:06:51 --> 00:06:55] about the decision of the law merger, how it's [00:06:55 --> 00:06:58] been repudiated in a court of law being illegal by Judge [00:06:58 --> 00:07:00] Andrew Holt. [00:07:00 --> 00:07:03] It's more than enough to disqualify certain members [00:07:03 --> 00:07:08] of the board of supervisors from being in this position [00:07:08 --> 00:07:12] here and one of them not being here at all. [00:07:12 --> 00:07:15] But then we look at other things that [00:07:15 --> 00:07:17] involve that active recall efforts, controversy, [00:07:17 --> 00:07:21] lawsuits that were enabled with their colleagues. [00:07:21 --> 00:07:25] It's really this price I just don't know why I'm here. [00:07:25 --> 00:07:27] For those that don't know me, I'm a music teacher [00:07:27 --> 00:07:28] at the City of Imperial. [00:07:28 --> 00:07:30] There was an interesting article a couple of weeks [00:07:30 --> 00:07:33] ago from the National Educators Association [00:07:33 --> 00:07:35] about data centers and their proximity to schools. [00:07:35 --> 00:07:38] The burden that these facilities place on the children [00:07:38 --> 00:07:41] has been documented well before this particular article, [00:07:41 --> 00:07:43] but there has been one point that I found [00:07:43 --> 00:07:46] especially interesting, which was, and I quote, [00:07:46 --> 00:07:50] the tax breaks and subsidies that attract these projects [00:07:50 --> 00:07:53] are draining much needed funding from public schools. [00:07:53 --> 00:07:55] In many states where data centers are clustered, [00:07:55 --> 00:07:58] schools are losing up to $250 million per year. [00:07:58 --> 00:08:01] Now, this is a pretty interesting fact, [00:08:01 --> 00:08:03] and we talked about some of the misinformation [00:08:03 --> 00:08:06] we've heard from the pro data center community [00:08:06 --> 00:08:14] around here and the promise of taxes going towards any public funding has yet to come [00:08:14 --> 00:08:20] to fruition in other places so I don't understand why anyone would think it would come here. [00:08:20 --> 00:08:27] So the narrative of water pollution noise, the moral implications of AI itself are more [00:08:27 --> 00:08:34] than enough to ban these projects altogether but the public reward for enduring these [00:08:34 --> 00:08:39] things hasn't proven to even exist yet. Not that it would be worth it anyway. As a [00:08:39 --> 00:08:43] fine arts teacher I would be, as my students would say, cooked. Music and [00:08:43 --> 00:08:46] arts programs are always the first to go in the meantime, but no teacher or [00:08:46 --> 00:08:50] classified employee would be immune from the cuts. A lack of funding would [00:08:50 --> 00:08:53] produce training work from teachers to get to the construction and AI industry [00:08:53 --> 00:09:00] is to use a biblical analogy stealing from Peter to give Paul. So if this [00:09:00 --> 00:09:02] this committee is to come up with changes [00:09:02 --> 00:09:04] to this general plan and zoning. [00:09:04 --> 00:09:07] Within three months or sooner after as practical, [00:09:07 --> 00:09:10] then the only thing you can actually do in that timeframe [00:09:10 --> 00:09:12] is to just band data centers all together, [00:09:12 --> 00:09:14] which is what the Board of Supervisors [00:09:14 --> 00:09:15] should have done a long time ago. [00:09:15 --> 00:09:18] But let's be real here, that's not why [00:09:18 --> 00:09:20] this committee has been cobbled up in the first place. [00:09:21 --> 00:09:27] So I'll leave it at that, thank you. [00:09:27 --> 00:09:29] Thank you. [00:09:29 --> 00:09:31] Our next speaker is Jake Tyson. [00:09:31 --> 00:09:37] I'm just as a friendly reminder to please keep it to items on the agenda. [00:09:37 --> 00:09:42] Yeah, I am. I am. Thank you. I'm Jake Tice. I'm Jake Tice in my commissary, [00:09:42 --> 00:09:49] I was nine A, B, and C, but right now I'm going to kind of just raise some stuff, [00:09:49 --> 00:09:53] which is A, B, and C. I'm going to talk about the website, [00:09:53 --> 00:09:57] the moratorium coming, and then the new data set of laws. [00:09:57 --> 00:10:03] you know public safety I just feel must drive every recommendation this committee makes on this agenda [00:10:04 --> 00:10:10] and on all agendas going forward. We need to learn what our community can safely support [00:10:10 --> 00:10:15] and how protections need to be put in place before authorized and proposed development pathways. [00:10:16 --> 00:10:23] So on the moratorium what protections exist today and what safely finds I'm sorry what safety [00:10:23 --> 00:10:29] findings and risk assessments must be completed before any pause ends. That's [00:10:29 --> 00:10:33] important because that's what happened in court. They said show us the arm and you [00:10:33 --> 00:10:39] know they didn't show it. So we need to protect our community full stop. Okay and [00:10:39 --> 00:10:44] then on the new laws show us how C-core review and enforceable conditions [00:10:44 --> 00:10:49] will protect our air, Colorado River water, neighborhoods and fire responders. [00:10:49 --> 00:10:53] We also need to, well this is not only on the agenda, [00:10:53 --> 00:10:55] but it is something that has to do with the laws, right? [00:10:55 --> 00:10:59] And that is the IID, Large Load Terrorist, okay? [00:10:59 --> 00:11:01] And those, you know, when we talk about those laws, [00:11:01 --> 00:11:03] when we talk about what's gonna happen here, [00:11:03 --> 00:11:05] what's gonna be developed here, [00:11:05 --> 00:11:07] you're gonna have to look at those too. [00:11:07 --> 00:11:09] So it becomes very intricate, [00:11:09 --> 00:11:11] because violating the events up [00:11:11 --> 00:11:13] is gonna result in lawsuits. [00:11:13 --> 00:11:15] And once again, we're gonna be dealing with that [00:11:15 --> 00:11:17] with millions of dollars of litigation fees [00:11:17 --> 00:11:19] that tax tariffs gonna be funding. [00:11:19 --> 00:11:20] And we don't want to do that. [00:11:20 --> 00:11:23] We want to kind of, that's kind of where we want to stop. [00:11:23 --> 00:11:27] So, you know, with the cumulative impacts [00:11:27 --> 00:11:30] and with the ideas asking what the state laws are saying. [00:11:30 --> 00:11:33] So also the new laws and before any approval [00:11:33 --> 00:11:36] require independently verified water supplies, [00:11:36 --> 00:11:38] fully funded emergency responses, [00:11:38 --> 00:11:42] public monitoring and consequences for violations. [00:11:42 --> 00:11:43] How are we going to keep these people, [00:11:43 --> 00:11:47] whoever the developers are, hold their feet to the fire. [00:11:47 --> 00:11:53] Residents deserve specific protections named enforcement agencies and answers on the public record. [00:11:54 --> 00:11:58] You know, we need to know who you are and there is a lot going on here. [00:11:58 --> 00:12:02] These laws are saying our family should never be left bearing risk. [00:12:02 --> 00:12:04] The developers and officials still to address. [00:12:04 --> 00:12:09] So that's my opinion and I hope you know, you guys realize it's a big job. [00:12:10 --> 00:12:11] Thank you. [00:12:15 --> 00:12:17] Our next speaker is Peter Rodriguez. [00:12:17 --> 00:12:29] Good evening members of the committee, audience. [00:12:29 --> 00:12:31] My name is Peter Rodriguez, [00:12:31 --> 00:12:35] and I'd like to thank you for the clarification you gave us. [00:12:36 --> 00:12:41] Christina, president of the board of this committee, Sydney. [00:12:42 --> 00:12:46] I too was surprised about the change [00:12:46 --> 00:12:49] and the general, we're gonna go forward with it. [00:12:49 --> 00:12:51] I like this committee. [00:12:51 --> 00:12:53] I know there's a bylaw change recommendation [00:12:53 --> 00:12:55] but for the committee, [00:12:55 --> 00:13:00] I like this committee to give me an opportunity to make those changes and not the public. [00:13:00 --> 00:13:02] Maybe give them reasons why. [00:13:02 --> 00:13:07] The last board meeting doesn't matter to the public because in the audience they didn't [00:13:07 --> 00:13:08] like the rules. [00:13:08 --> 00:13:13] Well, as a football official for high school, rules are set by the state. [00:13:13 --> 00:13:16] Now by me, not by my association. [00:13:16 --> 00:13:17] And rules need to be followed. [00:13:17 --> 00:13:18] That's what's wrong with our society. [00:13:18 --> 00:13:19] We don't want to follow the rules. [00:13:19 --> 00:13:20] We want to make our own rules. [00:13:20 --> 00:13:21] We don't get committees. [00:13:21 --> 00:13:28] We don't get committees or better yet, we like the government a chance to make rules in a foreign decisive decision. [00:13:28 --> 00:13:31] We just want to come in, some people want to come in months of rule to set it. [00:13:31 --> 00:13:37] Hey, I don't like this. I like to give you guys the opportunity. You're not selected. [00:13:37 --> 00:13:41] You never write to make these rules and I would abide by those rules [00:13:41 --> 00:13:47] and they're done publicly with an open heart and with honesty and transparency. [00:13:47 --> 00:13:54] I trust this committee to be transparent because we are seeing not transparent. [00:13:54 --> 00:14:01] We see the lack of truth and elected officials, especially where we're ordered. [00:14:01 --> 00:14:04] They're not alone. We see it in the city governments. [00:14:04 --> 00:14:09] If you look around, you look around in my one city, okay? [00:14:09 --> 00:14:15] Like ours and the truth when they're saying things and putting things in social media. [00:14:15 --> 00:14:18] So I trust you guys make the right decision. [00:14:18 --> 00:14:20] And I leave that as my final comment. [00:14:20 --> 00:14:21] Thank you. [00:14:21 --> 00:14:32] Uh, speaker is Roxanne, Edie Dinger. [00:14:32 --> 00:14:33] I apologize if I'm mispronounce you. [00:14:33 --> 00:14:35] Oh, that's a nice piece. [00:14:35 --> 00:14:40] OK, so I'll just be thinking on the informational items [00:14:40 --> 00:14:43] to add to those changes. [00:14:43 --> 00:14:45] So good evening. [00:14:45 --> 00:14:47] My name is Roxanne Edie Dinger. [00:14:47 --> 00:14:51] I am the daughter of Joseph T. B. of Collector Co. [00:14:51 --> 00:14:55] and Joanne McCann of Imperial. [00:14:55 --> 00:14:59] And I'm the owner of the E.E. Ranch in southeast, [00:14:59 --> 00:15:00] by southeast Imperial County. [00:15:00 --> 00:15:02] My family has been part of the Imperial Valley [00:15:02 --> 00:15:05] agriculture for generations. [00:15:05 --> 00:15:08] My father came to the Valley in 1905. [00:15:08 --> 00:15:11] And years later, he helped build the all-American canal, [00:15:11 --> 00:15:16] driving mules that pulled a Fresno scraper. [00:15:16 --> 00:15:19] He became a farmer later, and eventually he [00:15:19 --> 00:15:23] was farming his fields in an air conditioned tractor. [00:15:23 --> 00:15:28] I have a feeling you probably prefer the air-conditioned tractor over the mules. [00:15:28 --> 00:15:32] But that's pretty incredible when you think about it. [00:15:32 --> 00:15:34] All that change in one lifetime. [00:15:34 --> 00:15:36] And changes just don't stop there. [00:15:36 --> 00:15:39] Farming has continued to evolve. [00:15:39 --> 00:15:46] GPS, automated steering, sensors, drones, and now artificial intelligence. [00:15:46 --> 00:15:50] I understand the concern that new technology can change jobs [00:15:50 --> 00:15:53] and reduce the need for some kinds of agriculture labor. [00:15:53 --> 00:15:56] You've seen that through the history of farming. [00:15:56 --> 00:16:00] The challenge is making sure that our local workforce [00:16:00 --> 00:16:06] has the opportunity to move forward with back change. [00:16:06 --> 00:16:11] And I think we're at another one of those moments today. [00:16:11 --> 00:16:13] This is why we don't automatically [00:16:13 --> 00:16:16] be a agriculture and data center technology [00:16:16 --> 00:16:18] as opposing industries. [00:16:18 --> 00:16:21] Modern agriculture increasingly depends on data, [00:16:21 --> 00:16:23] connectivity, computing, and those tools [00:16:23 --> 00:16:26] only are going to become more important. [00:16:26 --> 00:16:28] The connection won't happen just because [00:16:28 --> 00:16:30] a data center is built here. [00:16:30 --> 00:16:32] But it gives us an opportunity to think about [00:16:32 --> 00:16:34] what could grow alongside it. [00:16:34 --> 00:16:38] Ag tech research, smarter water management, [00:16:38 --> 00:16:40] workforce planning, partnerships with our [00:16:40 --> 00:16:43] agriculture and educational institutions. [00:16:43 --> 00:16:45] I also think community benefits agreements [00:16:45 --> 00:16:49] are worth looking at as part of this committee's work. [00:16:49 --> 00:16:51] Particularly how new development can support [00:16:51 --> 00:16:56] infrastructure workforce development and community priorities. [00:16:56 --> 00:17:02] Imperial Valley has never stood still. [00:17:02 --> 00:17:05] It has adapted to new infrastructure, new equipment, [00:17:05 --> 00:17:11] new markets, and new technology for more than a century. [00:17:11 --> 00:17:14] Maybe the question is not simply whether Imperial Valley [00:17:14 --> 00:17:17] chooses agriculture or technology, [00:17:17 --> 00:17:22] but how technology can become a part of the next chapter [00:17:22 --> 00:17:24] of Imperial Valley. [00:17:24 --> 00:17:26] Thank you. [00:17:26 --> 00:17:33] Our next speaker is Suzanne Perris. [00:17:33 --> 00:17:46] Well, I did need my, let me just look at this real quick. [00:17:46 --> 00:17:51] I'm going to address section 8C work plan development. [00:17:51 --> 00:18:01] I was here at the very first meeting and it became clear that this could go on for a while. [00:18:01 --> 00:18:05] this committee developing its findings, [00:18:05 --> 00:18:07] getting some organization. [00:18:07 --> 00:18:12] So my recommendation and offering of services [00:18:13 --> 00:18:18] would be to engage with a facilitator [00:18:18 --> 00:18:21] that can set a clear plan that has no interest, [00:18:21 --> 00:18:24] one way or the other, they're impartial. [00:18:24 --> 00:18:28] It doesn't take away from the chair at all. [00:18:28 --> 00:18:31] It facilitates fact-finding meetings [00:18:31 --> 00:18:34] so that you get clear results. [00:18:34 --> 00:18:37] People have tasks it's divvied up. [00:18:37 --> 00:18:42] And I think it would be beneficial for this committee [00:18:42 --> 00:18:44] and the tasks you have before you. [00:18:45 --> 00:18:50] I feel strongly that it should be someone from our valley. [00:18:50 --> 00:18:55] If it isn't me, I successfully facilitated meetings [00:18:55 --> 00:18:58] with other boards and other committees. [00:18:58 --> 00:19:02] And so something I'd like you to think about, [00:19:02 --> 00:19:04] I'm sure other of you have attended meetings [00:19:04 --> 00:19:06] where there's been facilitators. [00:19:06 --> 00:19:10] But I think I would like to see this committee [00:19:10 --> 00:19:14] be effective and efficient and not get lost [00:19:14 --> 00:19:19] in conversation which sometimes can happen. [00:19:21 --> 00:19:26] So that is my two cents on a side note personally, [00:19:26 --> 00:19:28] in addition to the Pledge of Allegiance, [00:19:28 --> 00:19:31] I'd like to have a prayer at the beginning of the meeting. [00:19:31 --> 00:19:33] Thank you. [00:19:33 --> 00:19:34] Thank you. [00:19:34 --> 00:19:38] So that is all of our public comments for now. [00:19:42 --> 00:19:43] Black people, I'm sorry. [00:19:43 --> 00:19:46] Mr. Gim, you would like public comments. [00:19:49 --> 00:19:52] Committee members, Chairwoman Christian, [00:19:52 --> 00:19:56] Sopel, let's just cut to the chase. [00:19:56 --> 00:19:58] Let's stop wasting time. [00:19:58 --> 00:20:00] I think we all know what we are here. [00:20:00 --> 00:20:02] I think there's a lot of people in the public [00:20:02 --> 00:20:04] who know exactly what they want. [00:20:04 --> 00:20:06] They're not gonna budge. [00:20:06 --> 00:20:10] let's propose to do a vote right away, [00:20:10 --> 00:20:11] the first thing that we do, [00:20:11 --> 00:20:13] why waste time, why waste my money, [00:20:15 --> 00:20:17] to put it down right away. [00:20:17 --> 00:20:18] And two things will come out of that, [00:20:18 --> 00:20:23] either one, we will know who in here [00:20:23 --> 00:20:26] was actually biased when they came in [00:20:26 --> 00:20:28] and already had an opinion about the data center [00:20:28 --> 00:20:33] or we go along and we unanimously work together. [00:20:33 --> 00:20:35] I like the second option more than anything. [00:20:35 --> 00:20:37] There's a lot of... [00:20:37 --> 00:20:39] Madam Chair, how does this work? [00:20:39 --> 00:20:43] How does attacking the chairman relate to what Sherry said? [00:20:43 --> 00:20:48] I've been allowing individuals to speak under kind of the form of plan development. [00:20:48 --> 00:20:52] I gave the currency to the other two, so I'm a life-finished person. [00:20:52 --> 00:20:59] So you can see even just saying the truth hurts people. [00:20:59 --> 00:21:01] And he has a comment about it. [00:21:01 --> 00:21:04] So I think you guys know what I'm talking about. [00:21:04 --> 00:21:07] Let's not waste time. [00:21:07 --> 00:21:09] Well, he called me out, so. [00:21:09 --> 00:21:12] Well, you just started with scurries. I mean, I was looking at you. [00:21:12 --> 00:21:14] What are you doing? [00:21:14 --> 00:21:17] So, I'm not gonna waste your time, but remember guys. [00:21:17 --> 00:21:19] This is what's going on. So, thank you. [00:21:19 --> 00:21:20] Thank you. [00:21:20 --> 00:21:27] So that is our last speaker for public comment for today. [00:21:27 --> 00:21:32] Our next item on the agenda is to review island documents. [00:21:32 --> 00:21:41] We have it moved by Michael Leven, second by Sandy. [00:21:41 --> 00:21:44] Oh, I'm sorry. [00:21:44 --> 00:22:00] I noticed that in the in the minutes item 6 it indicates that the order of the agenda [00:22:00 --> 00:22:07] was a motion by year 4, a one second by average, 4 to vote 19, and I think my recollection [00:22:07 --> 00:22:09] is that there was 17 on this year. [00:22:09 --> 00:22:14] Yeah, I would like to point out that you are in a flexible way. [00:22:14 --> 00:22:17] Yes, thank you for, yeah. [00:22:18 --> 00:22:21] That's what we had as we talked. [00:22:21 --> 00:22:30] Any other good catches on our agenda or minutes? [00:22:30 --> 00:22:44] My last name, it's 1-0. [00:22:44 --> 00:22:48] Okay, so we'll make those changes, [00:22:48 --> 00:22:52] taking in Dennis' comment and then we'll, [00:22:52 --> 00:22:54] and I guess we'll be more strong over again, [00:22:54 --> 00:22:56] so if you want to approach this. [00:22:56 --> 00:22:57] So we'll. [00:22:57 --> 00:22:57] Thank you. [00:22:59 --> 00:23:00] Thank you for doing it again. [00:23:00 --> 00:23:03] Sorry, just to make sure that we cover our faces. [00:23:07 --> 00:23:10] So that was a review and adoption of the minutes. [00:23:10 --> 00:23:12] Next thing on the agenda is approval. [00:23:12 --> 00:23:14] Oh, okay, the show goes. [00:23:14 --> 00:23:16] Thank you, thank you. [00:23:16 --> 00:23:17] Sometimes I just want to get things done, right? [00:23:17 --> 00:23:21] Okay, so we'll go around in votes. [00:23:22 --> 00:23:23] Can I just do first things? [00:23:23 --> 00:23:25] Are you okay with that? [00:23:25 --> 00:23:27] Or just do I, is that okay? [00:23:27 --> 00:23:28] To be real quick. [00:23:28 --> 00:23:30] Okay, everyone say I. [00:23:30 --> 00:23:31] I, I. [00:23:31 --> 00:23:32] Your favorites, say I. [00:23:32 --> 00:23:43] Thank you. And I apologize, I'm not an elected official so please meet your patients with me and greatly appreciate it. [00:23:43 --> 00:23:45] You have all the posts. [00:23:45 --> 00:23:49] Okay, thank you so much for that. [00:23:49 --> 00:24:03] Okay. [00:24:03 --> 00:24:14] So then we'll move on to the next item which is approval of the order of the agenda. Does anyone have any comments or concerns with the current agenda? [00:24:14 --> 00:24:17] or concerns with the current order of the agenda. [00:24:22 --> 00:24:27] Okay, we first motion by Sandy, second by Flavio. [00:24:29 --> 00:24:34] And then approval, all in favor? [00:24:35 --> 00:24:37] Aye. [00:24:37 --> 00:24:40] Opposed? [00:24:40 --> 00:24:46] Motion passes, thank you. [00:24:46 --> 00:24:50] So now we'll move into our discussion and action items. [00:24:50 --> 00:24:54] Our first discussion action item eight [00:24:54 --> 00:24:55] is to determine a regular meeting schedule [00:24:55 --> 00:24:57] for the committee. [00:24:57 --> 00:25:01] A little bit of information last time it was discussed [00:25:01 --> 00:25:03] that we wanted to meet twice a month. [00:25:03 --> 00:25:08] Also the times of month I will provide you with [00:25:08 --> 00:25:10] more cross-progress by the individuals [00:25:10 --> 00:25:11] that currently hold office. [00:25:11 --> 00:25:14] So there's meetings that take place monthly [00:25:14 --> 00:25:16] or city council meetings. [00:25:16 --> 00:25:18] So based on that information, [00:25:18 --> 00:25:23] that were optional for us could be the first. [00:25:23 --> 00:25:25] And if you want to write this now, [00:25:25 --> 00:25:28] also bring up your calendar or your phone. [00:25:28 --> 00:25:30] And I don't try not to say too fast. [00:25:30 --> 00:25:35] So either the first or third Monday of the month, [00:25:35 --> 00:25:36] that's one option. [00:25:37 --> 00:25:44] There's also the second or fourth Wednesday. [00:25:44 --> 00:25:46] The first or third Monday, [00:25:46 --> 00:25:49] that's one option for our Mondays. [00:25:49 --> 00:25:54] For our Wednesdays, it's the second or fourth, [00:25:54 --> 00:25:57] and then another option could be the first Thursday [00:25:57 --> 00:25:58] of the month. [00:25:58 --> 00:26:01] And these are all dates that the clerk could also [00:26:01 --> 00:26:04] be available in the county as well. [00:26:04 --> 00:26:06] For these meetings, it doesn't conflict with other meetings [00:26:06 --> 00:26:10] and other committees at the county. [00:26:10 --> 00:26:13] The third is, is it first and second on the floor? [00:26:13 --> 00:26:15] I was wondering if there's one on the option. [00:26:15 --> 00:26:18] It's first, first, first and third. [00:26:18 --> 00:26:20] First and third is an option. [00:26:20 --> 00:26:25] We do want to pick two that works for them, obviously the majority of us. [00:26:26 --> 00:26:30] And we are misdemeined because we're members of the state, but we'll go with us. [00:26:32 --> 00:26:38] Would we select two days, let's say two Mondays or two weeks a day? [00:26:39 --> 00:26:41] Is that set in stone? Can we decide or? [00:26:42 --> 00:26:44] It's not set in stone. It's up for discussion. [00:26:44 --> 00:26:49] We can definitely choose like the first, an example could be the first Monday. [00:26:49 --> 00:26:52] And then we do the second Wednesday of the month [00:26:52 --> 00:26:53] just to throw that out there. [00:26:53 --> 00:26:55] We can make some match, yes. [00:26:56 --> 00:26:57] I know we can. [00:26:57 --> 00:26:59] I would probably suggest that you but as [00:26:59 --> 00:27:01] a consistent one day of the month. [00:27:03 --> 00:27:04] Go ahead. [00:27:04 --> 00:27:07] I know that there are three of us here [00:27:07 --> 00:27:10] that serve on the Imperial County Transportation Commission [00:27:10 --> 00:27:13] and that's the fourth one in states. [00:27:13 --> 00:27:14] Maybe two months. [00:27:14 --> 00:27:18] So maybe that would not be a good one. [00:27:18 --> 00:27:20] first and third Monday's is not [00:27:20 --> 00:27:21] so good. [00:27:21 --> 00:27:22] It was to fill out all our Monday's [00:27:22 --> 00:27:23] because second, fourth, and I [00:27:23 --> 00:27:24] shall not fill out. [00:27:24 --> 00:27:25] Okay. [00:27:25 --> 00:27:26] Yes. [00:27:26 --> 00:27:28] Is there anyone in this committee [00:27:28 --> 00:27:30] who doesn't, but happily [00:27:30 --> 00:27:32] literally the first Monday [00:27:32 --> 00:27:33] of every month? [00:27:33 --> 00:27:34] Just so at least get one day. [00:27:34 --> 00:27:40] The first and third? [00:27:40 --> 00:27:42] Or the first and third? [00:27:42 --> 00:27:43] First and third. [00:27:43 --> 00:27:44] I think that is just a little [00:27:44 --> 00:27:45] bit of a problem. [00:27:45 --> 00:27:47] I think that is just a little [00:27:47 --> 00:27:48] bit of a problem. [00:27:48 --> 00:27:49] First and third is really [00:27:49 --> 00:27:50] important. [00:27:50 --> 00:27:51] We, of course, will make so [00:27:51 --> 00:27:52] someone with a motion. [00:27:52 --> 00:27:56] the next Monday would be the [00:27:56 --> 00:27:58] first because that's the first [00:27:58 --> 00:28:00] month. Yeah. So we turn around. [00:28:00 --> 00:28:02] But when we talk we talk about [00:28:02 --> 00:28:04] our plans we can kind of other [00:28:04 --> 00:28:06] will be productive. I'm hoping [00:28:06 --> 00:28:08] with people that will come to [00:28:08 --> 00:28:10] I know. Yes Michael January [00:28:10 --> 00:28:12] 1st the governor will the [00:28:12 --> 00:28:15] governor sign last year bill [00:28:15 --> 00:28:18] that came in effect this year [00:28:18 --> 00:28:20] that eased the issue of the [00:28:20 --> 00:28:26] last year bill that came in effect this year that eases the requirements for [00:28:26 --> 00:28:32] online participation in public meetings can online participation be an option [00:28:32 --> 00:28:43] for our members? We do have to follow the regulations that posted where you're going to be [00:28:43 --> 00:28:50] if it's we have to ask the public earlier at so yes it's still going or we would have to work there. [00:28:50 --> 00:28:55] could follow that. Yes, because it's the [00:28:55 --> 00:29:13] no committee members. Okay, so just to bring us back, we had a motion for the first and third Monday of the month. [00:29:13 --> 00:29:19] So I know that we're just learning the time, [00:29:19 --> 00:29:21] that's what we did at the end of last week, [00:29:21 --> 00:29:23] we just left the time place. [00:29:23 --> 00:29:25] I mean, I'm just wanna make sure [00:29:25 --> 00:29:33] is that not also being discussed today? [00:29:33 --> 00:29:36] Yeah, for schedule, this was, [00:29:38 --> 00:29:41] and it's a great question, you guys know, [00:29:41 --> 00:29:43] right now I was just trying to secure [00:29:43 --> 00:29:46] like a time, like a regular time schedule. [00:29:46 --> 00:29:51] However, location could definitely change [00:29:51 --> 00:29:54] as long as it's posted on the agenda appropriately. [00:29:54 --> 00:29:56] So if I could just, for example, [00:29:56 --> 00:30:00] say if we hosted this meeting at the El Centro Library, [00:30:00 --> 00:30:03] we would just make sure that that is in the agenda. [00:30:04 --> 00:30:07] So we're disappuing our regular meeting schedule, [00:30:07 --> 00:30:10] our meeting schedule, not the location. [00:30:10 --> 00:30:11] Or- [00:30:11 --> 00:30:14] So for clarification, if you want to hold one of these [00:30:14 --> 00:30:21] meetings in North and which I acknowledge is one of the hardest places to get public participation. [00:30:21 --> 00:30:24] But that's like we will be open for this community. [00:30:24 --> 00:30:26] But as I said, that's right. [00:30:26 --> 00:30:38] As I understand the rules, the key thing is to secure the dates and the time. [00:30:38 --> 00:30:42] So I'll amend my motion to say officially [00:30:42 --> 00:30:45] first and third Monday of the month at 6 p.m. [00:30:45 --> 00:30:45] Right? [00:30:45 --> 00:30:48] And I think during one of the meetings, [00:30:48 --> 00:30:51] we can say, hey, my next meeting will be held in Broadley. [00:30:51 --> 00:30:53] And then at that meeting, the following meeting [00:30:53 --> 00:30:57] will be held in Calvary. [00:30:57 --> 00:31:00] The following meeting will be held in Elson, Dr. [00:31:00 --> 00:31:02] So I think we can schedule that meeting [00:31:02 --> 00:31:03] for the following location. [00:31:03 --> 00:31:05] It's just what we want to make sure [00:31:05 --> 00:31:07] if we get the date and the time set [00:31:07 --> 00:31:08] I would recommend it. [00:31:08 --> 00:31:09] Yes. [00:31:09 --> 00:31:10] About the time, is there any way [00:31:10 --> 00:31:12] that you could be five or does that [00:31:12 --> 00:31:13] are possible? [00:31:13 --> 00:31:14] There is my access. [00:31:14 --> 00:31:17] I work nights, so I do have to be over at seven. [00:31:17 --> 00:31:19] So depending if I, since I don't [00:31:19 --> 00:31:22] be able to work across the days all the time, [00:31:22 --> 00:31:25] I wouldn't have to do this at six or five. [00:31:25 --> 00:31:26] So what if five would be sort of [00:31:26 --> 00:31:27] for people to understand, [00:31:27 --> 00:31:29] I just want to help them caution. [00:31:29 --> 00:31:34] How would you, I probably would suspect 30 minutes. [00:31:34 --> 00:31:39] I don't know if you would like that. [00:31:39 --> 00:31:40] I think I just want to. [00:31:40 --> 00:31:42] I want to take that into consideration. [00:31:42 --> 00:31:44] I do have one question. [00:31:44 --> 00:31:50] If we vote on the day but leave the time flexible to the chair, [00:31:50 --> 00:31:54] would that constitute a special meeting because she's scheduling it? [00:31:54 --> 00:31:55] Yes. [00:31:55 --> 00:31:58] Okay. [00:31:58 --> 00:32:06] Yes, only based on the bios. [00:32:06 --> 00:32:10] Yes, I don't need one. [00:32:10 --> 00:32:19] I just would like to remind the committee if most holidays fall on Mondays [00:32:19 --> 00:32:24] And on Wednesdays a lot of city council meetings happen. [00:32:24 --> 00:32:33] I just a reminder for that. [00:32:33 --> 00:32:41] These dates, I did a cross-reference against the common American holidays of like Christmas and Thanksgiving and people would have impact those. [00:32:41 --> 00:32:51] People getting off at work at 5 o'clock, you know, 5.30 am I to work? [00:32:51 --> 00:33:08] or to go on and make sure that the public can make it. [00:33:08 --> 00:33:10] It's hard and I definitely understand, you know, [00:33:10 --> 00:33:14] certain start times, but I'm not considering as well [00:33:14 --> 00:33:17] for the general public. [00:33:17 --> 00:33:18] Anyhow, if you get so. [00:33:18 --> 00:33:20] As much as I would love to change that, [00:33:20 --> 00:33:22] I think it's just a good deal. [00:33:22 --> 00:33:25] And what the flexibility of Zoomey's, [00:33:25 --> 00:33:29] you can have your camera off [00:33:29 --> 00:33:31] just as long as we know what you vote for. [00:33:31 --> 00:33:33] Each vote. [00:33:33 --> 00:33:35] Yeah, it's an issue. [00:33:35 --> 00:33:36] I understand. [00:33:36 --> 00:33:39] I'll work with it. [00:33:39 --> 00:33:45] I'm also structuring the agenda to be discussion of important items on top, informational items [00:33:45 --> 00:33:50] on bottom, so you would miss maybe the speaker, and then we can provide you with this, obviously [00:33:50 --> 00:33:52] you would have the slide deck. [00:33:52 --> 00:33:56] And if you wanted to provide any questions ahead of time, I would be more than make [00:33:56 --> 00:33:57] sure that they were working. [00:33:57 --> 00:33:58] I can ask that as well. [00:33:58 --> 00:34:01] So that comes. [00:34:01 --> 00:34:07] So I'll second mr. Creel was motion to meet the first and third Monday at 6 p.m. [00:34:21 --> 00:34:23] Oh [00:34:27 --> 00:34:31] So my comment was specific to this item [00:34:36 --> 00:34:38] Yes, that's [00:34:40 --> 00:34:42] I'm going to be Kelly Jordan. [00:34:42 --> 00:34:46] So I just was wanting to know if you're establishing [00:34:46 --> 00:34:49] a schedule based on the amount of work [00:34:49 --> 00:34:53] that actually needs to be completed or on convenience. [00:34:53 --> 00:34:55] So I think there should be enough meetings [00:34:55 --> 00:34:59] to about time for information to be presented, [00:34:59 --> 00:35:03] questions to be answered, the committee to deliberate. [00:35:03 --> 00:35:04] Thank you. [00:35:04 --> 00:35:06] The public's participate and recommendations [00:35:06 --> 00:35:08] to be drafted and revised. [00:35:08 --> 00:35:12] So I'm just asking that the schedule be established [00:35:12 --> 00:35:14] far enough in advance so members of the public [00:35:14 --> 00:35:18] can plan and attend and participate consistently. [00:35:18 --> 00:35:22] And a regular meeting schedule should do more than tell us [00:35:22 --> 00:35:24] when the committee will meet. [00:35:24 --> 00:35:27] It should demonstrate that there is enough time built [00:35:27 --> 00:35:31] into the process to complete the committee's work [00:35:31 --> 00:35:33] in a thoughtful and transparent way. [00:35:33 --> 00:35:36] So I'm asking like how many substitutes [00:35:36 --> 00:35:39] the meeting, does this committee believe it needs [00:35:39 --> 00:35:42] to complete its work and we'll kind of schedule [00:35:42 --> 00:35:46] or reflect that. [00:35:46 --> 00:35:51] Thank you. [00:35:51 --> 00:36:00] And thank you for prompting me to your comments. [00:36:00 --> 00:36:03] So we'll move on to our next discussion item, [00:36:03 --> 00:36:08] B, by watching recommendations before by the committee. [00:36:08 --> 00:36:12] So this item was discussed at our last meeting [00:36:12 --> 00:36:16] and we took those comments and there's a document [00:36:16 --> 00:36:20] providing the red line based on those comments. [00:36:20 --> 00:36:23] So at this moment, if anybody in the committee [00:36:23 --> 00:36:24] wants to discuss, [00:36:28 --> 00:36:30] I'm wrong, so I get one, just here. [00:36:30 --> 00:36:31] Yes, I can be. [00:36:42 --> 00:36:43] So you know what, I, [00:36:46 --> 00:36:47] what does the group prefer? [00:36:47 --> 00:36:49] Does the committee prefer to go in order? [00:36:49 --> 00:36:50] The entirety of it? [00:36:50 --> 00:36:53] Okay, then we'll go down in order then. [00:36:53 --> 00:36:57] So let me go to the right page. [00:36:57 --> 00:37:00] Okay, so the name of the committee [00:37:00 --> 00:37:04] shall be the data center advisory committee. [00:37:04 --> 00:37:07] Does anybody feel really strongly you need to change it? [00:37:07 --> 00:37:09] Okay, purpose. [00:37:09 --> 00:37:12] The purpose of the data center advisory committee [00:37:12 --> 00:37:14] shall be to advise the board of supervisors [00:37:14 --> 00:37:16] on potential land use and zoning options [00:37:16 --> 00:37:18] relating to data center development [00:37:18 --> 00:37:24] within unincorporate areas of the county. [00:37:24 --> 00:37:26] For attending, I'm actually gonna set up [00:37:26 --> 00:37:29] I'm going to do three charge. [00:37:31 --> 00:37:35] That item, there was a discussion last time about [00:37:35 --> 00:37:40] does our charge involve a possible ban on data centers [00:37:40 --> 00:37:42] or prohibition on data centers? [00:37:42 --> 00:37:47] And the response back from the County Council, [00:37:48 --> 00:37:50] County Council was yes, [00:37:50 --> 00:37:53] item B, potential amendments to Fero County [00:37:53 --> 00:37:57] the codified ordinance could involve a add or prohibition [00:37:57 --> 00:37:58] on data centers. [00:37:59 --> 00:38:01] Does anyone have any thoughts? [00:38:01 --> 00:38:02] I'm so sorry, anyone? [00:38:05 --> 00:38:09] So I'm looking at all the charge to do there. [00:38:09 --> 00:38:14] And I have a concern if I was on the city council [00:38:14 --> 00:38:16] and the planning commission told me, [00:38:16 --> 00:38:18] we don't intend to show you any plans [00:38:18 --> 00:38:21] because we don't want any projects in the city. [00:38:21 --> 00:38:26] How would I have? [00:38:26 --> 00:38:34] And it seems that a ban just dismisses all the other duties that were required to be charged [00:38:34 --> 00:38:35] with a number of things here. [00:38:35 --> 00:38:42] And a ban says don't even look into those things because you're not going to have a [00:38:42 --> 00:38:43] data center. [00:38:43 --> 00:38:44] Why would you need to do any of that? [00:38:44 --> 00:38:47] And that's my question for the group. [00:38:47 --> 00:38:50] Thank you. [00:38:50 --> 00:38:53] Michael? [00:38:53 --> 00:38:57] Yeah, I think that was just clarification for legality's sake. [00:38:57 --> 00:39:00] We can completely remove the band language [00:39:00 --> 00:39:03] under the ordinance as we can still introduce that. [00:39:03 --> 00:39:07] So I think that was just clarification from our members, [00:39:07 --> 00:39:09] but my question involves this, [00:39:09 --> 00:39:13] but the following, some are changes in specific verbiage [00:39:13 --> 00:39:16] that can be presented to the supervisors [00:39:16 --> 00:39:19] and others are just ideas of what was mentioned. [00:39:19 --> 00:39:22] So are we going to discuss the verbiage [00:39:22 --> 00:39:24] that we're recommending tonight, [00:39:24 --> 00:39:27] or are we simply confirming what we discussed last year? [00:39:27 --> 00:39:28] That's a good point. [00:39:28 --> 00:39:30] So we're doing both. [00:39:30 --> 00:39:32] So if the committee is comfortable [00:39:32 --> 00:39:35] with the current language put forth, [00:39:35 --> 00:39:36] then we can continue. [00:39:36 --> 00:39:38] My goal was to actually approve, [00:39:38 --> 00:39:39] we've not today of course, [00:39:39 --> 00:39:43] if we don't come to a collective decision, [00:39:43 --> 00:39:45] but is to approve this in its entirety. [00:39:45 --> 00:39:47] So if we wanna change specific parts of it, [00:39:47 --> 00:39:49] we're not gonna go in motion for each part. [00:39:49 --> 00:39:52] So we're most, so to answer your question, [00:39:52 --> 00:39:55] Yes, we can adopt some of the language [00:39:55 --> 00:39:58] or we can put forth another recommendation language. [00:39:58 --> 00:39:59] It would go back to council [00:39:59 --> 00:40:02] and then they would give us what they recommend. [00:40:02 --> 00:40:05] So then it would come back for the next meeting. [00:40:05 --> 00:40:06] It would be back and forth. [00:40:06 --> 00:40:07] Is how I understand it. [00:40:17 --> 00:40:19] So I just wanted to clarify [00:40:19 --> 00:40:21] because I was one of the ones that did bring up as far as [00:40:21 --> 00:40:23] if the committee comes up and says, [00:40:23 --> 00:40:25] you know, this isn't viable. [00:40:25 --> 00:40:28] You know, does that make you have to change the ordinance [00:40:28 --> 00:40:29] as well? [00:40:29 --> 00:40:30] So I want to try more talking about that. [00:40:30 --> 00:40:31] We're talking about that. [00:40:31 --> 00:40:32] That's what we're saying. [00:40:32 --> 00:40:35] That if this committee decides ultimately, you know, [00:40:35 --> 00:40:38] that there shouldn't be one that that is something we have [00:40:38 --> 00:40:41] to present to the county board and say, hey, [00:40:41 --> 00:40:44] you need to change this, but we're not going to vote. [00:40:44 --> 00:40:44] That's fine. [00:40:44 --> 00:40:45] There'd be clarification. [00:40:45 --> 00:40:46] That's worth spending on them. [00:40:46 --> 00:40:50] What a potential advantage it is there. [00:40:50 --> 00:40:52] Yeah, that's kind of what I was going to mention. [00:40:52 --> 00:40:56] I was like, I was like, well, we're not saying that's [00:40:56 --> 00:40:59] collectively vote today to recommend to that. [00:40:59 --> 00:41:01] because we haven't even started the research. [00:41:01 --> 00:41:04] But we want to make sure that it is, [00:41:04 --> 00:41:06] we have all available policy options [00:41:06 --> 00:41:11] towards this, for collective tool sets. [00:41:11 --> 00:41:14] And one of them being, if we decide to collectively, [00:41:14 --> 00:41:17] based on the knowledge and evidence that we've presented, [00:41:17 --> 00:41:20] that they're not suitable for this level. [00:41:20 --> 00:41:21] And we recommend that, you know, [00:41:21 --> 00:41:22] where's the best background. [00:41:22 --> 00:41:24] If it gets there. [00:41:24 --> 00:41:26] So, yeah, that's why, [00:41:26 --> 00:41:31] I'm coming under the color I mentioned last meeting. [00:41:31 --> 00:41:37] I just want to make sure that we have all available options that we're not completely gridlocked online. [00:41:37 --> 00:41:38] They're going to fail. [00:41:38 --> 00:41:43] And on the distribution, because we don't even know what the science is designed to be [00:41:43 --> 00:41:51] behind all these things that we're not so. [00:41:51 --> 00:42:01] So under the charge, I can tell you that your range goes from doing an amendment to your general plan, [00:42:01 --> 00:42:06] your courtifying ordinance to ending and the recommendation to add the day centers. [00:42:06 --> 00:42:07] So you have that range. [00:42:07 --> 00:42:12] From beginning on working on everything and making changes to that, or at the end of the day, [00:42:12 --> 00:42:18] the community decides to go with the day center plan that is an option for the community based on the [00:42:18 --> 00:42:23] changes that you guys have already made. [00:42:23 --> 00:42:26] So I appreciate the clarification that that was your position. [00:42:26 --> 00:42:29] Here's my concern. [00:42:29 --> 00:42:32] And there's a lot of work. [00:42:32 --> 00:42:36] We're charged with putting up guardrails to ensure [00:42:36 --> 00:42:41] that data centers don't ruin us. [00:42:41 --> 00:42:48] And if this is going to be an exercise of futility [00:42:48 --> 00:42:52] in which we don't like, OK, we couldn't find any guardrails [00:42:52 --> 00:42:58] that would work, we're going to look back on this as, wow, [00:42:58 --> 00:43:02] we gave our time to a lot of effort. [00:43:02 --> 00:43:04] And now we've decided we're back to square one [00:43:04 --> 00:43:06] and we can't find any way to work. [00:43:08 --> 00:43:11] That would be unfortunate. [00:43:11 --> 00:43:15] Because it's working in other places. [00:43:15 --> 00:43:18] People say that there's percentage of other places [00:43:18 --> 00:43:21] that aren't happy, but that means there's a percentage [00:43:21 --> 00:43:24] of places that are happy with data centers. [00:43:24 --> 00:43:29] And we don't know where we'll end up. [00:43:29 --> 00:43:30] But I don't wanna start on a journey [00:43:30 --> 00:43:42] that takes us to nowhere. [00:43:42 --> 00:43:46] that is within our crew view to make that recommendation [00:43:46 --> 00:43:47] to the board of supervisors. [00:43:49 --> 00:43:51] During our discussion of the work plan development, [00:43:51 --> 00:43:54] we could also reiterate similar what peer sentiments are [00:43:54 --> 00:43:57] as well or anyone else's, [00:43:57 --> 00:44:00] but I'm gonna say there's opportunity again. [00:44:00 --> 00:44:05] But I just wanna comment that I think we're, [00:44:05 --> 00:44:11] I think that we are all here [00:44:11 --> 00:44:15] and we're all committed to doing the research, [00:44:15 --> 00:44:20] regardless if the outcome turns out to be a ban. [00:44:21 --> 00:44:24] I know I'm committed. [00:44:24 --> 00:44:26] I wanna know, knowledge has came, right? [00:44:26 --> 00:44:30] So it might work somewhere else. [00:44:30 --> 00:44:34] Great, let's get the research in. [00:44:34 --> 00:44:36] I'm committed 100% to do that. [00:44:50 --> 00:44:55] So then we have discussed charge. [00:44:56 --> 00:44:58] So three, we are comfortable, [00:44:58 --> 00:45:03] we are aware that section B would cover the ban. [00:45:11 --> 00:45:13] Do you want to let the members of the public know [00:45:13 --> 00:45:15] that we're gonna allow you to get public comment [00:45:15 --> 00:45:16] before we vote? [00:45:16 --> 00:45:18] So we're gonna go through it, if that's okay with you. [00:45:18 --> 00:45:22] And then we will go through the list of public comments. [00:45:22 --> 00:45:26] That's specifically on my comment, it's the characters. [00:45:26 --> 00:45:35] Yes, we're... [00:45:35 --> 00:45:38] Language, or just an understanding of the ban [00:45:38 --> 00:45:45] could apply, or we adding the language to that. [00:45:45 --> 00:45:49] It sounds like we want clarification. [00:45:49 --> 00:45:52] The term logic also can be proficient or probably particular. [00:45:54 --> 00:45:56] But it didn't flag in the ordinance. [00:45:56 --> 00:45:58] Like in other counties and cities, [00:45:59 --> 00:46:03] when they're either a ban or a partial ban [00:46:03 --> 00:46:05] or it's all based on zoning. [00:46:05 --> 00:46:09] So essentially the language would go into the general plan [00:46:10 --> 00:46:11] that's where it would, [00:46:11 --> 00:46:13] or any specific plan that it relates to as well. [00:46:13 --> 00:46:17] there was just clarification requested on whether or not [00:46:17 --> 00:46:20] other recommendations include a ban [00:46:20 --> 00:46:23] and since it was clarified that yes, [00:46:23 --> 00:46:26] under codified ordinances it does. [00:46:26 --> 00:46:28] I don't think we should change the verbiage [00:46:28 --> 00:46:32] because it won't include a moratorium, a ban, [00:46:32 --> 00:46:35] every other possibility under the rainbow. [00:46:35 --> 00:46:37] It's just keep the verbiage as is. [00:46:37 --> 00:46:39] It was requested for clarification [00:46:39 --> 00:46:42] and I think that's what it is. [00:46:42 --> 00:46:45] Yes, just confirming in my notes, [00:46:45 --> 00:46:48] asked does this, it was a question on me, [00:46:48 --> 00:46:51] so we clarify by saying yes, [00:46:51 --> 00:46:54] but it's also under your charge fee, [00:46:54 --> 00:47:02] so that's the preparation that was going. [00:47:02 --> 00:47:04] Okay, so we'll move down now to, [00:47:04 --> 00:47:07] and I just wanna remember from members of the public, [00:47:07 --> 00:47:10] we'll go through the whole bylaws [00:47:10 --> 00:47:11] and then we'll go through comments at the end, [00:47:11 --> 00:47:14] so we will stop at the item that is specifically [00:47:14 --> 00:47:17] I'm not sure if I lost. [00:47:17 --> 00:47:20] Just so we can get through this fairly efficiently. [00:47:20 --> 00:47:26] The item for membership, there was no comment last time. [00:47:26 --> 00:47:28] Is there any comment now? [00:47:28 --> 00:47:34] No comment on membership. [00:47:36 --> 00:47:38] I just wanna ask, like, in this committee, [00:47:38 --> 00:47:40] and I'm gonna have to exclude you, Michael, [00:47:40 --> 00:47:43] like, aside from public officials, [00:47:43 --> 00:47:44] is there anyone in this committee [00:47:44 --> 00:47:48] that's from the North and will be care about? [00:47:48 --> 00:47:49] Well, aside from Broadland. [00:47:49 --> 00:47:52] We're going to talk about more than the last few minutes. [00:47:52 --> 00:47:55] And I say that aside from the bill, [00:47:55 --> 00:47:58] I think that we should have some of those. [00:47:58 --> 00:48:02] I don't know where some of those are not present. [00:48:02 --> 00:48:05] Well, my point is that this is going to fill [00:48:05 --> 00:48:09] county advisory committee and historically we've known [00:48:09 --> 00:48:11] that the more the end of the year rally has been [00:48:11 --> 00:48:14] neglected in many of the decisions that take place. [00:48:14 --> 00:48:18] And in fact, a lot of these discussions that we're going to talk about [00:48:18 --> 00:48:24] are going to directly be talking about the land in the tent. [00:48:24 --> 00:48:28] So I'm just bringing up that it seems kind of inequitable [00:48:28 --> 00:48:32] that we don't have a North end physician, specifically [00:48:32 --> 00:48:35] a voice from the North end in this committee. [00:48:35 --> 00:48:40] But we do have to order a supervisor sitting here. [00:48:40 --> 00:48:43] And I just don't know what the utility is [00:48:43 --> 00:48:45] in having to, to be honest. [00:48:45 --> 00:48:47] I'm just wondering if it would be a more [00:48:47 --> 00:48:50] equitable distribution of voices in the county [00:48:50 --> 00:48:54] to have one supervisor to the committee [00:48:54 --> 00:48:56] and get a position kind of like handed out [00:48:56 --> 00:48:58] to a possible Northam boys to actually [00:48:58 --> 00:49:01] that was stated this committee as well. [00:49:01 --> 00:49:03] As the city was planning to do. [00:49:03 --> 00:49:03] Yeah, I was wondering. [00:49:03 --> 00:49:06] I was wondering if that's still in place. [00:49:06 --> 00:49:09] That's correct. [00:49:09 --> 00:49:12] No final decision has been made for Northam. [00:49:12 --> 00:49:16] But they do have an appointment under it. [00:49:16 --> 00:49:20] I'm not sure if Northam is from Northam. [00:49:20 --> 00:49:26] I have to check but I just have a comment. [00:49:26 --> 00:49:27] You might have a personal comment. [00:49:27 --> 00:49:28] Oh, I'm sorry. [00:49:28 --> 00:49:30] I feel like I'm always facing this way. [00:49:30 --> 00:49:31] OK. [00:49:31 --> 00:49:36] I just have a good question. [00:49:36 --> 00:49:39] If the city of Westmoreland does not appoint, can we [00:49:39 --> 00:49:42] add a contingency in the bylaws where the supervisors [00:49:42 --> 00:49:46] can appoint, let's say, for some reason I resign, [00:49:46 --> 00:49:50] or Mr. Monsonada's resigns, and the city's do not appoint [00:49:50 --> 00:49:52] of whatsoever, can the supervisors [00:49:52 --> 00:49:55] or even the members of this committee [00:49:55 --> 00:49:59] appoint for the vacancy, is that just off the record, [00:49:59 --> 00:50:01] do you think the supervisors will be willing [00:50:01 --> 00:50:08] to hear that recommendation? [00:50:08 --> 00:50:10] I think we're open to anything. [00:50:10 --> 00:50:12] Can you hear me with this? [00:50:12 --> 00:50:14] But I just wanted to point out that on the third bullet [00:50:14 --> 00:50:17] on committee members, you have the unincorporated [00:50:17 --> 00:50:22] local government and anyone in those areas [00:50:22 --> 00:50:25] which we covered here far north end, [00:50:25 --> 00:50:36] I believe he wrote that to return to Mr. Hampton. [00:50:36 --> 00:50:37] Yes, please. [00:50:37 --> 00:50:40] Do you need a problem? [00:50:40 --> 00:50:41] I think I'll roll. [00:50:41 --> 00:50:46] Yeah. [00:50:46 --> 00:50:49] To the extent that there's a list here, [00:50:49 --> 00:50:53] nowhere does that list include geography. [00:50:53 --> 00:50:55] So if we start introducing a notion [00:50:55 --> 00:50:59] that somebody will be from the North End, [00:50:59 --> 00:51:04] that might open up Pandora's box about geography. [00:51:04 --> 00:51:08] My understanding is that each of these positions [00:51:08 --> 00:51:13] was open, people could apply and the board appointed [00:51:13 --> 00:51:16] accordingly. [00:51:16 --> 00:51:24] So I would stay away from designating based on geography. [00:51:24 --> 00:51:29] The other thing is with respect to having, frankly, [00:51:29 --> 00:51:34] I welcome John and Peggy's presence. [00:51:34 --> 00:51:35] Because at the end of the day, what [00:51:35 --> 00:51:37] we're going to be doing is making a recommendation [00:51:37 --> 00:51:39] to the board. [00:51:39 --> 00:51:42] And I think having two board members present [00:51:42 --> 00:51:46] will give us a sense about how the recommendations will [00:51:46 --> 00:51:47] be received. [00:51:47 --> 00:51:52] Obviously, it's not three votes, but there [00:51:52 --> 00:51:57] will be two members here who we can hear from. [00:51:57 --> 00:52:00] And like I said at the last meeting, at the end of the day, [00:52:00 --> 00:52:02] the board is going to be the one that, [00:52:02 --> 00:52:05] when you look at all of these things, general plan, [00:52:05 --> 00:52:08] ordinances, all those things are within the jurisdiction of the board. [00:52:08 --> 00:52:19] And so, I would, I would like the support having two board members part of this body. [00:52:19 --> 00:52:26] Really, really quickly, I also do support having two board members on this committee [00:52:26 --> 00:52:30] just because it gives a realistic sense of what can be approved just like Mr. Murray [00:52:30 --> 00:52:34] is that however, seeing that the two, [00:52:34 --> 00:52:37] and this is all due respect to Mrs. Price and Mr. Hopp, [00:52:37 --> 00:52:38] but seeing that the two supervisors [00:52:38 --> 00:52:42] who were appointed immediately supported the lot merger, [00:52:42 --> 00:52:44] I think it would be more beneficial [00:52:44 --> 00:52:46] if we had someone who voted against, [00:52:46 --> 00:52:48] and I know that gets into the intricacies of policy, [00:52:48 --> 00:52:53] but I think Mrs. Price and Mrs. Singh [00:52:53 --> 00:52:56] would have been great representatives. [00:52:56 --> 00:53:01] But I fully support having two supervisors on the board. [00:53:01 --> 00:53:08] Maybe the support and opposition is a little one-sided when it comes to those appointments. [00:53:08 --> 00:53:12] We know who has three votes on the supervisors. [00:53:12 --> 00:53:15] But at this point, I don't think there's much we can change. [00:53:15 --> 00:53:32] Looking around the room, it doesn't look, oh, there is, sorry. [00:53:32 --> 00:53:35] So, sorry, I don't want to get you off. [00:53:35 --> 00:53:36] I'll give you guys some time for something. [00:53:36 --> 00:53:39] I'm here as a public member. [00:53:39 --> 00:53:47] The main biggest thing on this is, I think, regardless of who is on the court, whether you believe it should or shouldn't be, [00:53:47 --> 00:53:53] this is a committee of, you know, essentially 19 people that should make 19 people. [00:53:53 --> 00:54:06] We've been at 17. I think if the majority, whatever the decision is for this court, is the recommendation to the county or supervisors, [00:54:06 --> 00:54:12] us as a public, if they look at this recommendation, whatever it may be, and they decide to go with [00:54:12 --> 00:54:19] the opposite, then that's where us as a public need to make our voices heard at that right time [00:54:19 --> 00:54:25] in the future and make sure it is heard about them, right? Ultimately, we are the ones that are [00:54:25 --> 00:54:30] selecting our leaders no matter what position they are in, whether it's city council, [00:54:30 --> 00:54:33] whether it's poor supervisors, whether they're discovering their senators, it's one of the [00:54:33 --> 00:54:37] members to have a right is our job to make sure our voices heard one way to [00:54:37 --> 00:54:42] shape the point and on that end you know this committee was formed by the [00:54:42 --> 00:54:47] board of directors like Mr. Rita said we all have the opportunity to apply we all [00:54:47 --> 00:54:51] have the opportunity to show up to explain why we wanted to be a part of [00:54:51 --> 00:54:56] this I have been open-minded about as centers I'm not saying they're bad [00:54:56 --> 00:55:00] I'm not saying they're good because I have heard both of them ultimately I [00:55:00 --> 00:55:05] I think AI is going to be part of the future. [00:55:05 --> 00:55:09] But I'm also Gen X, I'm a little weird because of Terminator. [00:55:09 --> 00:55:10] I'm waiting for 2029. [00:55:10 --> 00:55:13] But at the end of the day, I think, [00:55:13 --> 00:55:17] regardless of the decision, AI is happening. [00:55:17 --> 00:55:20] There's issues happening on there [00:55:20 --> 00:55:22] and currently that are going to get addressed. [00:55:22 --> 00:55:24] I need to get addressed on that end. [00:55:24 --> 00:55:26] We're not going to stop the development of AI [00:55:26 --> 00:55:29] no matter what our ultimate decision is here. [00:55:29 --> 00:55:36] And I think our goal should be whether a data center is viable for this county. [00:55:36 --> 00:55:38] That is our ultimate charge. [00:55:38 --> 00:55:43] And if it is, how do we make sure that we incorporate correct regulations and [00:55:43 --> 00:55:50] guidance to either have it or if we say no, everybody understands why it's not. [00:55:50 --> 00:55:56] I also just want to be mindful. [00:55:56 --> 00:56:00] We have, yeah, to go through and I really think we'll get into all this [00:56:00 --> 00:56:03] conversation on lower plan development. [00:56:03 --> 00:56:04] they don't want to limit anyone. [00:56:04 --> 00:56:07] But it looks at this point, we have great discussion, [00:56:07 --> 00:56:10] but we do not want to change the language [00:56:10 --> 00:56:14] for section four of the bylaws. [00:56:14 --> 00:56:16] Great, okay. [00:56:16 --> 00:56:18] You guys have to do the answer. [00:56:18 --> 00:56:22] I think the first person to support this question. [00:56:22 --> 00:56:24] I just want to make sure that, [00:56:24 --> 00:56:26] and I don't know if this is already a requirement, [00:56:26 --> 00:56:28] it might be, but I haven't read, [00:56:28 --> 00:56:31] that every member of this committee, [00:56:31 --> 00:56:33] that it also happens to be an actual resident [00:56:33 --> 00:56:34] of Imperial County, [00:56:34 --> 00:56:36] just want to make sure that the voice is collectively [00:56:36 --> 00:56:39] feel decided in all the future in autonomy. [00:56:39 --> 00:56:41] So I don't know if that's something that we need to have [00:56:41 --> 00:56:43] because the way that I read it, [00:56:43 --> 00:56:44] someone could potentially be appointed [00:56:44 --> 00:56:45] to that's not from this count. [00:56:45 --> 00:56:48] And I think I'm a little comfortable about that. [00:56:48 --> 00:56:51] Obviously I welcome outside opinions and experts [00:56:51 --> 00:56:54] and professors if they want to get into presentations [00:56:54 --> 00:56:56] and why not, but I feel like that nobody [00:56:56 --> 00:57:00] member of this committee should be from this committee. [00:57:00 --> 00:57:01] I don't know if I'm only not one, [00:57:01 --> 00:57:08] but I would like the language to be established in there. [00:57:08 --> 00:57:18] Okay. So we can make note of that and we can go back and [00:57:18 --> 00:57:23] I am not from this county. [00:57:23 --> 00:57:29] I would support that amendment. [00:57:29 --> 00:57:37] But you're here, you're operating in this county? [00:57:37 --> 00:57:40] We are looking at different projects here in this county. [00:57:40 --> 00:57:43] Okay. So as I'm getting an out vested that's no fear. [00:57:43 --> 00:57:49] So we are, I'm here to represent the energy industry. [00:57:49 --> 00:57:56] I think we're going to have to really redo a whole everything and submit it to my application [00:57:56 --> 00:57:59] much like everybody else here in this room did. [00:57:59 --> 00:58:03] And it was very clear I'm not living here. [00:58:03 --> 00:58:05] Well it's good that you're here Peggy Brass. [00:58:05 --> 00:58:19] Because I think we're going to ask you to talk with the board of supervisors about this situation [00:58:19 --> 00:58:27] and understand where this is going, see what's possible. [00:58:27 --> 00:58:30] I believe this was the only application we received [00:58:30 --> 00:58:32] for this category. [00:58:32 --> 00:58:35] There was one other, and my understanding is that [00:58:35 --> 00:58:38] individuals will live somewhere in the Midwest. [00:58:38 --> 00:58:41] Yeah, I don't think either one of the applicants, [00:58:41 --> 00:58:43] if I would call correctly. [00:58:43 --> 00:58:47] So, and I think we did ask if either one of them [00:58:47 --> 00:58:50] would be eligible based on our bylaws [00:58:50 --> 00:58:52] and it was approved to go ahead [00:58:52 --> 00:58:54] and have it in the bottom tier of the limit. [00:58:54 --> 00:58:56] But I'm glad to take it back. [00:58:56 --> 00:59:02] that's something that this committee would like to have reviewed. [00:59:02 --> 00:59:10] And as it goes back, it might be that your wisdom is needed, but we really would want to... [00:59:10 --> 00:59:12] No, I'm not going to ask. [00:59:12 --> 00:59:19] So then I guess if you can just leave and have that. [00:59:19 --> 00:59:26] So it definitely, based on the progress we're making right now, we're not going to decide today on any of these as a whole. [00:59:26 --> 00:59:28] We're not going to vote on this as a whole. [00:59:28 --> 00:59:32] But at least in the very least we can get through the other items. [00:59:32 --> 00:59:36] Okay, so a five, appointments and terms. [00:59:36 --> 00:59:40] We have gotten some feedback about B. [00:59:40 --> 00:59:42] Each appointed authority shall have sole authority [00:59:42 --> 00:59:46] to remove any member appointed by the appointing authority. [00:59:46 --> 00:59:49] Is the new language. [00:59:49 --> 00:59:52] Prior it was the board of supervisors shall have [00:59:52 --> 00:59:55] sole authority to remove appointee for membership. [00:59:56 --> 00:59:58] And then we have a majority candidate. [00:59:58 --> 01:00:01] The bullet can be removed and allowed committee members [01:00:01 --> 01:00:06] So that would be a simple goal. [01:00:06 --> 01:00:08] I think that also would include a appointee. [01:00:08 --> 01:00:17] Like if we had a big spot, we can also do the body to appoint as well. [01:00:17 --> 01:00:18] Any discussion? [01:00:18 --> 01:00:24] Yes, Madam Chair, the previous recommendation I made on allowing the supervisors or [01:00:24 --> 01:00:42] this body to appoint vacancies would be in this section just for records. [01:00:42 --> 01:00:46] shall be appointed by the city council of those cities, [01:00:46 --> 01:00:58] unless otherwise. [01:00:58 --> 01:01:02] I think that's highly unusual for a committee created [01:01:02 --> 01:01:07] by another body, then be able to point [01:01:07 --> 01:01:10] to remove members of that committee. [01:01:10 --> 01:01:17] To control your committee. [01:01:17 --> 01:01:20] Yeah, on our planning commission, [01:01:20 --> 01:01:24] we don't appoint people for our planning commission [01:01:24 --> 01:01:26] and then look at the planning commission [01:01:26 --> 01:01:28] just start removing them at their own will. [01:01:28 --> 01:01:33] That's bizarre. [01:01:33 --> 01:01:39] We just surrender that to them because it'd be fair to community [01:01:39 --> 01:01:44] to canvas the community again and get more applications [01:01:44 --> 01:01:50] and then go back to the planning commission with someone [01:01:50 --> 01:01:52] to replace someone. [01:01:52 --> 01:01:54] Should that be the case? [01:01:54 --> 01:01:56] But for our level. [01:01:56 --> 01:02:00] I think we're running some very complex issues [01:02:00 --> 01:02:02] to regarding this committee removing anybody [01:02:02 --> 01:02:05] is appointed by another agency. [01:02:05 --> 01:02:07] Typically, we have to define the criteria for a move [01:02:07 --> 01:02:08] or something. [01:02:08 --> 01:02:11] And I think it would be something that we [01:02:11 --> 01:02:15] want to discuss with the appointing authorities. [01:02:15 --> 01:02:20] And it also would make room for politicizing this committee. [01:02:20 --> 01:02:24] People then like a particular position, well, let's remove it. [01:02:24 --> 01:02:29] So I don't really like this particular of this. [01:02:29 --> 01:02:32] I think the appointed authority needs [01:02:32 --> 01:02:44] to be responsible for their appointee. [01:02:44 --> 01:02:46] So as I understand, he did. [01:02:46 --> 01:02:50] I just wanted to kind of, Michael, [01:02:50 --> 01:02:53] your comment was that A is about appointing [01:02:53 --> 01:02:57] and then he is about removal to let the decision. [01:02:57 --> 01:03:01] Yes, so my request was for the supervisors [01:03:01 --> 01:03:02] to appoint, of course, vacancies. [01:03:02 --> 01:03:04] They appointed originally, but if the city [01:03:04 --> 01:03:07] or appointing agency does not, maybe [01:03:07 --> 01:03:09] then the supervisors can step in. [01:03:09 --> 01:03:13] But all removals should be the supervisors in my opinion, [01:03:13 --> 01:03:16] unless it is the appointing agency. [01:03:16 --> 01:03:18] Yes, I think that was the perfect explanation. [01:03:18 --> 01:03:23] So yeah, so it's the authority. [01:03:23 --> 01:03:25] Yeah, that's the blue language. [01:03:25 --> 01:03:26] Yeah. [01:03:30 --> 01:03:34] So kind of on the same thing, as far as moving, [01:03:34 --> 01:03:37] what would constitute somebody being removed? [01:03:37 --> 01:03:39] That's the issue. [01:03:39 --> 01:03:41] And I'm sure in what constitutes an appointment. [01:03:41 --> 01:03:44] Right, but once the appointment's done, [01:03:44 --> 01:03:48] then technically the board should just leave that meeting. [01:03:48 --> 01:03:50] Leave it up to the committee. [01:03:50 --> 01:03:52] Now, we're turning it aside to stay or leave. [01:03:52 --> 01:03:54] That's one, my opinion. [01:03:54 --> 01:03:59] But two, what are we as a committee going to say, [01:03:59 --> 01:04:01] if we're going to take on Peggy, [01:04:01 --> 01:04:04] if you take on Peggy, sorry. [01:04:04 --> 01:04:06] But if Peggy says, you know, [01:04:06 --> 01:04:07] I didn't like what the airman said. [01:04:07 --> 01:04:11] And as a more supervisor, I'm going to remove the airman. [01:04:11 --> 01:04:14] What's the distinction? [01:04:14 --> 01:04:16] Where are we saying? [01:04:16 --> 01:04:17] I think that we need to have criteria [01:04:17 --> 01:04:20] on how we're removing this. [01:04:20 --> 01:04:23] Because I think once you're in, you should be in until you're [01:04:23 --> 01:04:25] out on your own. [01:04:25 --> 01:04:28] Or you don't meet certain criteria. [01:04:28 --> 01:04:30] You miss five meetings. [01:04:30 --> 01:04:32] And we have to accept that. [01:04:32 --> 01:04:35] And I think that should be the only criteria as far [01:04:35 --> 01:04:38] Maybe just add upon a vacancy. [01:04:38 --> 01:04:40] Correct. [01:04:40 --> 01:04:44] Just upon a vacancy occurring just so that the supervisors can [01:04:44 --> 01:04:56] make the case that we just moved from somebody [01:04:56 --> 01:04:57] to our vacancy. [01:04:57 --> 01:05:01] That's correct. [01:05:01 --> 01:05:05] But the design is in some way not available. [01:05:05 --> 01:05:08] Yes, but the criteria for removal would be, [01:05:08 --> 01:05:10] in my opinion, the three meetings missed without a good [01:05:10 --> 01:05:13] concept. [01:05:13 --> 01:05:14] Yes. [01:05:14 --> 01:05:25] when everybody's able to have to say no to the threat of the end of the movement. [01:05:25 --> 01:05:27] So I'll move down to the front of your room. [01:05:27 --> 01:05:29] Yes. [01:05:29 --> 01:05:37] We could do it, someone like the hospital district, [01:05:37 --> 01:05:43] if there's a vacancy in the district, [01:05:43 --> 01:05:50] the folks representing that district would have a first shot, first crack at replacing the person. [01:05:50 --> 01:05:54] Yes, that's the recommendation. [01:05:54 --> 01:05:57] I don't know if the community agrees, [01:05:57 --> 01:05:58] but that's what I recommend. [01:05:58 --> 01:06:00] Go back to the legal criteria. [01:06:00 --> 01:06:01] Yeah. [01:06:01 --> 01:06:03] Yeah. [01:06:03 --> 01:06:04] Yeah. [01:06:04 --> 01:06:05] I'm glad I said that. [01:06:05 --> 01:06:05] Yes. [01:06:05 --> 01:06:10] So the supervisors appoints in the event of a vacancy [01:06:10 --> 01:06:13] the criteria for removals are already established. [01:06:13 --> 01:06:16] So if removal must occur, it would [01:06:16 --> 01:06:19] be the supervisors instead of the appointing agency. [01:06:19 --> 01:06:23] If a resignation occurs, then the appointing agency [01:06:23 --> 01:06:24] would appoint, and if they don't, [01:06:24 --> 01:06:28] then the first letter A would add the contingency [01:06:28 --> 01:06:30] that would allow the supervisors to appoint [01:06:30 --> 01:06:34] if the city doesn't. [01:06:34 --> 01:06:40] Well, let's question that a little bit. [01:06:40 --> 01:06:42] I just want to expand on what you're saying. [01:06:42 --> 01:06:46] So some of these folks came from a nonprofit organization. [01:06:46 --> 01:06:48] So we use that person. [01:06:48 --> 01:06:50] Then the board of supervisors goes back [01:06:50 --> 01:06:54] and takes applications from nonprofit organizations [01:06:54 --> 01:06:59] They don't just arbitrarily say, okay, now we got a spot, we've put our guy. [01:06:59 --> 01:07:05] They go back, same criteria, they started to take someone from that community or whatever. [01:07:05 --> 01:07:11] With that situation, would we be a whole new application period? [01:07:11 --> 01:07:13] Like, are we going to go off the application period? [01:07:13 --> 01:07:15] I think that would be up to the supervisor. [01:07:15 --> 01:07:17] I think we'll only be able to read this application, sort of. [01:07:17 --> 01:07:48] I feel like we have completed five appointments and journeys. [01:07:48 --> 01:07:51] So we'll move on to officers. [01:07:51 --> 01:07:52] Now that we didn't receive any comments last time [01:07:52 --> 01:07:54] on this section, does anybody have something [01:07:54 --> 01:07:56] that would like to bring up on the officers [01:07:56 --> 01:07:58] to the data center shell? [01:07:58 --> 01:08:03] The chair and the vice chair, looking around the room. [01:08:03 --> 01:08:05] Everyone's fine. [01:08:05 --> 01:08:08] Okay, so we'll move on then to seven of the file laws [01:08:08 --> 01:08:10] on meetings. [01:08:10 --> 01:08:14] Here we did have a conversation on-seat. [01:08:14 --> 01:08:17] Regular meetings shall be set to formal action [01:08:17 --> 01:08:22] of the DCAC notice and agendas for regular meetings [01:08:22 --> 01:08:25] shall be posted and distributed importance [01:08:25 --> 01:08:27] with a requirement of a Brown Act, [01:08:27 --> 01:08:35] including at least 72 hours before the meeting. [01:08:36 --> 01:08:40] And I think this was a clarification around [01:08:40 --> 01:08:44] how we as a committee kind of set the agenda [01:08:44 --> 01:08:46] and then we as an individual, [01:08:46 --> 01:08:48] sorry, me as the chair could set, [01:08:48 --> 01:08:49] a special meeting. [01:08:49 --> 01:08:51] So that is the issue between that. [01:08:51 --> 01:08:53] Do you want to clarify more on this one? [01:08:53 --> 01:08:54] Oh, thank you. [01:08:54 --> 01:08:57] So, I'm sorry. [01:08:57 --> 01:09:02] Yeah, so I just wanted to make sure that with the perspective [01:09:02 --> 01:09:04] that chairs prerogative to call a meeting, [01:09:04 --> 01:09:06] that is for special meeting. [01:09:06 --> 01:09:10] So when it says Mr. Reed, you're concerned about chair [01:09:10 --> 01:09:12] scheduling regular meetings, I don't believe [01:09:12 --> 01:09:14] that the Crown Act contemplates [01:09:14 --> 01:09:17] that the chair can do that. [01:09:17 --> 01:09:20] and the chair can call the speciality. [01:09:20 --> 01:09:23] So that was an absurd, didn't have anything to do [01:09:23 --> 01:09:25] with a current chair and we kind of concerned [01:09:25 --> 01:09:28] about her calling the media. [01:09:28 --> 01:09:29] We brought it. [01:09:29 --> 01:09:30] We brought it. [01:09:30 --> 01:09:31] I'm ready. [01:09:36 --> 01:09:38] So it looks like we won't be taking in that music [01:09:38 --> 01:09:42] with said informal, actually, by the desk, [01:09:42 --> 01:09:43] if I see. [01:09:43 --> 01:09:45] Awesome. [01:09:50 --> 01:09:52] There was one other Eric section [01:09:52 --> 01:09:54] that was added for clarification. [01:09:54 --> 01:09:57] I believe this was Ms. Hollager's comment [01:09:57 --> 01:10:00] about how do we put forth an item to the agenda. [01:10:00 --> 01:10:05] So, a member made request an item within the subject matter [01:10:06 --> 01:10:09] jurisdiction of the data center advisory committee [01:10:09 --> 01:10:12] to be placed on the agenda for a regular meeting. [01:10:12 --> 01:10:14] The request shall be submitted to the chair [01:10:14 --> 01:10:16] sufficiently in advance of the meeting [01:10:16 --> 01:10:19] to allow for preparation and timely posting [01:10:19 --> 01:10:22] of the agenda in accordance with applicable law [01:10:22 --> 01:10:25] the timing, wording, and placement of the, [01:10:26 --> 01:10:31] of a request agenda item may be reasonably modified [01:10:31 --> 01:10:35] as necessary to address the legal, procedural, [01:10:35 --> 01:10:37] or practical consideration provided. [01:10:37 --> 01:10:41] However, the reasonable effort shall be made [01:10:41 --> 01:10:44] to place each timely request item on the agenda [01:10:44 --> 01:10:47] without a material altering the substance [01:10:47 --> 01:10:50] of the member's request. [01:10:50 --> 01:10:52] So if anybody would like an item on the agenda, [01:10:52 --> 01:10:55] I think it would just, you know, unequal to me, [01:10:55 --> 01:10:57] and then we can see where we best fit. [01:10:57 --> 01:10:59] But I also think as we move forward [01:10:59 --> 01:11:00] with the work plan development, [01:11:00 --> 01:11:02] I mean we're gonna develop kind of a plan [01:11:02 --> 01:11:06] of how we wanna utilize our time together. [01:11:06 --> 01:11:09] What is sufficiently intense? [01:11:09 --> 01:11:10] Well, that's a good question. [01:11:10 --> 01:11:13] So for example, this was a quick turnaround. [01:11:13 --> 01:11:14] This was like OV. [01:11:14 --> 01:11:17] So I mean, everything has to be posted, [01:11:19 --> 01:11:21] you know, the Wednesday before. [01:11:21 --> 01:11:28] Yeah, because of, for example, if there was like one item that was recommended, it was about 23 pages. [01:11:28 --> 01:11:32] I mean, I did not have time to review it prior to putting on the agenda, so we moved to another one. [01:11:32 --> 01:11:35] So yeah, especially lengthy items. [01:11:35 --> 01:11:43] So we want to put that in and find out if you wanted the Wednesday before. [01:11:43 --> 01:11:45] Yeah. [01:11:45 --> 01:11:47] Yeah. [01:11:47 --> 01:11:49] So let's, for example, we're meeting next Monday. [01:11:49 --> 01:11:51] For a Monday you wanted Wednesday. [01:11:51 --> 01:11:53] Yeah, so we're meeting next Monday, alright? [01:11:53 --> 01:11:58] then five by Wednesday would be [01:11:58 --> 01:12:04] and the posting goes on Friday. [01:12:04 --> 01:12:12] Preferably. [01:12:12 --> 01:12:17] I would say the Wednesday prior. [01:12:17 --> 01:12:32] Yeah, I'm not sure if it's to be the specific. I just [01:12:32 --> 01:12:34] I close the day. [01:12:34 --> 01:12:38] Yeah, because I'll be transparent. [01:12:38 --> 01:12:42] Like this time around, I think I put together the agenda on Thursday around noon. [01:12:42 --> 01:12:49] Of course, you have also the clerk's office has their time frame and there was back and forth. [01:12:49 --> 01:12:51] And then I was going to look at it. [01:12:51 --> 01:12:54] I will say this is outside of my day job. [01:12:54 --> 01:12:59] So like, I won't be able to like drag the day, you know, when the day only works schedule. [01:12:59 --> 01:13:02] So I prefer the the wincy board [01:13:15 --> 01:13:17] We just say by business [01:13:32 --> 01:13:56] I mean of course like I can't speak for myself. I don't know what other future chairs would do, but I have like a specific email dedicated to this information so I check it right before me. [01:13:56 --> 01:14:01] So if you email me, I will see it if the timing matters. [01:14:01 --> 01:14:02] And get back to you in the timing, Robert. [01:14:02 --> 01:14:04] But of course, that varies for chairs. [01:14:04 --> 01:14:14] So OK, so we feel comfortable with the adoption of that. [01:14:14 --> 01:14:18] We should clarify how we put an item on the agenda. [01:14:18 --> 01:14:20] Well, I'm just clarifying it. [01:14:20 --> 01:14:21] Five days to the final. [01:14:21 --> 01:14:24] Yeah, and again, it's not said and still, [01:14:24 --> 01:14:28] but we just sufficient amount of time for this. [01:14:28 --> 01:14:31] So we'll move on. [01:14:31 --> 01:14:33] You recommended just keeping it as it is. [01:14:33 --> 01:14:35] So I think the informal remediation can be cut based, [01:14:35 --> 01:14:38] but the verbiage is fine. [01:14:38 --> 01:14:42] As long as we know, well, one concerns [01:14:42 --> 01:14:45] is that there's back-up material, [01:14:45 --> 01:14:50] last-minute submission, reputation, materials. [01:14:50 --> 01:15:01] And that already means. [01:15:01 --> 01:15:03] Yeah, so I do want to look at it. [01:15:03 --> 01:15:04] I think that's good. [01:15:04 --> 01:15:06] So maybe I'll repeat what Cynthia said. [01:15:06 --> 01:15:10] So for example, say someone, it's Friday, [01:15:10 --> 01:15:12] and there's an item that goes to put on the agenda, [01:15:12 --> 01:15:13] but it's not enough time to review it [01:15:13 --> 01:15:15] or for me to review it. [01:15:15 --> 01:15:17] It doesn't mean it won't never go on an agenda. [01:15:17 --> 01:15:20] It just means it might not be for the next agenda. [01:15:20 --> 01:15:28] So that's, I don't think we're gonna add if I do. [01:15:28 --> 01:15:31] I mean, we're gonna keep the language as is, [01:15:31 --> 01:15:33] but sufficient is just, you know, sufficient. [01:15:33 --> 01:15:36] But I will say I approach your goal of flexible [01:15:36 --> 01:15:41] and I'll do my best to do everything that can be matter. [01:15:41 --> 01:15:43] I even this weekend, it was accessible, right? [01:15:43 --> 01:15:46] So to set the special meeting, so I will be accessible. [01:15:46 --> 01:15:52] So eight, quorum and voting. [01:15:52 --> 01:15:56] We had no comments last time, any comments this time? [01:15:56 --> 01:15:58] I'm just gonna do this, okay. [01:15:58 --> 01:16:00] The next one is attendance. [01:16:00 --> 01:16:03] Members are expected to attend all regular meetings. [01:16:03 --> 01:16:06] Any members who is absent from these three [01:16:06 --> 01:16:09] can vote except absent for three consecutive [01:16:09 --> 01:16:12] regular meetings without good cause. [01:16:12 --> 01:16:13] And this is not potential to remove, [01:16:13 --> 01:16:17] may be recommended to the applicable appointed authority. [01:16:18 --> 01:16:23] which will be for the removal of the data center advisor committee. [01:16:23 --> 01:16:25] Request to match appointment in terms of removal [01:16:25 --> 01:16:28] will be done by the data center advisor committee. [01:16:28 --> 01:16:30] So this is about the, we kind of just vested already [01:16:30 --> 01:16:35] the three day absence and the removal from the committee. [01:16:35 --> 01:16:37] We should have a nice kind of content [01:16:37 --> 01:16:39] that's why we have to set it up. [01:16:39 --> 01:16:43] We didn't specify that in the talk. [01:16:43 --> 01:16:47] Let's look at that. [01:16:47 --> 01:16:49] I don't think five needs to set up the criteria. [01:16:49 --> 01:16:53] the criteria is just a little bit further down. [01:16:53 --> 01:16:54] That's just establishing. [01:16:54 --> 01:16:57] It was an emotion for three ladies. [01:16:57 --> 01:17:02] But it didn't specify the second though. [01:17:02 --> 01:17:04] But it also says without the cause. [01:17:04 --> 01:17:06] The movie turns with the cause. [01:17:06 --> 01:17:10] Yeah, so it comes against you. [01:17:10 --> 01:17:13] It's in the, we do, like, that's part of our discussion. [01:17:13 --> 01:17:15] We in Germany was going to cause for them to not [01:17:15 --> 01:17:16] for some of the absence. [01:17:16 --> 01:17:19] So like if somebody was sick, then that's the cause. [01:17:19 --> 01:17:21] But then, you know. [01:17:21 --> 01:17:23] But I hate for everybody to show up with an ice bag [01:17:23 --> 01:17:36] I mean, Mr. Andrews' emails that he would be available, I just think, notice that. [01:17:36 --> 01:17:38] I think that's something we can have. [01:17:38 --> 01:17:40] Just email ahead of time. [01:17:40 --> 01:17:42] Yeah, somebody has a card, so it'll be very effective. [01:17:42 --> 01:17:44] It's possible in four weeks. [01:17:44 --> 01:17:47] You can see that, you know, we missed something. [01:17:47 --> 01:17:52] Maybe we could, like, if you have a good cause, call in early. [01:17:52 --> 01:17:55] let people know that death in their family or something [01:17:55 --> 01:17:59] and you can go to the other town and that's it. [01:17:59 --> 01:18:01] Yes, what are you doing, President? [01:18:01 --> 01:18:04] Ms. Fennell's comment was that that would change the right [01:18:04 --> 01:18:05] to be. [01:18:05 --> 01:18:08] It needs to stay also conservative, [01:18:08 --> 01:18:15] if number not nine is correct. [01:18:15 --> 01:18:16] So are you going to put on? [01:18:16 --> 01:18:19] Yeah, five doesn't mention any of today specifically, [01:18:19 --> 01:18:21] just mentions the removal. [01:18:21 --> 01:18:25] And then this specifies the criteria over the new. [01:18:25 --> 01:18:30] Okay, so it is three consecutive needs, not three, [01:18:32 --> 01:18:33] all of the board. [01:18:33 --> 01:18:35] That would be what's defined in the line. [01:18:35 --> 01:18:36] Yeah, that would be under attendance. [01:18:36 --> 01:18:39] So we didn't change the language, as Michael said, [01:18:39 --> 01:18:44] for five, we kept it with the language that it has, [01:18:45 --> 01:18:47] the one highlighted in blue. [01:18:47 --> 01:18:50] And we just kind of openly discussed attendance [01:18:50 --> 01:18:53] in correlation to that, like what a removal [01:18:53 --> 01:19:00] the constitute. So for for nine, though, yes, it does a consecutive regular [01:19:00 --> 01:19:05] meeting without good cause. So I think we have one individual. I was already in [01:19:05 --> 01:19:20] absent for two. Hopefully they join us next time. Okay, so attendance we keep it [01:19:20 --> 01:19:28] we keep it as is. Okay, so we're keeping nine attendance as is. Now we want [01:19:28 --> 01:19:29] 10. [01:19:29 --> 01:19:30] Oh, no. [01:19:30 --> 01:19:34] Is it as it's written here? [01:19:34 --> 01:19:40] Is it written here or are these recommended changes or not changes? [01:19:40 --> 01:19:44] Yeah, it will serve as a safe measure. [01:19:44 --> 01:19:50] Yeah, so any member who is absent from three consecutive regular meetings without good [01:19:50 --> 01:19:55] cause may be recommended to the, like a bold form to the authority, so I could get [01:19:55 --> 01:19:58] city or like the board of supervisors for removal [01:19:58 --> 01:20:00] from the Dallas Enterprise. [01:20:00 --> 01:20:04] So no changes, but to underline Ms. Fendell's comment [01:20:04 --> 01:20:07] about the consecutive, it would have to be three [01:20:07 --> 01:20:08] absences in a row. [01:20:08 --> 01:20:11] So you can be absent three or more times [01:20:11 --> 01:20:13] but sporadically over the past, I know, [01:20:13 --> 01:20:15] next five months or so. [01:20:15 --> 01:20:19] And you would be inexceptibly in good standing [01:20:19 --> 01:20:20] I guess, committee member. [01:20:21 --> 01:20:22] All right. [01:20:22 --> 01:20:27] So 10 committee, it looks like we have no suggestions [01:20:27 --> 01:20:30] from last time, anybody have any suggestions? [01:20:30 --> 01:20:33] Looking around the room. [01:20:33 --> 01:20:36] And we're gonna move on from 10 to 11. [01:20:36 --> 01:20:38] Compensation appointees to the data center [01:20:38 --> 01:20:40] shall serve without compensation. [01:20:40 --> 01:20:42] Is anyone really feeling the capacity? [01:20:42 --> 01:20:45] Maybe the community members, I'm just kidding. [01:20:45 --> 01:20:47] Coming from the real market. [01:20:47 --> 01:20:47] Yeah. [01:20:47 --> 01:20:48] So, okay. [01:20:57 --> 01:20:59] Okay, I'm gonna relate to that one. [01:20:59 --> 01:21:03] Okay, so then it looks like we came to the end [01:21:03 --> 01:21:05] of our bylaws. [01:21:05 --> 01:21:07] Thank you for sticking with us. [01:21:07 --> 01:21:10] Now we're with the public as well as all the committee. [01:21:10 --> 01:21:12] The clerk will take this back [01:21:12 --> 01:21:14] and next time hopefully we'll have a full, [01:21:14 --> 01:21:16] you know, 12 minutes. [01:21:16 --> 01:21:18] Okay, thank you. [01:21:18 --> 01:21:20] We have public comments. [01:21:20 --> 01:21:23] So before we vote, we're not gonna vote actually, [01:21:23 --> 01:21:24] but we'll take public comment [01:21:24 --> 01:21:27] and we'll take those into consideration as well. [01:21:27 --> 01:21:28] Thank you for your patience [01:21:28 --> 01:21:31] as I get used to this chair position. [01:21:31 --> 01:21:41] So we'll start with Adele, Vernon. [01:21:41 --> 01:21:43] Everybody knows I don't need a microphone. [01:21:43 --> 01:21:45] Everybody knows that. [01:21:45 --> 01:21:50] Okay, my concern is the charge of this committee. [01:21:51 --> 01:21:54] Now I didn't know if I know that part. [01:21:54 --> 01:21:55] Am I on? [01:21:55 --> 01:21:59] Okay, my concern is the charge. [01:21:59 --> 01:22:05] Now, this is more from the time that this committee or this board was forced into being, right? [01:22:05 --> 01:22:08] I'm going to use it as a pointer so that's the problem, right? [01:22:08 --> 01:22:13] Okay, it wasn't, it was, we're all volunteers here, right? [01:22:13 --> 01:22:15] But it was a forced issue. [01:22:15 --> 01:22:22] Because if the board had had their way from the beginning, from the time when lot mergers started, [01:22:22 --> 01:22:24] from the whole process through that, [01:22:24 --> 01:22:27] this data center would be built right now. [01:22:27 --> 01:22:31] It would be built in the process right now. [01:22:31 --> 01:22:34] They didn't vet the developers, [01:22:34 --> 01:22:37] they didn't research the projects, [01:22:37 --> 01:22:40] and it was written like it was a done deal. [01:22:40 --> 01:22:43] All the paperwork I saw from the planning commission [01:22:43 --> 01:22:45] and everything else was just signed away [01:22:45 --> 01:22:47] and we're good to go. [01:22:47 --> 01:22:49] Now I do have a problem with the fact [01:22:49 --> 01:22:53] I don't feel that this is totally independent, [01:22:53 --> 01:22:56] that this advisory board is on our own. [01:22:56 --> 01:22:59] I do believe that's important. [01:22:59 --> 01:23:03] The reason we're here is because things were shortcutted, [01:23:03 --> 01:23:06] done improperly, it's been adjudicated by a judge. [01:23:06 --> 01:23:08] We have issues, we have problems. [01:23:08 --> 01:23:10] We have to be transparent, [01:23:10 --> 01:23:14] and we have to be a community that works together. [01:23:14 --> 01:23:16] Now, we have not been that. [01:23:16 --> 01:23:20] And I've been at most of the board meetings since December. [01:23:20 --> 01:23:22] I was out for a while, my husband broke his back, [01:23:22 --> 01:23:24] I missed a couple. [01:23:24 --> 01:23:27] So this is critically important. [01:23:27 --> 01:23:29] That the Valley as a whole has a chance [01:23:29 --> 01:23:31] to look at the prospect. [01:23:31 --> 01:23:35] And it has been clarified that ban is a possibility, [01:23:35 --> 01:23:37] because I've been getting the impression that our charge [01:23:37 --> 01:23:38] has changed. [01:23:38 --> 01:23:40] Well, you've got zoning to consider, [01:23:40 --> 01:23:42] and you've got the general plan to consider. [01:23:42 --> 01:23:43] And this is all a big deal. [01:23:43 --> 01:23:51] But our mission here, I believe, is to decide whether the valley can manage this industry. [01:23:51 --> 01:23:53] And it is a problem. [01:23:53 --> 01:23:56] We all know we do not have the resources to this. [01:23:56 --> 01:23:57] It has to be developed. [01:23:57 --> 01:23:59] It has to be funded. [01:23:59 --> 01:24:00] We don't have any of that. [01:24:00 --> 01:24:03] And you can't fund on the backing promise. [01:24:03 --> 01:24:09] The solar, the wind, we've not benefited like they said we were going to from these [01:24:09 --> 01:24:10] projects. [01:24:10 --> 01:24:11] And I'm pro-winter. [01:24:11 --> 01:24:12] I'm pro-wind. [01:24:12 --> 01:24:18] win and AI is usable it is something we can do but I think it's being orchestrated [01:24:18 --> 01:24:23] for things that we're not aware of and this has to be inspected this has to be [01:24:23 --> 01:24:29] examined from the top down front every which way it's important it could be [01:24:29 --> 01:24:33] debilitating and we could never recover from these things this is not [01:24:33 --> 01:24:37] anything that you can look at like well it could be good it could be bad it [01:24:37 --> 01:24:43] could be devastating. We could go down in flames over something that has not been examined [01:24:43 --> 01:24:47] for them. So anyway, that's what I've got to say about that. [01:24:47 --> 01:24:48] Thank you Adele. [01:24:48 --> 01:24:49] Thank you. [01:24:49 --> 01:24:50] Next public comment is Jake Tyson. [01:24:50 --> 01:25:09] Oh yes, 729. This is Edwards. Thank you. Okay I'm sorry for that question. I'm [01:25:09 --> 01:25:10] 29. [01:25:10 --> 01:25:15] This is Edward. [01:25:15 --> 01:25:17] Thank you. [01:25:17 --> 01:25:19] Okay, I'm sorry for that introduction. [01:25:19 --> 01:25:21] Go ahead, Mr. Kaysen. [01:25:21 --> 01:25:23] Yeah, no problem. Thank you. [01:25:23 --> 01:25:25] So mine was on number nine, [01:25:25 --> 01:25:27] the information items of the [01:25:27 --> 01:25:29] data center committee website. [01:25:29 --> 01:25:31] So I don't know if any of you folks, [01:25:31 --> 01:25:33] sorry, I don't know if you need to. [01:25:33 --> 01:25:35] This one is for bylaws. You have a couple. [01:25:35 --> 01:25:37] Yeah, but you asked us to wait until I waited. [01:25:37 --> 01:25:39] Okay, so this is about [01:25:39 --> 01:25:41] any data center committee website [01:25:41 --> 01:25:45] It says website, bylaws, again, is managed with book of law. [01:25:45 --> 01:25:48] But I don't know if any of you have seen it yet. [01:25:48 --> 01:25:51] But there's a website that says, it [01:25:51 --> 01:25:55] works in guide to the data center advisory committee [01:25:55 --> 01:25:56] chart. [01:25:56 --> 01:25:57] OK? [01:25:57 --> 01:25:59] I don't know if any of you guys seen any of that. [01:25:59 --> 01:26:00] It's an extensive website. [01:26:00 --> 01:26:03] In fact, there's a whole section on me. [01:26:03 --> 01:26:04] OK? [01:26:04 --> 01:26:07] And there's something about all of you. [01:26:07 --> 01:26:13] So yes, right now, we are under by us to [01:26:13 --> 01:26:15] introduction. [01:26:15 --> 01:26:16] It's discussion. [01:26:17 --> 01:26:17] I don't know. [01:26:18 --> 01:26:19] Oh, you haven't done the information. [01:26:19 --> 01:26:19] I did. [01:26:20 --> 01:26:20] Okay. [01:26:20 --> 01:26:20] Sorry. [01:26:21 --> 01:26:23] But you do have a break. [01:26:24 --> 01:26:24] Yes. [01:26:24 --> 01:26:26] You can still speak on the bylaws. [01:26:26 --> 01:26:26] I don't. [01:26:26 --> 01:26:27] Yes. [01:26:27 --> 01:26:29] Because you have a multiple card. [01:26:29 --> 01:26:31] Well, it's just to speak on the website. [01:26:31 --> 01:26:31] Okay. [01:26:31 --> 01:26:31] Okay. [01:26:31 --> 01:26:33] Then we'll wait for the website. [01:26:33 --> 01:26:33] Is that okay? [01:26:33 --> 01:26:35] I thought you were just waiting in the right. [01:26:36 --> 01:26:36] Yeah. [01:26:36 --> 01:26:38] Okay, I really sorry for confusing this. [01:26:40 --> 01:26:44] Kelly Jordan, you also, there's a comment for Bylaws. [01:26:44 --> 01:26:45] I did. [01:26:46 --> 01:26:51] It was just for clarification, like on the agenda, [01:26:51 --> 01:26:54] it just says, by law, change recommendation. [01:26:54 --> 01:26:57] And if in the future, you could clearly [01:26:57 --> 01:27:02] sustain the exact proposed changes on the agenda. [01:27:02 --> 01:27:07] So we know exactly what those recommendations would be. [01:27:08 --> 01:27:14] And also, clarification, is this a change for the committee [01:27:14 --> 01:27:19] or are you going to bring this to the Board of Supervisors [01:27:19 --> 01:27:21] for recommendation? [01:27:21 --> 01:27:22] Because we have the answers to it. [01:27:22 --> 01:27:23] I can answer that. [01:27:23 --> 01:27:28] So on the agenda, your correct is section B, [01:27:29 --> 01:27:31] but then there's item also B. [01:27:31 --> 01:27:35] So in the agenda, the attachment was the list [01:27:35 --> 01:27:37] of recommendations they were highlighted [01:27:37 --> 01:27:41] along with no terms which committee member they came from. [01:27:41 --> 01:27:44] So that's where your first question around [01:27:44 --> 01:27:46] having that accessible, I can make that more clear [01:27:46 --> 01:27:47] in terms of an agenda. [01:27:47 --> 01:27:51] But also the other part about yes, this would be, [01:27:51 --> 01:27:53] it's going now to County Council, [01:27:53 --> 01:27:56] it will go to County Council for to review our suggestions [01:27:56 --> 01:27:58] and provide suggested language. [01:27:58 --> 01:28:01] and then from there it will come back to us [01:28:01 --> 01:28:02] and then we will vote next meeting [01:28:02 --> 01:28:05] and then after that it will go to the board supervisors [01:28:05 --> 01:28:07] and then yes they have that decision to adopt it [01:28:07 --> 01:28:09] as the resolution as they're the ones [01:28:09 --> 01:28:11] who created the bylaws essentially. [01:28:11 --> 01:28:12] Thank you for your patience. [01:28:15 --> 01:28:18] Oh welcome, we need to make sure I add you to my [01:28:18 --> 01:28:21] John join us at 7.32, you got it? [01:28:21 --> 01:28:22] Oh, it's right here. [01:28:22 --> 01:28:23] Okay. [01:28:23 --> 01:28:29] Okay, so we have, oh, and Mr. Ardizadeh, okay. [01:28:31 --> 01:28:33] Thank you, I'm sorry if I, you have too much to add. [01:28:33 --> 01:28:35] Okay, okay, okay. [01:28:35 --> 01:28:40] And then our last public comment, oh, we have two more. [01:28:40 --> 01:28:48] We have Joseph Diem. [01:28:48 --> 01:28:52] Just wanted to follow up on what Mr. Ruehelden was saying. [01:28:52 --> 01:28:55] If there was a bias already in the board of supervisors [01:28:55 --> 01:28:56] and we were to remove two people, [01:28:56 --> 01:28:58] then I think we should go the other way too, [01:28:58 --> 01:29:01] with people who are biased for a man. [01:29:01 --> 01:29:05] So we'll constitute Mr. Montanades, Mr. Christians. [01:29:05 --> 01:29:06] There'll be a lot of people down. [01:29:06 --> 01:29:09] I mean, let's play fair here. [01:29:09 --> 01:29:12] Let's run a committee. [01:29:12 --> 01:29:14] I think also the chair of Christian, [01:29:14 --> 01:29:16] I think you have to remind people to charge [01:29:16 --> 01:29:17] every single time. [01:29:17 --> 01:29:19] Because I've heard three or four times [01:29:19 --> 01:29:22] on tap on the board with no reason. [01:29:22 --> 01:29:23] I don't think that constitute [01:29:23 --> 01:29:26] as making anything productive here. [01:29:26 --> 01:29:27] We're just going over and over again [01:29:27 --> 01:29:29] the same political talking points, [01:29:29 --> 01:29:30] we're getting nothing here. [01:29:30 --> 01:29:33] So recommend to remind everybody that comes up here, [01:29:33 --> 01:29:35] run with a charge and with this committee's one. [01:29:35 --> 01:29:36] Thank you. [01:29:36 --> 01:29:38] Thank you. [01:29:38 --> 01:29:41] And then our last public comment is, [01:29:44 --> 01:29:46] oh, we have two more. [01:29:46 --> 01:29:56] Michael Morales. [01:29:56 --> 01:29:58] She can go next. [01:29:58 --> 01:29:59] Yeah, go ahead, Susan. [01:29:59 --> 01:30:01] I'm sorry, I couldn't read the names. [01:30:01 --> 01:30:03] I know what it's gonna add for. [01:30:03 --> 01:30:04] It was what it was. [01:30:04 --> 01:30:06] So going over the bylaws, [01:30:06 --> 01:30:10] I'll just make several talking points. [01:30:10 --> 01:30:13] With respect to removing a committee member [01:30:13 --> 01:30:16] for good cause for missing appointments, [01:30:16 --> 01:30:19] typically it is the executive committee, [01:30:19 --> 01:30:22] which would be the chair, the vice chair, [01:30:22 --> 01:30:26] and the secretary or the officers essentially [01:30:26 --> 01:30:28] that would have a meeting and then put that [01:30:28 --> 01:30:32] on the agenda for the committee to discuss. [01:30:32 --> 01:30:36] So I don't know if clarification needs to be made [01:30:36 --> 01:30:39] With respect to that, but it simplifies [01:30:40 --> 01:30:43] versus the whole committee having a discussion. [01:30:43 --> 01:30:48] I also have concerns with respect to submitting agenda items. [01:30:48 --> 01:30:51] I think that anyone on this committee [01:30:51 --> 01:30:53] submits an agenda item. [01:30:53 --> 01:30:54] It should be on the agenda, [01:30:54 --> 01:30:58] whether the church has a chance to review it or not. [01:30:58 --> 01:30:59] It's just respectful. [01:30:59 --> 01:31:04] I don't think it needs to get overly complicated or delayed. [01:31:04 --> 01:31:10] And lastly, I'm having a senior moment. [01:31:13 --> 01:31:16] And then even, I guess those are my only two comments [01:31:16 --> 01:31:17] since I can't remember my third. [01:31:17 --> 01:31:21] But the job, I just feel that it should, [01:31:21 --> 01:31:25] everybody should be considered no matter what they are, [01:31:27 --> 01:31:29] if they submit something. [01:31:29 --> 01:31:34] And I will say with respect to Mr. Nima, [01:31:34 --> 01:31:36] I strongly feel everyone on this committee [01:31:36 --> 01:31:40] should be a resident of the county, [01:31:40 --> 01:31:42] whatever recommendation comes there. [01:31:42 --> 01:31:46] But I also feel that your expertise, [01:31:46 --> 01:31:48] you're exactly what we're looking for [01:31:48 --> 01:31:53] with respect to guidance and information and expertise. [01:31:53 --> 01:31:54] So I don't know how that will play out, [01:31:54 --> 01:31:59] but my position is that this committee [01:32:01 --> 01:32:02] be valley residents. [01:32:02 --> 01:32:07] And finally, I request that your email [01:32:07 --> 01:32:09] that you have dedicated to this committee [01:32:09 --> 01:32:14] be made to the public so that we can submit concerns [01:32:14 --> 01:32:20] or comments to the chair. [01:32:20 --> 01:32:21] Thank you. [01:32:21 --> 01:32:22] Thank you. [01:32:23 --> 01:32:35] And then, Michael, what about this? [01:32:35 --> 01:32:38] Hello, good evening everybody. [01:32:38 --> 01:32:40] I just wanted to touch on something real quick [01:32:40 --> 01:32:42] on the charge. [01:32:42 --> 01:32:45] And that's the last paragraph, which states that [01:32:45 --> 01:32:48] this board, this committee will present its findings [01:32:48 --> 01:32:51] and recommendations to the board of supervisors [01:32:51 --> 01:32:54] by January 1st of 2027. [01:32:54 --> 01:32:58] And that's my concern, because last meeting it was discussed. [01:32:58 --> 01:33:03] It was mentioned that if that date was not doable, [01:33:04 --> 01:33:05] that it could be extended. [01:33:07 --> 01:33:09] I personally would feel more comfortable [01:33:09 --> 01:33:12] if it was actually documented and placed on there [01:33:12 --> 01:33:16] that that date is flexible, that's given you guys more time [01:33:16 --> 01:33:19] because I doubt if you guys are gonna be, [01:33:19 --> 01:33:21] I mean, we're going into October already. [01:33:21 --> 01:33:25] I don't think you will have a final report by January. [01:33:25 --> 01:33:27] So that's just something I wanted to point out. [01:33:27 --> 01:33:28] Thank you. [01:33:28 --> 01:33:29] Thank you. [01:33:29 --> 01:33:31] I will say it as soon as possible. [01:33:31 --> 01:33:34] Mm-hmm. [01:33:34 --> 01:33:37] The reason we will be doing this. [01:33:37 --> 01:33:38] Oh, that next? [01:33:38 --> 01:33:39] Yeah, I'm afraid. [01:33:39 --> 01:33:43] January 1st, or I assume after this, we seem practical. [01:33:44 --> 01:33:52] Thank you. [01:33:52 --> 01:33:54] So, since we are not going to vote today [01:33:54 --> 01:33:59] on the bylaw changes, we'll be in the agenda next week. [01:34:00 --> 01:34:02] Thank you members of the public. [01:34:02 --> 01:34:07] So we're gonna move on to item C, work plan development. [01:34:07 --> 01:34:12] I do wanna be mindful of time, so it's 7.38. [01:34:12 --> 01:34:17] And the way I see it is work plan development could essentially be a very lengthy conversation. [01:34:17 --> 01:34:23] We could be here for hours on and discussing what we want to focus on as a committee. [01:34:23 --> 01:34:31] So I am actually going to kind of put some parameters for us if that's okay about like no more than like 30 minutes of us discussing it. [01:34:31 --> 01:34:39] It can be carried on to another agenda just because I want to make sure that today we really get an opportunity for the informational item, [01:34:39 --> 01:34:42] which is the data center committee website, [01:34:42 --> 01:34:43] which shouldn't take more than I think [01:34:43 --> 01:34:46] in like five minutes, it can be very quick, [01:34:46 --> 01:34:49] as well as the update on the data center moratorium, [01:34:49 --> 01:34:52] which will probably be another five to 10 minutes. [01:34:52 --> 01:34:55] So I don't know if you guys have a key three out, [01:34:55 --> 01:34:56] maybe possibly. [01:34:56 --> 01:34:59] And then the California data center legislation [01:34:59 --> 01:35:03] is probably gonna be another 10 minutes as well. [01:35:04 --> 01:35:06] So I just wanna put that forward, [01:35:06 --> 01:35:08] that I'm gonna just be kind of monitoring the time [01:35:08 --> 01:35:11] as we get a little bit after eight [01:35:11 --> 01:35:13] so we can move on to the information items. [01:35:13 --> 01:35:15] But we can always bring back this work plan. [01:35:15 --> 01:35:18] This is just a beginning of the conversation. [01:35:18 --> 01:35:20] Kind of the, I would see as an icebreaker. [01:35:20 --> 01:35:22] I know a lot of the members of the public feel [01:35:22 --> 01:35:25] that there's a lot of bias on both spectrums [01:35:25 --> 01:35:27] on the data center conversation. [01:35:27 --> 01:35:29] So this is an opportunity for all of us [01:35:29 --> 01:35:33] to discuss these items publicly of, you know, [01:35:33 --> 01:35:35] where do we see a work plan? [01:35:35 --> 01:35:37] Who do we wanna have come, you know, [01:35:37 --> 01:35:40] speak on different things, different areas, [01:35:40 --> 01:35:43] subjects related to data center development. [01:35:43 --> 01:35:46] So I just want to kind of start us off on that. [01:35:46 --> 01:35:49] But we did have, we have poster boards. [01:35:49 --> 01:35:50] I'm a visual person. [01:35:50 --> 01:35:53] I've also been sitting down for a really long time. [01:35:53 --> 01:35:56] So, and we have really cool markers. [01:35:56 --> 01:36:00] So we could definitely like, if we have different boards, [01:36:00 --> 01:36:01] so I want to see an example. [01:36:01 --> 01:36:05] Like if we're concerned about water usage plan, [01:36:05 --> 01:36:07] like what's the county's water use plan [01:36:07 --> 01:36:09] for industrial development? [01:36:09 --> 01:36:11] And that would include data centers. [01:36:11 --> 01:36:13] So that can be something that you put up on the board, [01:36:13 --> 01:36:14] we can start with testing, [01:36:14 --> 01:36:16] and then we can, I mentioned we'll consolidate [01:36:16 --> 01:36:18] all day for me to put forward today. [01:36:18 --> 01:36:21] And this will just be the committee today doing this. [01:36:21 --> 01:36:24] It doesn't mean that we'll limit it to the committee. [01:36:24 --> 01:36:28] There's opportunities for us to have a community session [01:36:28 --> 01:36:30] where this is open to the public [01:36:30 --> 01:36:31] if that's so limited committee decides [01:36:31 --> 01:36:34] that we want to also do as well. [01:36:34 --> 01:36:36] So this is just, like I said, it's a beginning. [01:36:36 --> 01:36:37] It's an icebreaker. [01:36:37 --> 01:36:39] It's a work plan development, [01:36:39 --> 01:36:41] kind of to get the ball rolling essentially. [01:36:42 --> 01:36:46] Also like one of the boards we focus on, energy use plans. [01:36:46 --> 01:36:50] Maybe we wanna see if does our grid have the capacity? [01:36:50 --> 01:36:51] Where will that be? [01:36:51 --> 01:36:52] Where is it gone? [01:36:52 --> 01:36:55] So I just wanted to kind of start us off [01:36:55 --> 01:36:57] on that some thoughts on the work plan. [01:36:57 --> 01:36:59] I don't know if the chair or the secretary [01:36:59 --> 01:37:01] could maybe on the panel on work plan. [01:37:01 --> 01:37:18] Oh, we're not, we're not, we're not, let me clarify. [01:37:18 --> 01:37:21] So to the committee, so we're not finding questions, [01:37:21 --> 01:37:23] I mean, sorry, we're not, we don't need answers, [01:37:23 --> 01:37:25] we're just one of the questions we have. [01:37:26 --> 01:37:30] So there's a lot of concerns around, [01:37:30 --> 01:37:32] do we have the water in Imperial County [01:37:32 --> 01:37:36] to sufficiently support not only a 330-Bangalow [01:37:36 --> 01:37:39] data center, but maybe 10, 20-Bangalow data centers [01:37:39 --> 01:37:41] because there's still a cumulative impact. [01:37:41 --> 01:37:43] So when we're talking about data centers, [01:37:43 --> 01:37:47] they are different sizes, different capacities, [01:37:47 --> 01:37:49] different technologies, maybe energy intense, [01:37:49 --> 01:37:52] maybe water intense, or a combination of two. [01:37:52 --> 01:37:56] So we're not coming up with answers today. [01:37:56 --> 01:37:58] This is about what does this committee want to prioritize [01:37:58 --> 01:37:59] in our conversation. [01:38:00 --> 01:38:02] And then we have a plan, we have a lot of knowledge [01:38:02 --> 01:38:04] in this room, maybe you want to bring in [01:38:04 --> 01:38:06] the planning commission, that's the one I've already [01:38:06 --> 01:38:09] reached out to about having, you know, [01:38:09 --> 01:38:10] be one of our first presenters [01:38:10 --> 01:38:12] what is our general plan in late season? [01:38:12 --> 01:38:14] So, I'm sorry, I'll pass it on. [01:38:14 --> 01:38:17] Yeah, I was so curious to have a presentation from [01:38:17 --> 01:38:20] the county planning staff in mind. [01:38:20 --> 01:38:24] What is the best science about how that's decided? [01:38:24 --> 01:38:28] Yeah, so, I don't know what to write. [01:38:28 --> 01:38:30] Stry, is it Stry? [01:38:30 --> 01:38:31] You were a Stry? [01:38:31 --> 01:38:32] Okay. [01:38:32 --> 01:38:33] How was the school teacher? [01:38:33 --> 01:38:35] You went on your school teacher, [01:38:35 --> 01:38:36] we got a volunteer here. [01:38:36 --> 01:38:38] So, I think, again. [01:38:38 --> 01:38:40] What is the list of under all of these? [01:38:40 --> 01:38:41] Is that all right? [01:38:41 --> 01:38:44] What's the list of we have, you know, [01:38:44 --> 01:38:46] Mr. Commander said about pretty, [01:38:46 --> 01:38:49] the fine commission as a speaker. [01:38:49 --> 01:38:52] I think there's a general zoning. [01:38:52 --> 01:38:55] I'm sorry, I think there's very, very fine. [01:38:55 --> 01:38:58] It's probably quite a list of subject matter experts [01:38:58 --> 01:39:01] that we would want to invite into the participate [01:39:01 --> 01:39:03] and provide us with creation. [01:39:03 --> 01:39:07] So we would arrive at the right question and assessment. [01:39:07 --> 01:39:17] I think on water, power, environment, land use, all those things that we're going to be covering, [01:39:17 --> 01:39:26] the most have these people as well as for developing a plan on the committee level. [01:39:26 --> 01:39:34] It will be useful possibly for a use of time to consider subcommittees on those subjects. [01:39:34 --> 01:39:41] So the new subcommittee goes on and does their own work, does their research, brings it back to this committee to report. [01:39:41 --> 01:39:47] So we're using the best use of time as we can. [01:39:47 --> 01:39:50] I also have a few things I can't do. [01:39:50 --> 01:39:55] Yeah, you're in city planning so who's that going to be? [01:39:55 --> 01:40:04] Yeah, well, I want to be more of a, actually having a playing staff from the county planning [01:40:04 --> 01:40:09] division to speak regarding the rezoning and that was derived. [01:40:09 --> 01:40:13] The general plan where we're being asked to look at making changes to that agreement, [01:40:13 --> 01:40:19] you understand what's there right now, and regarding there's a little process with [01:40:19 --> 01:40:25] the IED to connect to the grid and be beneficial for the community to have that [01:40:25 --> 01:40:29] from just to tell you the story about mosses. [01:40:29 --> 01:40:33] We have a workshop somewhere months ago, [01:40:33 --> 01:40:37] maybe I'll invite the speakers and also the wire use [01:40:37 --> 01:40:41] of the social media speakers like that if they can. [01:40:41 --> 01:40:44] Thank you. [01:40:44 --> 01:40:46] Thank you. [01:40:46 --> 01:40:51] I would say safety. [01:40:51 --> 01:41:18] Maybe having the private department come. [01:41:18 --> 01:41:25] So I would really recommend somebody coming in to be a subject matter expert on SQL and [01:41:25 --> 01:41:28] explaining what that process is and how that is done. [01:41:28 --> 01:41:29] Okay. [01:41:29 --> 01:41:35] Yeah, so part of this is everyone can get out their wish list and the public can see our [01:41:35 --> 01:41:45] wish list or kind of what we're envisioning to get out. [01:41:45 --> 01:41:50] One of the questions from the audience was asking about whether or not data centers [01:41:50 --> 01:41:53] or benefit, public benefit. [01:41:53 --> 01:41:56] And I think it might be worthwhile to have [01:41:56 --> 01:41:59] economic analysis of a data center [01:41:59 --> 01:42:01] and what it produces, what it brings to the community, [01:42:01 --> 01:42:02] what it costs to be here. [01:42:02 --> 01:42:04] Tax expert. [01:42:04 --> 01:42:06] Tax expert too. [01:42:06 --> 01:42:08] There's a lot of taxes on the GPUs too. [01:42:08 --> 01:42:10] Yeah, I mean the whole payment. [01:42:10 --> 01:42:12] Taxes cost, what is it, [01:42:12 --> 01:42:15] what are the cost benefit analysis? [01:42:15 --> 01:42:19] And so that would be worthwhile. [01:42:19 --> 01:42:23] Would that be the same one that the county did? [01:42:23 --> 01:42:23] Yes. [01:42:31 --> 01:42:34] Definitely seek other experts in the same area. [01:42:43 --> 01:42:46] I did have this one quick question. [01:42:46 --> 01:42:47] This is what we're seeing. [01:42:47 --> 01:42:47] Oh no. [01:42:47 --> 01:42:49] You're right. [01:42:49 --> 01:42:52] So these are topics in which we [01:42:52 --> 01:42:53] would like our topic on end. [01:42:53 --> 01:42:55] I know. [01:42:55 --> 01:42:59] But it was also mentioned establishing [01:42:59 --> 01:43:09] are these topics that we would like to dig into as subcommittees as well or just speaking topics? [01:43:09 --> 01:43:11] I mean I need that. [01:43:11 --> 01:43:13] I mean for me it's like some body. [01:43:13 --> 01:43:17] So the way I see it as subcommittees might be like a lot. [01:43:17 --> 01:43:23] I'm so ready to hear all together with them. [01:43:23 --> 01:43:25] Well I think you can speak. [01:43:25 --> 01:43:27] Yeah. [01:43:27 --> 01:43:29] One another for the next. [01:43:29 --> 01:43:33] I was going to keep this to kind of just like a minute. [01:43:33 --> 01:43:36] I think where they've made it, I think they're kicked from the... [01:43:36 --> 01:43:37] I mean... [01:43:37 --> 01:43:40] I saw them in the screen a little bit earlier. [01:43:40 --> 01:43:42] The environmental impacts? [01:43:42 --> 01:43:46] Yeah, I mean environmental standards on air emissions, the air districts. [01:43:46 --> 01:43:53] You can have car permit and take the California regulations on data centers hard. [01:43:53 --> 01:43:56] I know the county has some EJ goals. [01:43:56 --> 01:44:06] Maybe we can remember what those are. [01:44:06 --> 01:44:08] I'm not sure if you're so afraid, [01:44:08 --> 01:44:10] but I just want to answer that maybe I really [01:44:10 --> 01:44:14] get interested in finding out what the impacts of having [01:44:14 --> 01:44:17] a water offensive industry would be. [01:44:17 --> 01:44:21] What the impacts could possibly be, [01:44:21 --> 01:44:23] but bringing more of this kind of like [01:44:23 --> 01:44:28] a defensive industry as has been happening in other places. [01:44:28 --> 01:44:32] What that group would look like on the social scene. [01:44:32 --> 01:44:33] You just want to make sure that we have [01:44:33 --> 01:44:36] that kind of fight through the environmental thing. [01:44:36 --> 01:45:00] I just said it's a real risk assessment review on it. [01:45:00 --> 01:45:01] A real one. [01:45:01 --> 01:45:03] they're like, I don't know, they're like, health mist? [01:45:03 --> 01:45:07] Well, just in general, a risk assessment in general. [01:45:07 --> 01:45:09] I just, that would be part, [01:45:09 --> 01:45:11] the health risk would be part of it. [01:45:11 --> 01:45:13] And it's not two or three major stories [01:45:13 --> 01:45:18] of 50, 50, 100, or more. [01:45:18 --> 01:45:21] And it talks about, and also, [01:45:21 --> 01:45:25] Mr. Mazanov just said something about the self-seek. [01:45:25 --> 01:45:28] Well, then the cumulative impacts [01:45:28 --> 01:45:30] that this thing is made to [01:45:30 --> 01:45:33] with everything you're doing here. [01:45:33 --> 01:45:35] And it's also, well, as I'm your respect, [01:45:35 --> 01:45:36] I did like Mr. Tyson speak, [01:45:36 --> 01:45:48] Just real quick, I would recommend the committee doing a SWOT analysis per topic because that [01:45:48 --> 01:45:51] way it is one cohesive document. [01:45:51 --> 01:46:00] A SWOT analysis is when you take energy, you look at the strengths, you look at the weaknesses, [01:46:00 --> 01:46:05] you look at the opportunities and you look at the threats of each component. [01:46:05 --> 01:46:12] And that way you're putting a clear picture together, everything is judged the same, or [01:46:12 --> 01:46:13] fact-finding is the same. [01:46:13 --> 01:46:18] You're looking at all of those components for each industry, because there are going [01:46:18 --> 01:46:20] to be strengths for having this. [01:46:20 --> 01:46:23] There's going to be weaknesses, there's going to be opportunities, and there's going [01:46:23 --> 01:46:24] to be threats. [01:46:24 --> 01:46:29] But at least when you put the final document together, it's cohesive. [01:46:29 --> 01:46:31] And it reads the same as one author. [01:46:31 --> 01:46:45] I will speak to the streets and the media but then I will allow just to end the doubt. [01:46:45 --> 01:46:50] We can do a lot of research on this for months. [01:46:50 --> 01:46:53] There's a lot of information we've gathered. [01:46:53 --> 01:46:56] I would like to know who we present that information to. [01:46:56 --> 01:46:59] Research that we've done information that's been gathered. [01:46:59 --> 01:47:04] We need a court person to be able to submit that. [01:47:04 --> 01:47:10] the chair. Yeah, so we discussed informational items. We'll show you where to put this information [01:47:10 --> 01:47:19] as a, like, through, like, a dedicated, kind of like a main email, like a system. It's [01:47:19 --> 01:47:23] important that we get input because it really is. And there's a lot of information we [01:47:23 --> 01:47:27] can. So I think we can do that. Thank you. Okay, so now I'm going to just regroup [01:47:27 --> 01:47:34] us back just to complete. So another, keep the meditation plan, if they can only [01:47:34 --> 01:47:36] how many have any key dedication plans or policies [01:47:36 --> 01:47:38] on communication? [01:47:44 --> 01:47:47] I wanted to also see if we can reflect [01:47:47 --> 01:47:51] like the presentation, but I'll be helping people. [01:47:51 --> 01:47:53] To kind of get everyone in the same plane [01:47:53 --> 01:47:58] to concerns of knowledge as it pertains to like, [01:47:58 --> 01:48:00] what does it look like currently [01:48:00 --> 01:48:03] for certain percentage of asthma people in the county? [01:48:03 --> 01:48:05] Like just a little bit, we're all up to the things [01:48:05 --> 01:48:09] of what are the current health conditions of the care [01:48:09 --> 01:48:10] center in Sierra Valley? [01:48:10 --> 01:48:14] As we're not talking about the environmental impacts, [01:48:14 --> 01:48:15] we also need to make sure that we understand [01:48:15 --> 01:48:19] what we're at right now. [01:48:19 --> 01:48:22] I think what we need to do now is the nexus [01:48:22 --> 01:48:25] data center is airing that. [01:48:25 --> 01:48:28] We can get that data so that they can now [01:48:28 --> 01:48:31] develop what it's going to be with the air. [01:48:31 --> 01:48:35] Now we know the questions that are out there. [01:48:35 --> 01:48:38] I think they're going to be in nexus. [01:48:38 --> 01:48:40] I think that's what's up. [01:48:40 --> 01:48:41] So we're not around. [01:48:41 --> 01:48:45] Another thing to add is bringing in, [01:48:45 --> 01:48:47] let's see if we can get the board of supervisors [01:48:47 --> 01:48:48] for Loudoun County. [01:48:48 --> 01:48:51] Cities that have data centers, [01:48:51 --> 01:48:53] what are their, is that, [01:48:53 --> 01:48:56] what are their grievances? [01:48:56 --> 01:49:00] How about someone that actually built it? [01:49:00 --> 01:49:02] Something that's also missing on this board [01:49:02 --> 01:49:07] is labor, you know, [01:49:07 --> 01:49:13] standards for building labor around the... [01:49:13 --> 01:49:19] What did you want? Codes? [01:49:19 --> 01:49:28] Oh, I just would imagine, I think Mr. Andrews was not here. [01:49:28 --> 01:49:34] Because actually you could have questions around just, I don't know, labor and ordinances, [01:49:34 --> 01:49:38] but I mean, similar to the Lincoln plan, so we've got these items in scattered. [01:49:38 --> 01:49:40] There was a laborer's? [01:49:40 --> 01:49:45] Oh, yes, the shops, sorry. [01:49:45 --> 01:49:49] I'd like to hear from a new data expert. [01:49:49 --> 01:49:49] Yes. [01:49:49 --> 01:49:55] Someone that has been successful in developing these things. [01:49:55 --> 01:50:01] I mean, I want to listen to somebody that [01:50:01 --> 01:50:04] doesn't know what they're talking about. [01:50:04 --> 01:50:12] So I don't know where you can find one. [01:50:12 --> 01:50:14] I ID found one. [01:50:14 --> 01:50:17] So I can really tell you. [01:50:17 --> 01:50:19] Any time you're going to ask somebody who's up there. [01:50:19 --> 01:50:21] Yeah. [01:50:21 --> 01:50:25] Yeah. [01:50:25 --> 01:50:27] I'm sorry. [01:50:27 --> 01:50:45] Most of my experience is on renewals. I have working knowledge of, you know, got a center of development. I've not done one myself, but honestly very similar to just developing any project. [01:50:45 --> 01:50:50] I mean, most of the things that we've addressed here would actually be in your SQL process. [01:50:50 --> 01:50:54] These are going to be studies and reports that you're going to have to do on it. [01:50:54 --> 01:51:00] And if you're attracting the state, 887 now says that any data center must go through a SQL process. [01:51:00 --> 01:51:08] So I think this list is great and I think we should bring these individuals or find out more information on all of them. [01:51:08 --> 01:51:14] But I think when we start looking at it, you know, now that the state has dictated how this would be done, [01:51:14 --> 01:51:17] these were all being addressed to that process. [01:51:17 --> 01:51:26] I do want to comment, this state did not address SICLA until the issue that we have here in New York. [01:51:26 --> 01:51:31] You know, I'm not getting into that, but I'm just saying it must have been passed. [01:51:31 --> 01:51:37] It took intentionality to make sure that SICLA applies to all data centers. [01:51:37 --> 01:51:37] Yeah. [01:51:40 --> 01:51:45] Some discussion about visiting the data center that I was reminded that we're not a buddy. [01:51:47 --> 01:51:49] I mean there's someone in the area. [01:51:50 --> 01:51:55] Is that something that's, you know, civil rights is because I think you might entertain sitting people with us. [01:51:56 --> 01:51:57] But there are a few. [01:51:58 --> 01:52:00] So I'm just going to share with you guys. [01:52:01 --> 01:52:05] So, rank 7, 56. [01:52:05 --> 01:52:15] So we did get one comment from the two. [01:52:15 --> 01:52:20] So I'm going to even discuss for maybe another five minutes. [01:52:20 --> 01:52:25] And then this is kind of our starting point. [01:52:25 --> 01:52:34] I have spoken to Cynthia that I can happily make the CEO about having the planning to start from there [01:52:34 --> 01:52:37] what is the zone need, where's the specific plan. [01:52:37 --> 01:52:40] So we have a public knowledge within this room [01:52:40 --> 01:52:42] of what our current zone is [01:52:42 --> 01:52:43] and how we get it. [01:52:48 --> 01:52:51] Would noise be in your home? [01:52:51 --> 01:52:52] What are those? [01:52:52 --> 01:52:53] The environment. [01:52:53 --> 01:52:54] Noise. [01:52:54 --> 01:52:55] That's environment. [01:52:55 --> 01:52:57] But I do wish you get really specific. [01:52:57 --> 01:52:59] So this is the starting point, [01:52:59 --> 01:53:02] but I think when we have the plan, [01:53:02 --> 01:53:04] I think it's going to be noise. [01:53:04 --> 01:53:05] Yeah. [01:53:05 --> 01:53:09] Also now, we can look at all of those zones in the United States. [01:53:09 --> 01:53:11] What is their buffer? [01:53:11 --> 01:53:15] So Steve, but I also see where the buffer is on submission. [01:53:15 --> 01:53:23] But what I'm saying is the information is on there. [01:53:23 --> 01:53:23] Oh, yes. [01:53:23 --> 01:53:24] Go ahead. [01:53:24 --> 01:53:28] The Spanish Center can't operate without power and water. [01:53:28 --> 01:53:32] And those are two of my most concerns. [01:53:32 --> 01:53:37] Having an IAMD committed to let us know exactly what's [01:53:37 --> 01:53:39] available, where we are in the federal government, [01:53:39 --> 01:53:42] is cutting our water in January again. [01:53:42 --> 01:53:45] I'm not sure how much you might know that. [01:53:45 --> 01:53:47] But yeah. [01:53:47 --> 01:53:51] So you don't know how much I've heard [01:53:51 --> 01:53:54] many different amounts of water that will be used [01:53:54 --> 01:53:56] and how that will be used. [01:53:56 --> 01:53:59] And those are probably two of our most [01:54:03 --> 01:54:05] precious commodities here in the valley. [01:54:07 --> 01:54:10] You don't know if you can't grow food without water. [01:54:10 --> 01:54:15] and we live in the desert where we need power to form the community. [01:54:15 --> 01:54:30] So I'd like to have somebody at least in the INAB that can tell us what is our situation with the water and power. [01:54:30 --> 01:54:34] Yeah, I can't say this is my idea because I just can't get someone to comment. [01:54:34 --> 01:54:41] But the EPA, both state and federal, I think you mentioned, or someone mentioned, [01:54:41 --> 01:54:50] the policies that dictate other agencies that we can just get represented from both the state and federal agencies. [01:54:50 --> 01:54:51] I think yes. [01:54:51 --> 01:54:52] I'll work with you. [01:54:52 --> 01:54:53] Oh, yes. [01:54:53 --> 01:55:02] I'm sorry. [01:55:02 --> 01:55:03] Thank you. [01:55:03 --> 01:55:04] Just a thought. [01:55:04 --> 01:55:16] And that is, I wonder how realistic it is to believe that we're going to come to a consensus [01:55:16 --> 01:55:19] of any sort on any of these issues. [01:55:19 --> 01:55:35] For me, it's all about the process and how the process worked or didn't work with respect to the proposal that was made initially to the city of New Peru and then to the county of New Peru. [01:55:35 --> 01:55:55] And so if we can accomplish nothing else than sending a message or making a recommendation to the board about setting up a process so that all of these things are meaningfully assessed and mitigation measures are imposed. [01:55:55 --> 01:56:06] But keep in mind, when you get to the end of the SQL process, the agency has the ability [01:56:06 --> 01:56:14] to make findings of overriding consideration if there are environmental impacts that the [01:56:14 --> 01:56:17] study finds will not be mitigated. [01:56:17 --> 01:56:23] So I think SQL provides us a framework. [01:56:23 --> 01:56:26] But hopefully that framework will [01:56:26 --> 01:56:33] use us the data that whoever the decision maker is, [01:56:33 --> 01:56:37] whether it's one of the cities or the county, [01:56:37 --> 01:56:39] can make decisions. [01:56:39 --> 01:56:42] Now, a lot of counties up there, [01:56:42 --> 01:56:45] so I spent some time looking at a lot of the county. [01:56:45 --> 01:56:49] They have huge amounts of information on their website, [01:56:49 --> 01:56:51] on the county website. [01:56:51 --> 01:56:55] The governor of the state of Virginia a week ago [01:56:55 --> 01:56:59] signed an executive order dealing with data centers [01:56:59 --> 01:57:01] and the very concerns. [01:57:01 --> 01:57:03] You read that stuff and it's like they're [01:57:03 --> 01:57:05] an imperial county looking at us. [01:57:05 --> 01:57:10] The thing of it is, in Loudoun County and in Virginia, [01:57:10 --> 01:57:13] they go back to the 90s in terms of development [01:57:13 --> 01:57:15] of data centers. [01:57:15 --> 01:57:22] They have 233 data centers in Loudoun County and one county. [01:57:22 --> 01:57:25] Now they say that's one of the richest counties in the United [01:57:25 --> 01:57:25] States. [01:57:25 --> 01:57:28] They have almost a half a million people. [01:57:28 --> 01:57:31] They talk about the fact that their property taxes have [01:57:31 --> 01:57:33] gone down. [01:57:33 --> 01:57:37] There's been a lot of job creation yet. [01:57:37 --> 01:57:41] After all of that development in 2025, [01:57:41 --> 01:57:43] the Loudoun County Board of Supervisors [01:57:43 --> 01:57:48] put a stop to buy right development of data centers. [01:57:49 --> 01:57:54] And so that speaks, they have some experience with these things. [01:57:55 --> 01:57:57] Now I will also say that the average size [01:57:57 --> 01:58:00] of the data center in Mountain County [01:58:00 --> 01:58:02] is a couple hundred thousand square feet, [01:58:03 --> 01:58:08] which is a couple of costos and 10 costos. [01:58:09 --> 01:58:12] But in any case, [01:58:12 --> 01:58:17] There's a model out there, and Loudoun County [01:58:17 --> 01:58:22] has, in spite of their development, [01:58:22 --> 01:58:24] in spite of you go to their website, [01:58:24 --> 01:58:28] they'll talk about the benefits of the data centers, [01:58:28 --> 01:58:31] 40% of the Loudoun County budget [01:58:31 --> 01:58:34] is directly linked to data centers, [01:58:34 --> 01:58:36] 40% of their budget. [01:58:36 --> 01:58:41] And so that county has relied heavily [01:58:41 --> 01:58:44] on the development of data center yet. [01:58:44 --> 01:58:49] There's no more by right as of 2025. [01:58:49 --> 01:58:52] And they're looking at all of these issues, [01:58:52 --> 01:58:55] except they also have to deal with diesel generators, [01:58:55 --> 01:58:58] which I don't know that it's ever been proposed here. [01:58:58 --> 01:59:05] But in any case, I'm hopeful that if nothing else, [01:59:07 --> 01:59:10] the recommendation you make to the board [01:59:10 --> 01:59:17] will set up a process that is a bullet proof test we can make in terms of how we're going [01:59:17 --> 01:59:24] to look at and analyze data centers. To decide what the impact on the sea is, we can be here [01:59:24 --> 01:59:31] for years talking about how we mitigate potential impact to the sea. They talk about behind the [01:59:31 --> 01:59:38] meter, that isn't something that the IED at this point is considering, and I don't [01:59:38 --> 01:59:45] know that it's viable, at least with respect to the size of the data standard we're talking [01:59:45 --> 01:59:55] about. A J-thriller power plant is 49 megawatts. Any 330 megawatts. So anyway, I apologize, [01:59:55 --> 02:00:05] talk too much. With respect to where we go, I'm wondering if Susan didn't hit upon something [02:00:05 --> 02:00:18] that might provide some structure in terms of a committee of this board to convene and [02:00:18 --> 02:00:24] kind of organize it because we can brainstorm into the calisthenics. [02:00:24 --> 02:00:29] I mean this is a huge structure and there's a lot of good idea and a lot of discussion [02:00:29 --> 02:00:36] to be had but I'm wondering if sometimes smaller might be more efficient in terms of getting the ball rolling. [02:00:36 --> 02:00:49] So I'm really thinking that a little bit on this and thoughts. [02:00:49 --> 02:00:57] We did have an opportunity to walk in Loudoun County and just ask people on the street what [02:00:57 --> 02:00:58] their feelings were. [02:00:58 --> 02:01:07] And it was very blossy because like one girl, she was a jogger and she had her earphones [02:01:07 --> 02:01:08] on at about 30. [02:01:08 --> 02:01:11] And I said, do you feel safe here? [02:01:11 --> 02:01:15] And she goes, you look at me pretty weird and says, [02:01:15 --> 02:01:16] what's wrong with you? [02:01:16 --> 02:01:18] I said, what was the Davis Center right there [02:01:18 --> 02:01:19] in your jogging right here? [02:01:19 --> 02:01:21] How do you feel about her? [02:01:21 --> 02:01:23] And she goes, listen, I grew up with it. [02:01:23 --> 02:01:26] So I think to Dennis's point, [02:01:26 --> 02:01:29] they've been there for 30 years. [02:01:29 --> 02:01:33] And that's a corridor that feeds right into Washington, [02:01:33 --> 02:01:34] DC. [02:01:34 --> 02:01:38] So what you have is a real need [02:01:38 --> 02:01:41] in that area four data centers. [02:01:41 --> 02:01:43] But it's funny because I looked at what, [02:01:43 --> 02:01:47] when I saw it, it was like 199 data centers [02:01:47 --> 02:01:49] and then it got a big hits more. [02:01:49 --> 02:01:52] There were building, there was a lot of building going on, [02:01:52 --> 02:01:55] but the average size was much smaller. [02:01:55 --> 02:01:59] There were 50 megawatts, there was 70 megawatts. [02:01:59 --> 02:02:02] There was 100, there were, you know, [02:02:02 --> 02:02:05] so I think the older ones were less megawatts, [02:02:05 --> 02:02:08] less problemless, whatever. [02:02:08 --> 02:02:11] And I think you hit a point. [02:02:11 --> 02:02:15] If, for example, if we look at committees, [02:02:15 --> 02:02:20] and we said, okay, in week three or whatever, [02:02:20 --> 02:02:23] we want IID to come in and talk to us, [02:02:23 --> 02:02:26] and we have a committee that could bring that about. [02:02:26 --> 02:02:28] I know the committee wants to talk about labor [02:02:28 --> 02:02:32] when someone else can bring something in. [02:02:32 --> 02:02:36] I think there's value to the idea of having committees [02:02:36 --> 02:02:40] and say hey listen, this interests me like a, [02:02:40 --> 02:02:43] Jeff wants to be on the environmental department [02:02:43 --> 02:02:47] or whatever, you know I think we could get a committee [02:02:47 --> 02:02:50] and then have a speaker to speak to the issue [02:02:50 --> 02:02:51] that we're thinking about. [02:02:51 --> 02:02:54] And I don't know how that would work, [02:02:54 --> 02:02:57] but it seems like it would break it down [02:02:57 --> 02:03:00] to where we could at least have a better function [02:03:00 --> 02:03:04] to improve, instead of having a nine to nine vote [02:03:04 --> 02:03:07] on something or six to eight votes. [02:03:07 --> 02:03:09] You know, I think we should present [02:03:09 --> 02:03:12] and let everybody hear what we're learning. [02:03:12 --> 02:03:16] I would agree, creating such committees anyway [02:03:16 --> 02:03:19] was mentioned would be too much for it. [02:03:19 --> 02:03:21] Well, I think if you're willing to join one, [02:03:21 --> 02:03:28] then we have extra time to do it. [02:03:28 --> 02:03:33] I agree with that, but I also agree [02:03:33 --> 02:03:37] there's a difference between a hyper-stil AI data center [02:03:37 --> 02:03:40] in a data center and what you're talking about, [02:03:40 --> 02:03:42] that's only 59 watts. [02:03:42 --> 02:03:46] So that might be something that this community [02:03:46 --> 02:03:54] has to address as well. [02:03:54 --> 02:03:56] No, go ahead, David. [02:03:56 --> 02:03:57] Maybe just add one other thing, [02:03:57 --> 02:03:59] because you're talking about the different sizes [02:03:59 --> 02:04:00] of the data centers, [02:04:00 --> 02:04:04] as like maybe just kind of either sort of subject matter [02:04:04 --> 02:04:07] or like research, just like one of the different types [02:04:07 --> 02:04:10] of data centers and the typical sizes of it. [02:04:10 --> 02:04:14] But I think we all see in the news one gay data center. [02:04:14 --> 02:04:18] I think what we may find here is just due to the limitations, [02:04:18 --> 02:04:23] either environmental limitations, water, tower, et cetera, [02:04:23 --> 02:04:26] that you're not going to see the massive data centers [02:04:26 --> 02:04:29] like you're seeing in Texas, just [02:04:29 --> 02:04:32] because it's a different environment. [02:04:32 --> 02:04:34] And so I think having an understanding [02:04:34 --> 02:04:37] of the different types of data centers, [02:04:37 --> 02:04:40] Or are you understanding that different data centers [02:04:40 --> 02:04:42] do different uses? [02:04:42 --> 02:04:45] We have some for training, we have some for inferences, [02:04:45 --> 02:04:47] or something I could do with it. [02:04:47 --> 02:04:49] But so there's different ones, like, okay, [02:04:49 --> 02:04:50] how would those be coming in here? [02:04:50 --> 02:04:53] So I think it would be helpful to understand [02:04:53 --> 02:04:58] the comparison of the different sizes [02:04:58 --> 02:05:00] and the different types of data centers. [02:05:00 --> 02:05:04] I agree 100% because the public has been told [02:05:04 --> 02:05:08] that an AI data center is the same thing as data center. [02:05:08 --> 02:05:15] I'm just going to make this last time because I know that we're over the initial 30 minutes, [02:05:15 --> 02:05:19] but I feel like we're jumping ahead because we're already talking about downsizing data [02:05:19 --> 02:05:21] savings and we haven't even addressed it. [02:05:21 --> 02:05:23] We haven't had enough water for the industry. [02:05:23 --> 02:05:24] I'm just saying you're downstocking. [02:05:24 --> 02:05:25] I'm just saying that. [02:05:25 --> 02:05:29] No, I know, but I'm just saying like it's different already from the image that I'm [02:05:29 --> 02:05:32] talking about smaller data savings and we're like, well, I'm just wanting to know [02:05:32 --> 02:05:36] what the in fact long term is going to be on the Colorado River. [02:05:36 --> 02:05:43] We're just having historical cuts like so I just want to make sure we don't jump the gun start talking about working from a specific industry [02:05:43 --> 02:05:46] Backwards, I just want to make sure that we're covering all issues [02:05:47 --> 02:05:50] We might be talking about this energy in different scales [02:05:50 --> 02:05:56] Without even realizing we can have a large support in the long term because that's also another one of my concerns like [02:05:57 --> 02:06:00] We can support them today. What does it look like? [02:06:01 --> 02:06:05] 15 years from now 30 years from now is this deal going to be even more cuts to the Colorado? [02:06:05 --> 02:06:08] I just want to ask you first. [02:06:08 --> 02:06:24] On a similar note too, questions that I have also with smaller data centers or they're not smaller data centers because like you could a 20 megawatt data centers about the size of Target. [02:06:24 --> 02:06:28] It can be about the energy use of about 400 houses. [02:06:28 --> 02:06:38] So if we have that multiplied that can really impact that could take place in our county, like is that something also like having the IED come like during their current. [02:06:38 --> 02:06:40] your current tariff. [02:06:41 --> 02:06:44] I believe they're cut off almost 20 megawatts. [02:06:44 --> 02:06:49] So I mean, have imagined many 20 megawatts. [02:06:49 --> 02:06:51] So I think it's good for us to know the policies [02:06:51 --> 02:06:54] currently in place and how that fits into [02:06:54 --> 02:06:57] this bigger piece of data centers as well. [02:06:57 --> 02:07:00] I hope to also chime in by comment. [02:07:00 --> 02:07:02] So to kind of wrap up our work plan session [02:07:02 --> 02:07:04] for someone I think all of us in the committee [02:07:04 --> 02:07:06] for contributing to the conversation, [02:07:06 --> 02:07:08] but we do have one public comment. [02:07:08 --> 02:07:10] you still would like to be public comment then? [02:07:10 --> 02:07:13] No, you're good, okay, some said, thank you. [02:07:15 --> 02:07:20] So, yes, so this is just for discussion. [02:07:20 --> 02:07:23] I will take that up, it'll be a shared document [02:07:23 --> 02:07:25] of all of this with the public as well. [02:07:25 --> 02:07:30] And I do appreciate Dennis' your comment. [02:07:31 --> 02:07:33] I do think I would like to refine this down [02:07:33 --> 02:07:36] to something like Loud and County, [02:07:36 --> 02:07:39] very clear, directed, very clear guidance [02:07:39 --> 02:07:42] and we have so many other state councils here [02:07:42 --> 02:07:44] and you are also grappling with data centers. [02:07:44 --> 02:07:46] The data centers happen in an unincorporated [02:07:46 --> 02:07:47] parallel family, it usually happens [02:07:47 --> 02:07:49] in the Yellowstone Trail or in Brawley. [02:07:49 --> 02:07:53] So it'd be great to have a plan there. [02:07:53 --> 02:07:56] Okay, so we don't have public comment then [02:07:56 --> 02:07:59] for our work plan development. [02:07:59 --> 02:08:01] So I'll move on to information. [02:08:01 --> 02:08:01] Oh, sorry. [02:08:01 --> 02:08:02] Yeah, go ahead. [02:08:02 --> 02:08:07] So the next thing that I do, [02:08:07 --> 02:08:13] the community or the community that I agree to [02:08:13 --> 02:08:20] and for with, I think you talked about having some presenters to come and look before us. [02:08:20 --> 02:08:23] So that would be the goal of that document. [02:08:23 --> 02:08:29] Um, I was, yeah, I thought the goal, yeah, my intent was the goal of the document could be somewhat of a guiding document [02:08:29 --> 02:08:33] since like definitely Imperial County planning and development [02:08:33 --> 02:08:37] and their staff will be the first that we start having conversations with. [02:08:37 --> 02:08:40] That will also be bringing back the conversation [02:08:40 --> 02:08:43] if we want committees of some sort. [02:08:43 --> 02:08:44] That was also coming out of today. [02:08:44 --> 02:08:47] We'll be brought up next time. [02:08:47 --> 02:08:51] As well as putting forward the, I don't know, [02:08:51 --> 02:08:54] a request to the IIDs departments. [02:08:54 --> 02:08:57] That would be the one to address the policies. [02:09:00 --> 02:09:02] But yes, did I answer your question? [02:09:02 --> 02:09:02] Yes, I did. [02:09:02 --> 02:09:04] Okay, great, I wanted to make sure. [02:09:04 --> 02:09:05] Okay. [02:09:05 --> 02:09:07] Any other questions, thoughts? [02:09:07 --> 02:09:08] so I'm gonna move along with anyone. [02:09:08 --> 02:09:12] Okay, so we're gonna move on to informational items. [02:09:12 --> 02:09:14] Our first informational item is the [02:09:14 --> 02:09:16] Data Center Video Website. [02:09:16 --> 02:09:17] So, yeah. [02:09:30 --> 02:09:33] I met with Chair Christian last week [02:09:33 --> 02:09:35] and we did mention to her that other advisory committees [02:09:35 --> 02:09:39] have a website to have a specific place [02:09:39 --> 02:09:41] where to put your genitals, the minutes [02:09:41 --> 02:09:42] and the audios of the CD. [02:09:42 --> 02:09:46] I was able to create it, it's a rough draft. [02:09:46 --> 02:09:49] I still wanna make it pretty and look nice and everything, [02:09:49 --> 02:09:52] but it's a section where you will find [02:09:52 --> 02:09:55] all of the information about this data center. [02:09:55 --> 02:09:57] Committee, advisory committee, [02:09:57 --> 02:09:59] the question that has been coming up is how do we get [02:09:59 --> 02:10:02] a hold of you guys, how do we provide that information? [02:10:02 --> 02:10:06] I will be working with CEO's office at Yilpis [02:10:06 --> 02:10:08] to do a link within that website [02:10:08 --> 02:10:12] where you will be able to click submit your name, [02:10:12 --> 02:10:17] your comments and any attachments that you may have that will go either directly to me [02:10:17 --> 02:10:22] and or chair and then that way that communication is open with the committee. [02:10:22 --> 02:10:28] That is something that Miss Cushion and I were working on last weekend talking about it. [02:10:28 --> 02:10:35] Unfortunately I wasn't able to publish by Friday so our agenda was still posted on our Granicus website. [02:10:35 --> 02:10:41] I just collaborate with my advisory committee and Granicus because that's where I can post my video [02:10:41 --> 02:10:43] I think this is a half time for me, Lainty. [02:10:43 --> 02:10:46] I've been having some issues with posting, [02:10:46 --> 02:10:48] but we were able to get the one from last week [02:10:48 --> 02:10:50] posted and going, so I just wanted to show you [02:10:50 --> 02:11:00] a rough draft of what the website would look like. [02:11:00 --> 02:11:02] So just here, it's the name. [02:11:02 --> 02:11:04] You have the top counting information. [02:11:04 --> 02:11:08] If you keep on going, you will see meetings. [02:11:08 --> 02:11:10] This is something that may be changing [02:11:10 --> 02:11:12] as we move forward with the location [02:11:12 --> 02:11:17] of the committee meetings. [02:11:17 --> 02:11:19] We will add a map on the location [02:11:19 --> 02:11:21] once we know where we're going. [02:11:21 --> 02:11:23] So that will be updated by me. [02:11:23 --> 02:11:25] Once we have finalized the bylaws, [02:11:25 --> 02:11:29] they will be attached to the bylaws section. [02:11:29 --> 02:11:31] Then I have the committee members. [02:11:31 --> 02:11:35] Everyone will know who is part of the committee. [02:11:35 --> 02:11:37] And as you keep scrolling down, [02:11:37 --> 02:11:42] you will find the posting of agenda, minutes, and audio. [02:11:42 --> 02:11:47] If you click on it, you'll be able to find the back of material that was there. [02:11:47 --> 02:11:54] You do have a printer friendly view here for this meeting. [02:11:54 --> 02:12:00] We included the minutes that were approved by the committee earlier today. [02:12:00 --> 02:12:08] I'm sorry. And then the last thing I wanted to show you was the audio skip mail. [02:12:08 --> 02:12:14] And then I'll show you where you can locate the committee website. [02:12:14 --> 02:12:20] If you go into the county's webpage, you'll go into departments, clerk of the board, [02:12:20 --> 02:12:27] and then if you scroll down, you'll find a section that says boards and committees. [02:12:27 --> 02:12:30] And you will find the day center advisory committee. [02:12:30 --> 02:12:34] Again, it's the same age we're viewing right now. [02:12:34 --> 02:12:39] When you try to listen to the audio, it will take you to the Grand Lucas Imperial View. [02:12:39 --> 02:12:45] If we're working with Grandi-Cas, it does take a little bit of weeks before they can give us our own tab. [02:12:45 --> 02:12:58] If you guys see here, we have our Hebrew Community Advisory, our Akatiya Advisory, and our Veterans Advisory Councils here. [02:12:58 --> 02:13:03] But as of now, right now, you will see the audio right here in this area. [02:13:03 --> 02:13:07] Eventually it's going to have its own tab for it's as data center. [02:13:07 --> 02:13:19] you guys will be able to see all the meetings and audios from it. [02:13:19 --> 02:13:35] And questions is only recorded. [02:13:35 --> 02:13:39] I don't have the ability to do a live stream outside of my chamber. [02:13:39 --> 02:13:46] So at this time, I would say that we're doing a visual and audio recording, [02:13:46 --> 02:13:48] and then it's posted after. [02:13:48 --> 02:13:55] And also another question, can we add the bylaws to the website so they're easily [02:13:55 --> 02:13:56] available? [02:13:56 --> 02:13:57] OK, let's go to the back. [02:13:57 --> 02:14:02] I just wanted to make sure that I added the... [02:14:02 --> 02:14:05] Okay, that sounds good. [02:14:05 --> 02:14:08] Any more questions or concerns about the website? [02:14:08 --> 02:14:11] We have one public comment on websites. [02:14:11 --> 02:14:13] Just really quick. [02:14:13 --> 02:14:14] I'm pretty much answered it. [02:14:14 --> 02:14:15] Thank you, Mr. Dean. [02:14:15 --> 02:14:16] I appreciate that. [02:14:16 --> 02:14:20] Because I just wanted to make it really clear that there is a website, right, [02:14:20 --> 02:14:25] that says a working guide to the data center advisory committee's charge. [02:14:25 --> 02:14:26] Right? [02:14:26 --> 02:14:28] I'm just wondering who put that together because there is no author on it. [02:14:28 --> 02:14:34] there's no author on it. It's pretty extensive. It has a bio on all you guys. There's a whole [02:14:34 --> 02:14:39] segment on me. I mean it's crazy. Everything I've ever said publicly. I mean it goes, it's [02:14:39 --> 02:14:44] very very extensive and I'm just wondering if anybody here made it, are they connected [02:14:44 --> 02:14:50] to it? You know because it really, it's pushing, it's very biased. It's pushing, [02:14:50 --> 02:14:57] you know, the micro grid data center or a fancy many grab [02:14:57 --> 02:14:59] you know. [02:14:59 --> 02:15:02] So but I'm glad that I'm seeing that because that's what, [02:15:02 --> 02:15:04] you know, it's not the same. [02:15:04 --> 02:15:07] But if you have a chance, you can see this. [02:15:07 --> 02:15:08] It's just very sensitive. [02:15:08 --> 02:15:10] It's like a starting, you know, where [02:15:10 --> 02:15:12] you start all the stuff that leads you down this path, [02:15:12 --> 02:15:14] down a rabbit hole. [02:15:14 --> 02:15:15] making it lead to. [02:15:15 --> 02:15:17] Is it on the county website? [02:15:17 --> 02:15:20] It's not on the county website, but it just looks like it. [02:15:20 --> 02:15:25] It looks like AI made it, but it's very extensive. [02:15:25 --> 02:15:26] And I'm glad you're doing it by hand, [02:15:26 --> 02:15:29] because I found a lot of mistakes with people's names [02:15:29 --> 02:15:31] and the titles and stuff like that in there as well. [02:15:31 --> 02:15:33] Can you just share this? [02:15:33 --> 02:15:34] I mean, share it. [02:15:34 --> 02:15:36] Yeah, I can just share it with the party. [02:15:36 --> 02:15:37] There is no identification of who it is, [02:15:37 --> 02:15:38] but it's very extensive. [02:15:38 --> 02:15:39] So check it out. [02:15:42 --> 02:15:42] See this? [02:15:42 --> 02:15:44] Look at this. [02:15:44 --> 02:15:47] So here watch and then we go to see this framework area. [02:15:47 --> 02:15:49] So we're pushing that microgrid. [02:15:49 --> 02:15:51] You check this out. [02:15:51 --> 02:15:53] You have just the controversy here. [02:15:53 --> 02:15:55] And then you go here, look at the Tyson record. [02:15:55 --> 02:15:56] You know? [02:15:56 --> 02:15:58] I just want to see where it is. [02:15:58 --> 02:15:59] Yeah, that's not a yeah. [02:15:59 --> 02:16:02] So yeah, like nine months, two hundred, two speakers, [02:16:02 --> 02:16:04] one overturned approval. [02:16:04 --> 02:16:06] Well, I mean, it goes on and on. [02:16:06 --> 02:16:07] Are we able to display it? [02:16:07 --> 02:16:07] Huh? [02:16:07 --> 02:16:09] Are we able to display that here? [02:16:09 --> 02:16:12] What if you want to, I can go ahead and show it. [02:16:12 --> 02:16:14] Yeah, I suppose it would be. [02:16:14 --> 02:16:18] I think we can end on the conversation. [02:16:18 --> 02:16:21] I think the role will continue. [02:16:21 --> 02:16:26] Yeah, that's why I thought of that. [02:16:26 --> 02:16:31] It's just, it's very thorough, but it's also, like I said, [02:16:31 --> 02:16:35] it's misleading and puts you down in a certain path, you know? [02:16:35 --> 02:16:36] So. [02:16:36 --> 02:16:40] Thank you for your comment, Jake. [02:16:40 --> 02:16:45] It looks like Cynthia is looking into it. [02:16:45 --> 02:17:06] Yes, okay. Our next section is we'll have an update on the data center moratorium. Thank you. Good evening. [02:17:06 --> 02:17:11] Chair, so many members just a brief update. [02:17:11 --> 02:17:18] Um, as you may all know, in June, the coming adopted a moratorium extended that moratorium in July. [02:17:19 --> 02:17:23] We were sued over that moratorium and the court set it aside. [02:17:23 --> 02:17:28] So we are planning and the notices in the back of materials, a new moratorium that we brought [02:17:28 --> 02:17:32] before the board of supervisors this Tuesday, October 6th. [02:17:32 --> 02:17:35] So you can see that the board will hold public caring [02:17:35 --> 02:17:37] to consider it. [02:17:37 --> 02:17:40] One other issue that will be on that same agenda, [02:17:40 --> 02:17:42] and I'm wondering if you have now the point, [02:17:42 --> 02:17:45] confusion in compliance with the court order, [02:17:45 --> 02:17:48] we have another ordinance that sets aside [02:17:48 --> 02:17:50] the two previous ones. [02:17:50 --> 02:17:52] So you will see a vote for the board [02:17:52 --> 02:17:55] to repeal the prior board order. [02:17:55 --> 02:17:57] And that's a vote, not so much on the substance, [02:17:57 --> 02:17:59] any compliance of the court order. [02:17:59 --> 02:18:01] And then you'll have a public hearing [02:18:01 --> 02:18:05] where the actual auditory will be discussed. [02:18:05 --> 02:18:06] So that's the current status. [02:18:06 --> 02:18:12] Happy to answer your question. [02:18:12 --> 02:18:14] Is that something as far as for us, [02:18:14 --> 02:18:18] part of that, I mean, to attend that question, [02:18:18 --> 02:18:20] I have an intro. [02:18:20 --> 02:18:21] Or is that just kind of information? [02:18:21 --> 02:18:24] What would that be? [02:18:24 --> 02:18:27] For now, my presentation for now, [02:18:27 --> 02:18:31] I think as individuals, you absolutely can attend, [02:18:31 --> 02:18:33] provided feedback, be mindful that you're now [02:18:33 --> 02:18:37] front of a ground neck body, so there's those restrictions. [02:18:37 --> 02:18:40] But certainly part of the moratorium [02:18:40 --> 02:18:44] is to kind of pause on things while this committee conducts [02:18:44 --> 02:18:45] its work. [02:18:45 --> 02:18:51] So this committee is a big portion of that moratorium. [02:18:51 --> 02:18:55] That's my understanding that the previous moratorium [02:18:55 --> 02:19:03] was stopped because the immediate risk was not [02:19:03 --> 02:19:10] addressed. It looks to me like this is the same type of emergency moratorium that you did before. [02:19:11 --> 02:19:16] So what are the guarantees that this is going to go forward again? [02:19:17 --> 02:19:21] Oh, certainly. So the issue was not so much with the required finding. The government code [02:19:21 --> 02:19:27] section requires a certain finding. It was the evidence put into the moratorium to back up [02:19:27 --> 02:19:33] that finding. And certainly there's a sort of a different legal opinion regarding the deference [02:19:33 --> 02:19:38] the court gives or should give to a legislative body. [02:19:38 --> 02:19:40] Notice that as we put the first moratorium together, [02:19:40 --> 02:19:43] that we were paying very close attention to. [02:19:43 --> 02:19:45] And at that time, we had a secondary lawsuit [02:19:45 --> 02:19:48] that we had to be mindful of as we were dealing [02:19:48 --> 02:19:50] with these two issues. [02:19:50 --> 02:19:53] Certainly, we are taking into consideration [02:19:53 --> 02:19:56] and addressing the court's order and decision [02:19:56 --> 02:19:57] as we put this one together. [02:19:57 --> 02:19:59] So in the notice you see in the packet, [02:19:59 --> 02:20:02] it's very similar to the old notice. [02:20:02 --> 02:20:04] It's the same credit section that we're working under, [02:20:04 --> 02:20:06] just having additional information. [02:20:06 --> 02:20:10] And certainly new facts have occurred since [02:20:10 --> 02:20:12] the previous moratorium. [02:20:12 --> 02:20:16] Certainly the Bureau of Reclamation has issued there [02:20:17 --> 02:20:20] at least two-year decision or a potential new decision, [02:20:20 --> 02:20:23] so that's one piece of evidence, as well as other. [02:20:23 --> 02:20:29] But certainly taking into consideration both the court [02:20:29 --> 02:20:34] order in both cases will be addressed in this smart chart. [02:20:35 --> 02:20:37] So this was approved in the 45 days, [02:20:37 --> 02:20:41] it could be extended to the 10 months? [02:20:41 --> 02:20:44] So the way that code section works is [02:20:44 --> 02:20:47] if you go immediately public hearing, [02:20:47 --> 02:20:49] it goes 45 days and then you can extend it [02:20:49 --> 02:20:52] another 10 months and 15 days [02:20:53 --> 02:20:55] because we are doing the public hearing first this time, [02:20:55 --> 02:20:59] you can extend it out another 22 months. [02:20:59 --> 02:21:00] 15 days? [02:21:00 --> 02:21:01] What was your exact place? [02:21:01 --> 02:21:03] I'm just kidding. [02:21:03 --> 02:21:06] I know what you said. [02:21:06 --> 02:21:09] You need to know the reason why. [02:21:09 --> 02:21:12] You should go to the board to the last meeting. [02:21:12 --> 02:21:15] I'm cautioning you can only speak about it, [02:21:15 --> 02:21:17] because it could be interpreted by someone [02:21:17 --> 02:21:20] who's suspended from here on the one side [02:21:20 --> 02:21:25] of the other issue and to represent facts. [02:21:25 --> 02:21:29] So those sticky wickets you'd be stepping into there [02:21:29 --> 02:21:31] with the blind can say, [02:21:31 --> 02:21:33] because somebody's been identified right away [02:21:33 --> 02:21:35] with your ads and those committed. [02:21:35 --> 02:21:39] Those that want to will take a shot at you. [02:21:39 --> 02:21:40] Take a shot and commit. [02:21:44 --> 02:21:45] It's not that easy. [02:21:45 --> 02:21:46] You wonder if you could say, [02:21:46 --> 02:21:48] I'm just speaking on public [02:21:48 --> 02:21:50] and trying to disqualify the whole idea [02:21:50 --> 02:21:52] with some things that are. [02:22:04 --> 02:22:04] Thank you very much. [02:22:04 --> 02:22:16] one public comment on the board. [02:22:16 --> 02:22:20] Let me see. [02:22:20 --> 02:22:28] I just have a bunch of questions because, oh sorry. I just have a bunch of questions because, you know, what happened last time was [02:22:28 --> 02:22:33] absolute law. So what specific public health and safety threats will the county [02:22:33 --> 02:22:38] investigate during this new war tournament and what evidence must be produced before anyone [02:22:38 --> 02:22:40] anyone recommends lifting it. [02:22:41 --> 02:22:44] Will the county obtain an independent risk assessment [02:22:44 --> 02:22:47] fire of our fire and fire responsibility [02:22:47 --> 02:22:50] to handle battery fires generated by incidents [02:22:50 --> 02:22:52] and hazardous material emergencies [02:22:52 --> 02:22:55] and identify who pays for the necessary staffing, [02:22:55 --> 02:22:56] equipment and training? [02:22:56 --> 02:22:59] And will safety studies examine the entire campus [02:22:59 --> 02:23:02] operating through extreme heat and prolonged power outage [02:23:02 --> 02:23:04] including simultaneous generator operations [02:23:04 --> 02:23:07] and battery emergencies? [02:23:07 --> 02:23:08] I'll skip down a minute. [02:23:08 --> 02:23:11] If a project would depend directly or indirectly [02:23:11 --> 02:23:14] on Colorado River water, what shortage scenarios [02:23:14 --> 02:23:18] will you examine and whose supply would be reduced first [02:23:18 --> 02:23:20] during a shortage? [02:23:20 --> 02:23:23] So it's kind of like, let me have a fair little of words. [02:23:23 --> 02:23:26] But this is where we're at. [02:23:26 --> 02:23:28] I think we need you to end it on this little bit. [02:23:28 --> 02:23:30] I mean, you've got to be okay with it. [02:23:30 --> 02:23:34] And will the county require applicants to identify [02:23:34 --> 02:23:38] of this facility's operators and intent to check [02:23:38 --> 02:23:43] or computing uses, including which AI models, right, [02:23:43 --> 02:23:46] which AI models will train and host [02:23:46 --> 02:23:50] and how will changes and operators or uses be tracked? [02:23:51 --> 02:23:52] I don't know if this comes to a loss, [02:23:52 --> 02:23:54] but then what findings would lead this committee [02:23:54 --> 02:23:56] to recommend prohibition data centers [02:23:56 --> 02:23:59] and is that outcome genuinely included [02:23:59 --> 02:24:02] in a more current work plan or is it being let down? [02:24:02 --> 02:24:05] That was some of my questions. [02:24:05 --> 02:24:11] Thank you. [02:24:11 --> 02:24:12] One more question. [02:24:12 --> 02:24:19] If you have a final question about the court, [02:24:19 --> 02:24:21] is there currently no more authority to the State's [02:24:21 --> 02:24:22] State House? [02:24:22 --> 02:24:26] Are individuals able to apply for a court [02:24:26 --> 02:24:28] to the State's State House? [02:24:28 --> 02:24:29] Yes. [02:24:29 --> 02:24:32] So the exact date was around the 15th, [02:24:32 --> 02:24:34] when the court issued its final judgment. [02:24:34 --> 02:24:37] So currently today, there's no more authority in the [02:24:37 --> 02:24:42] And if the board were to adopt one of the six, it would be happen twice. [02:24:42 --> 02:24:48] Can you, if it happened, can you see to, like, if there is an app window, [02:24:48 --> 02:24:49] so not windows? [02:24:49 --> 02:24:54] To my knowledge, there have been no app window, [02:24:54 --> 02:25:00] and they get the applications that I know where I'll all create, [02:25:00 --> 02:25:04] even the auditorium we put into place. [02:25:04 --> 02:25:17] I understand with other entities there are other applications or requests for review that are separate from those with the county. [02:25:17 --> 02:25:18] Thank you. [02:25:18 --> 02:25:30] Thank you. [02:25:30 --> 02:25:31] This is University of Dallas Center for Retirement. [02:25:31 --> 02:25:32] You know what I'm going to comment on. [02:25:32 --> 02:26:02] So now once I am to see California Dallas Center legislation, we'll have an update on the seven enacted bills that just happened. [02:26:14 --> 02:26:16] We may or may not have time for it. [02:26:16 --> 02:26:18] Oh, I can give us just a second. [02:26:18 --> 02:26:20] We have a hand. [02:26:20 --> 02:26:30] We can work off the end at the end. [02:26:30 --> 02:26:36] If that's what the committee would prefer, I don't think it is need to look at that. [02:26:36 --> 02:26:39] We can just... [02:26:39 --> 02:26:41] We can see it, but it's not... [02:26:41 --> 02:26:43] Just see it, but it's definitely... [02:26:43 --> 02:26:45] Sorry. [02:26:45 --> 02:26:51] I'll just get started. [02:26:51 --> 02:26:52] Okay. [02:26:52 --> 02:26:54] I will get started. [02:26:54 --> 02:26:59] Okay, so California enacted a coordinated package of seven data center bills, [02:26:59 --> 02:27:02] also invented a governor on the same day, which was September 21st, [02:27:02 --> 02:27:06] 2026. So you want to think of these bills in four buckets. [02:27:06 --> 02:27:10] Three, deal with electricity and rates. Two, deal with water [02:27:10 --> 02:27:15] and one reshapes environmental review. So the unifying theme is let data [02:27:15 --> 02:27:19] centers keep growing, but make sure they pay their way on the grid [02:27:19 --> 02:27:23] on water and on the environment rather than shifting costs [02:27:23 --> 02:27:27] on two ordinary-type ratepayers and communities. [02:27:27 --> 02:27:30] So you want to keep in mind that these are framework laws. [02:27:30 --> 02:27:32] Several don't take full effect immediately [02:27:32 --> 02:27:36] to direct agencies, mainly the CPUC and the Energy Commission [02:27:36 --> 02:27:41] to build out rules over the next few years. [02:27:41 --> 02:27:44] So the first one that we have in here, backup, [02:27:44 --> 02:27:48] is SB 886, the Technology Innovation and Rate [02:27:48 --> 02:27:50] Care Protection Act. [02:27:50 --> 02:27:51] This is the flagship. [02:27:51 --> 02:27:55] It tells the CPUC, the California Public Utilities Commission [02:27:55 --> 02:27:58] to build a whole new tariff structure for data systems. [02:27:58 --> 02:28:03] By January 1st, 2028, the poll star of the CPUC's mandate [02:28:04 --> 02:28:07] is to protect other rate payers. [02:28:07 --> 02:28:09] The commission must actively prevent data centers [02:28:09 --> 02:28:12] from creating stranded costs or shipping costs [02:28:12 --> 02:28:14] onto everyone else. [02:28:14 --> 02:28:16] So a few teeth in this Senate bill [02:28:16 --> 02:28:18] that no one's calling out. [02:28:18 --> 02:28:22] applicants have to disclose if they filed for the same project [02:28:22 --> 02:28:24] in other utility territories. [02:28:24 --> 02:28:27] That stops developers from gaining multiple [02:28:27 --> 02:28:30] interconnection cues at once. [02:28:30 --> 02:28:32] Data centers pay for the transmission of grades [02:28:32 --> 02:28:34] they trigger, and any refought is [02:28:34 --> 02:28:38] capital 75% of the net transmission revenue [02:28:38 --> 02:28:40] they actually generate. [02:28:40 --> 02:28:42] So repairs aren't preventing the risk. [02:28:42 --> 02:28:44] And if a data center leaves early [02:28:44 --> 02:28:47] or never ramps up to its promised road, [02:28:47 --> 02:28:50] It pays an early termination fee covering the revenue gap [02:28:50 --> 02:28:52] over a minimum 10 year term. [02:28:52 --> 02:28:56] This new, this applies, oh thank you. [02:28:56 --> 02:28:58] This applies to new transition level interconnections [02:28:58 --> 02:29:01] on or after January 1, 2027. [02:29:03 --> 02:29:04] Thank you. [02:29:04 --> 02:29:08] Okay, so our next bill is AB 2383. [02:29:10 --> 02:29:13] So if Senate Bill 886 sets the vision, [02:29:13 --> 02:29:16] AB 2383 is the machinery. [02:29:16 --> 02:29:19] it fills in the actual tariff requirements. [02:29:19 --> 02:29:22] On the transmission and distribution side, [02:29:22 --> 02:29:25] it makes data centers pay their fair share [02:29:25 --> 02:29:27] of the big society-wide costs [02:29:27 --> 02:29:29] baked into everyone's bill, [02:29:29 --> 02:29:31] while for our mitigation, electrification, [02:29:31 --> 02:29:33] environmental programs. [02:29:33 --> 02:29:38] On the generation side, it requires at least a 10-year [02:29:39 --> 02:29:40] payment mechanism. [02:29:40 --> 02:29:44] So data centers cover the incremental generation costs [02:29:44 --> 02:29:47] the building creates, back, my collateral or prepayment, [02:29:47 --> 02:29:50] a minimum payment floor tied to projected mode [02:29:50 --> 02:29:54] and credit if they build zero emission resources [02:29:54 --> 02:29:57] behind the mirror. [02:29:57 --> 02:30:01] One number to remember, the generation tariff kicks in [02:30:01 --> 02:30:05] at a threshold that CPU sets, CPUC sets, [02:30:05 --> 02:30:08] but that threshold cannot exceed 25 million watts. [02:30:08 --> 02:30:11] So the biggest loads are always captured. [02:30:11 --> 02:30:14] And this isn't just the big investor owned utilities, [02:30:14 --> 02:30:18] Community choice, aggregators and electric service providers [02:30:18 --> 02:30:22] must adopt parallel tariffs by January 1, 2028. [02:30:25 --> 02:30:29] Next bill is the data center water use [02:30:29 --> 02:30:32] of SQUESTERS AB 2469. [02:30:32 --> 02:30:34] So we're shifting from power to water. [02:30:34 --> 02:30:38] AB 2469 works at the local permitting stage. [02:30:38 --> 02:30:41] It's a gate and the bottom line is a city [02:30:41 --> 02:30:44] or a county cannot approve a new [02:30:44 --> 02:30:50] or expanded data center until the applicant clears a set of water conditions. [02:30:50 --> 02:30:54] Those conditions include a water supply assessment and starting January 1st, [02:30:54 --> 02:31:01] 2028, a water scarcity plan laying out what the facility will do at each drought stage. [02:31:01 --> 02:31:06] The applicant also has to disclose projected water use, efficiency measures, [02:31:06 --> 02:31:13] and notably workforce details like job composition and how much of the workforce is local. [02:31:13 --> 02:31:16] Financially, the developer eats the full cost of any water [02:31:16 --> 02:31:19] infrastructure needed to serve the project. [02:31:19 --> 02:31:22] The legislature made that cost-shift provision severable. [02:31:22 --> 02:31:26] So if a court strikes it, the rest survives. [02:31:26 --> 02:31:28] And because water is a statewide concern, [02:31:28 --> 02:31:31] this binds charter cities as well. [02:31:31 --> 02:31:35] They cannot opt out. [02:31:35 --> 02:31:38] So the next bill is AB 2619. [02:31:38 --> 02:31:39] Can we ask some questions? [02:31:39 --> 02:31:40] Yes? [02:31:40 --> 02:31:42] If you need to clarify the legislation, [02:31:42 --> 02:31:43] do you have a question? [02:31:43 --> 02:31:45] I can do my best. [02:31:45 --> 02:31:56] I think that the city or county has a developer providing all of the water and you said the water plan is a water scarcity plan. [02:31:56 --> 02:32:00] Can the city or county still approve them? [02:32:00 --> 02:32:04] Let's start understanding your question. [02:32:04 --> 02:32:10] So say the developer provides them with their water assessment as well as their water scarcity plan. [02:32:10 --> 02:32:15] And let's say it determines that maybe the data center is not. [02:32:15 --> 02:32:18] I'm getting more of a hypothetical. [02:32:18 --> 02:32:21] Is can the county still approve them? [02:32:21 --> 02:32:24] Like this legislation just gives them transparency, [02:32:24 --> 02:32:28] but it doesn't require enforcement to deny all the requirements. [02:32:28 --> 02:32:37] So the city in the county can't approve a newer expanded data center until the applicant clears all of the requirements in this, [02:32:37 --> 02:32:40] the water use disclosures in this bill. [02:32:40 --> 02:32:45] They can't just say, okay, thank you for what you gave. [02:32:45 --> 02:32:46] You were approving it. [02:32:46 --> 02:32:49] They have to actually meet the water conditions [02:32:49 --> 02:32:50] as better established. [02:32:50 --> 02:32:51] Thank you, okay. [02:32:51 --> 02:32:51] Does that answer your question? [02:32:51 --> 02:32:55] I was losing sure, it was more of like a disclosure process [02:32:55 --> 02:33:00] but the discretion still was held by the government body [02:33:01 --> 02:33:03] to determine if they would still allow that. [02:33:03 --> 02:33:08] They can as long as the conditions are met. [02:33:08 --> 02:33:13] If the conditions are not met then the governing agency, [02:33:13 --> 02:33:15] the city or the county cannot approve the new or extended [02:33:15 --> 02:33:17] date center. [02:33:17 --> 02:33:22] Chris, you're going into back January 1st, 2028? [02:33:22 --> 02:33:25] None of these are emergency legislation. [02:33:25 --> 02:33:31] So all of these bills would be effective January 1, 2027. [02:33:31 --> 02:33:42] But there are some that have requirements for rates to be made or established or built in or studies to be concluded by 28. [02:33:42 --> 02:33:45] But all of these will be effective January 1, 2027. [02:33:46 --> 02:33:52] Those conditions that apply January 2028 are the most restrictive conditions. [02:33:52 --> 02:33:53] Yes. [02:33:53 --> 02:34:01] Well those are the, when you hear 2028, that's when, for example, the CPUC has been tasked [02:34:01 --> 02:34:04] with creating something by that date. [02:34:04 --> 02:34:14] Yeah, and they need to, for us as a committee, think about this, we've locked these much [02:34:14 --> 02:34:19] stretches and applied it to the term we would consider, right? [02:34:19 --> 02:34:21] Because eventually it's going to pass. [02:34:21 --> 02:34:26] Well, and I think something to keep in mind is some of the stuff the CPUC actually [02:34:26 --> 02:34:33] doesn't apply because IID is not part of it. So, you know, there are large there and large [02:34:33 --> 02:34:38] low care that they've written doesn't necessarily have to match up with what the state just passed [02:34:38 --> 02:34:48] into law because it's not under that authority. It is convoluted. So I'm curious to see how [02:34:48 --> 02:34:56] it will match up once the CDC writes theirs and how that compares to the IID. Or IID [02:34:56 --> 02:34:59] will come back and try to be by theirs before we touch it. [02:34:59 --> 02:35:02] Just move to Imperial Valley. [02:35:02 --> 02:35:07] You know, I'm all ready for it. [02:35:07 --> 02:35:09] Any other questions? [02:35:09 --> 02:35:10] There's just a few more to go over, [02:35:10 --> 02:35:14] but if there's anything that I've already gone over. [02:35:14 --> 02:35:20] OK, so now we're at AB 2619. [02:35:20 --> 02:35:24] So AB 2469 is the front end gate. [02:35:24 --> 02:35:29] AB 2619 is the ongoing reporting companion. [02:35:29 --> 02:35:32] So first he gives a size taxonomy [02:35:32 --> 02:35:34] that you'll see echoed elsewhere. [02:35:34 --> 02:35:37] Type one or hyperscale is over 10,000 servers [02:35:37 --> 02:35:39] or 25 megawatts. [02:35:39 --> 02:35:41] Type two is two to 25 megawatts [02:35:41 --> 02:35:44] and type three is under two megawatts. [02:35:44 --> 02:35:47] So the compliance hook with respect to this bill [02:35:47 --> 02:35:50] is perjury before applying for business license [02:35:50 --> 02:35:52] and again on the application, [02:35:52 --> 02:35:56] operators must give the water supplier good faith estimates [02:35:56 --> 02:35:59] of their water use under penalty of perjury. [02:35:59 --> 02:36:02] Then at renewal, they report actual water use [02:36:02 --> 02:36:05] from the prior year, including cooling system type, [02:36:05 --> 02:36:10] so the state sees estimate versus reality over time. [02:36:10 --> 02:36:13] And finally, a quieter but important change, [02:36:13 --> 02:36:16] water suppliers planning for unconstrained demand [02:36:16 --> 02:36:20] must now expressly account for data centers. [02:36:20 --> 02:36:23] the data centers can no longer be an invisible mode [02:36:23 --> 02:36:29] in the forecast. [02:36:29 --> 02:36:30] Okay. [02:36:32 --> 02:36:36] SB887 is the CICLA component. [02:36:36 --> 02:36:38] This is the environmental review piece [02:36:38 --> 02:36:39] and it does cut both ways [02:36:39 --> 02:36:42] because it's stricter in one respect [02:36:42 --> 02:36:43] and faster in another. [02:36:43 --> 02:36:46] So we'll talk about the carrot and the stick. [02:36:46 --> 02:36:49] The stick is that data centers are no longer eligible [02:36:49 --> 02:36:51] for CICLA's categorical exemptions. [02:36:51 --> 02:36:53] They cannot skip environmental review [02:36:53 --> 02:36:57] by sliding into an existing exempt category. [02:36:57 --> 02:37:01] The carrot is the qualifying project can get expedited [02:37:01 --> 02:37:03] environmental leadership streamlining, [02:37:03 --> 02:37:06] but only if it meets a very demanding checklist. [02:37:06 --> 02:37:08] So the checklist is stringent. [02:37:08 --> 02:37:12] It includes paying the full interconnection cost upfront, [02:37:12 --> 02:37:15] adding no in-state fossil fuel consumption [02:37:15 --> 02:37:19] and building at least four hours of zero carbon storage. [02:37:19 --> 02:37:23] And the headline requirement is 100% zero carbon electricity [02:37:23 --> 02:37:28] for hourly needs within five years and 75% of that [02:37:28 --> 02:37:29] has to be newly built. [02:37:29 --> 02:37:33] New clean generation, not just credits. [02:37:33 --> 02:37:35] It also requires water efficient cooling [02:37:35 --> 02:37:38] and a binding community benefits agreement. [02:37:38 --> 02:37:40] And the same fast track is extended [02:37:40 --> 02:37:42] to geothermal power plants as well as data centers. [02:37:44 --> 02:37:49] So then the next bill is SB 1168. [02:37:49 --> 02:37:51] And this is the shortest of the seven [02:37:51 --> 02:37:53] but it reinforces the rate fairness theme [02:37:53 --> 02:37:55] from a different angle. [02:37:55 --> 02:37:58] It directs the CPUC to assess rate structures [02:37:58 --> 02:38:00] specifically for data centers. [02:38:00 --> 02:38:04] The key phrase that data centers must pay their share [02:38:04 --> 02:38:06] regardless of whether they interconnect [02:38:06 --> 02:38:09] at the transmission or distribution level [02:38:09 --> 02:38:11] closes a potential gap. [02:38:11 --> 02:38:13] So a data center can't dodge its share [02:38:13 --> 02:38:15] by choosing where it plugs in. [02:38:15 --> 02:38:18] It also ensures that they pay a proportionate share [02:38:18 --> 02:38:22] of a load growth and procurement needed to serve them. [02:38:22 --> 02:38:24] And it's explicit about the goal, [02:38:24 --> 02:38:28] relieve cost pressure on residential rate payers [02:38:28 --> 02:38:31] because it calls out the low income California [02:38:31 --> 02:38:34] alternative rates for energy, care, [02:38:34 --> 02:38:37] and the family electric rate assistant, [02:38:37 --> 02:38:39] fair customers by name. [02:38:47 --> 02:38:52] Our last bill is AB 1577. [02:38:53 --> 02:38:55] And this one is about visibility. [02:38:55 --> 02:38:58] It's giving the state hard data on an industry [02:38:58 --> 02:39:01] that has been to date fairly opaque. [02:39:01 --> 02:39:04] It applies to data centers of 10 megawatts or more. [02:39:04 --> 02:39:07] Operators report facility data when they energize [02:39:07 --> 02:39:09] plus annual operating data. [02:39:09 --> 02:39:11] Load, power usage, effectiveness, [02:39:11 --> 02:39:14] onsite generation fuel and cooling. [02:39:14 --> 02:39:19] Starting with the 2029 integrated energy policy report, [02:39:19 --> 02:39:20] the energy commission holds this [02:39:20 --> 02:39:23] into a formal assessment of data center load trends [02:39:23 --> 02:39:26] and it publishes the data annually [02:39:26 --> 02:39:29] in anonymized, aggregated form. [02:39:29 --> 02:39:31] Separately at the local permit stage, [02:39:31 --> 02:39:34] applicants must disclose expected energy use [02:39:34 --> 02:39:39] and even sound levels to the city or the county. [02:39:39 --> 02:39:41] And importantly, the spill safeguards confidential [02:39:41 --> 02:39:44] proprietary and customer specific data. [02:39:44 --> 02:39:49] So transparency does not come to cost of trade secrets. [02:39:49 --> 02:39:52] So taken together, these seven laws send one message. [02:39:52 --> 02:39:56] California is open for data center investment that on terms that protect [02:39:56 --> 02:40:01] repairs water supplies and host communities the real deals the real [02:40:01 --> 02:40:06] detail can be expected to emerge as the CPUC and Energy Commission might be [02:40:06 --> 02:40:11] implementing rules over the next two or three years. Any additional questions? [02:40:11 --> 02:40:16] Thank you all very much for coming. [02:40:52 --> 02:40:54] I think that's a lot of things. [02:40:54 --> 02:41:03] We'll set the time for this. [02:41:03 --> 02:41:05] Yeah, I'm just going to move. [02:41:08 --> 02:41:10] When I, when all of the... [02:41:10 --> 02:41:24] Oh, we're going to have to change that up. [02:41:24 --> 02:41:26] So, thank you. [02:41:26 --> 02:41:28] Just a quick question. [02:41:28 --> 02:41:33] It's not, it's not going to be... [02:41:33 --> 02:41:36] Oh. [02:41:36 --> 02:41:38] I'm not going to take it. [02:41:38 --> 02:41:40] Okay, go ahead. [02:41:40 --> 02:41:42] Okay, you know, so, the large, [02:41:42 --> 02:41:44] when the large load carousel came out last month [02:41:44 --> 02:41:58] laws were signed it seemed like it creates a bigger puzzle you know because the pieces are there's more pieces now on the table about it and then you know how do they relate right and so how but it's [02:41:58 --> 02:42:04] signed it's also who's gonna enforce something who's gonna make sure that these laws are being [02:42:04 --> 02:42:10] adhered to right and because if not there's gonna be law since there will be [02:42:10 --> 02:42:17] loss is people are looking at the material value. Okay, there's no way out of it. And these laws [02:42:17 --> 02:42:22] that were passed is because of what's happened here last year, okay, the banning has been ripped off. [02:42:22 --> 02:42:29] And the injuries have happened. So anyway, so what's SQL review when these projects receive and who [02:42:29 --> 02:42:37] verifies that these proposal complies with the new laws? Who's going to oversize that? And will [02:42:37 --> 02:42:41] So the community evaluate a prohibition and where an EIR is [02:42:41 --> 02:42:45] compared, ensure meaningful consideration of the no-project [02:42:45 --> 02:42:49] control alternative and feasible alternatives that reduce community [02:42:49 --> 02:42:53] harm. Because that's what everybody wants. Nobody wants to get hurt by this stuff. [02:42:53 --> 02:42:57] It's about public safety. It's not about economic development [02:42:57 --> 02:43:01] for one developer or for a company. [02:43:01 --> 02:43:05] So we'll seek to review [02:43:05 --> 02:43:11] those whether our fire department can handle battery fires, generator incidents, and hazardous [02:43:11 --> 02:43:18] material emergencies while maintaining service to the rest of the community. That's a big [02:43:18 --> 02:43:22] one because moss landing is still burning right now. I don't know if you need to know [02:43:22 --> 02:43:27] that. We're on number two, evacuations. Because where are we all going to go when [02:43:27 --> 02:43:35] we have to evacuate? So we'll just really quickly do a bunch. But how will the new [02:43:35 --> 02:43:38] new water disclosures being incorporated into sequel [02:43:38 --> 02:43:41] analysis of Colorado River shortages, peak subredemand, [02:43:41 --> 02:43:44] a cumulative industrial water consumption, [02:43:44 --> 02:43:47] and who will independently verify that assumption? [02:43:47 --> 02:43:49] You know, it's very complex. [02:43:49 --> 02:43:52] This is not an easy job. [02:43:52 --> 02:43:56] That's why I think that January 1st is probably, you know, [02:43:56 --> 02:44:00] it's too soon of a time to hit. [02:44:00 --> 02:44:02] And, you know, that moratorium needs to get into place [02:44:02 --> 02:44:04] and then maybe be extended for it [02:44:04 --> 02:44:07] because you're gonna be here for a while. [02:44:07 --> 02:44:10] It's time to hunker down, that's what I'm gonna tell you. [02:44:10 --> 02:44:13] And then last, you know, there's a blanket out of the bunch, [02:44:13 --> 02:44:15] but if a developer violates environmental [02:44:15 --> 02:44:17] or public safety conditions, [02:44:17 --> 02:44:19] which agency can restrict operations, [02:44:19 --> 02:44:22] suspend permits, or impose penalties? [02:44:22 --> 02:44:26] And will the county identify those enforcement mechanisms [02:44:26 --> 02:44:28] before approval? [02:44:28 --> 02:44:30] You know, because when do we go to after, [02:44:30 --> 02:44:32] when do we complain, when do we say, [02:44:32 --> 02:44:34] who's gonna do this stuff? [02:44:34 --> 02:44:42] You know, so it's, yeah, it's, there's a big, there's a big play to bring. [02:44:42 --> 02:44:56] So now when we come to member reports or announcements. [02:44:56 --> 02:45:02] I do think that we need them more in Toran to be in place so we can get to a better place. [02:45:02 --> 02:45:09] And some of these legislative pieces can be fleshed out better if we have no time. [02:45:09 --> 02:45:16] this constraint, we're no way, I think he's done in January, but it does say a caveat [02:45:17 --> 02:45:22] has reasonable, it looks like reasonable as well, nothing to throw it in January. [02:45:22 --> 02:45:33] Just to let you know, Mike and I attended the League of Cities annual meeting this week, [02:45:33 --> 02:45:38] and data centers was a big topic amongst the cities in California. [02:45:38 --> 02:45:47] I did hear one presentation where Google is experimenting with prototype servers being [02:45:47 --> 02:45:48] sent into orbit. [02:45:48 --> 02:45:53] And if that works, they have been accosted and sent them up there in mass. [02:45:53 --> 02:45:56] I mean, I would resolve water problems. [02:45:56 --> 02:45:58] It's going to make everybody kind of lose. [02:45:58 --> 02:46:03] But I just say that just to let you know that technology is moving quickly. [02:46:03 --> 02:46:07] and the developers are knowing the struggles that we have [02:46:07 --> 02:46:09] and the issues that we have, [02:46:09 --> 02:46:12] and they're trying to change their technology [02:46:12 --> 02:46:15] to address the reality of the ground. [02:46:15 --> 02:46:18] So I think we're right in the middle of it, [02:46:18 --> 02:46:27] and I think we're having a great opportunity to tackle it. [02:46:27 --> 02:46:31] I know China is now putting in the scene [02:46:31 --> 02:46:35] and seeing that it will help with the water usage. [02:46:35 --> 02:46:38] I don't know if the salinization impacts, [02:46:38 --> 02:46:43] But if we do establish a delegation to visit data centers, [02:46:43 --> 02:46:44] I would love to be a part. [02:46:44 --> 02:46:46] I don't know if this is a conversation [02:46:46 --> 02:46:48] we will continue in the future. [02:46:50 --> 02:46:52] And then when you open up the motions, [02:46:52 --> 02:46:53] I'll motion you to adjourn. [02:46:53 --> 02:46:55] Oh, great, okay. [02:46:55 --> 02:46:57] Any other last comments? [02:46:57 --> 02:47:02] Yes, Angel. [02:47:02 --> 02:47:04] Yes, just a bit, so just maybe [02:47:04 --> 02:47:06] we can't express the kind of style that shows [02:47:06 --> 02:47:09] which item that we're on during meetings, [02:47:09 --> 02:47:12] because it makes a folks audience. [02:47:12 --> 02:47:14] We're on a agenda. [02:47:14 --> 02:47:25] And maybe in the future, just to talk about what we're going to be talking about and whether there's any action or no or no item. [02:47:25 --> 02:47:31] Also, do we need to speak to the microphones? [02:47:31 --> 02:47:37] Are we picking up our audio or are we going to take the purposes of this interview? [02:47:37 --> 02:47:44] I think the visual aid would be supportive to follow up the agenda as well as a shorter description. [02:48:17 --> 02:48:19] public set out and helpful as well in the agenda. [02:48:19 --> 02:48:27] So I'll be sure to make our agenda more teacher oriented. [02:48:27 --> 02:48:30] I mean obviously, I'm just thinking, [02:48:30 --> 02:48:32] because I was comparing with Mike when he said, [02:48:32 --> 02:48:35] like obviously I think we're all in agreement [02:48:35 --> 02:48:37] that the county is to put some sort of stuff [02:48:37 --> 02:48:38] and it is needed because we all are here [02:48:38 --> 02:48:41] because it wasn't one of which place. [02:48:41 --> 02:48:46] I'm just wondering if it's possible to, as a committee, [02:48:47 --> 02:48:50] send a letter of support to, as a recommendation [02:48:50 --> 02:48:53] to the county to adopt the moratorium. [02:48:53 --> 02:48:54] I don't even know that. [02:48:54 --> 02:48:55] We simply not. [02:48:55 --> 02:48:58] I'm looking at the resolution established [02:48:58 --> 02:49:01] by the county board of supervisors. [02:49:01 --> 02:49:02] It kind of does open that ability [02:49:02 --> 02:49:04] that we can record a congregation. [02:49:04 --> 02:49:05] Yeah, so I'm just thinking. [02:49:05 --> 02:49:07] Before they meet that. [02:49:07 --> 02:49:08] Yeah, because I'm looking at the county, [02:49:08 --> 02:49:11] I was like, I mean, it would kind of make sense, right? [02:49:11 --> 02:49:20] Is it too many years or more? [02:49:20 --> 02:49:23] Yeah, I think that's a good point. [02:49:23 --> 02:49:25] I mean, the committee was established [02:49:25 --> 02:49:27] alongside the moratorium. [02:49:27 --> 02:49:30] kind of one together. [02:49:30 --> 02:49:31] Um, or is it? [02:49:31 --> 02:49:36] It has turned in my day before to the clock or something. [02:49:36 --> 02:49:37] What? [02:49:37 --> 02:49:38] That's a question. [02:49:38 --> 02:49:44] It's a public hearing on a six. [02:49:44 --> 02:49:54] Um, and our council here is one of the staff asking questions that Tuesday, October 6th. [02:49:54 --> 02:49:57] So we meet on Monday and then we watch all day. [02:49:57 --> 02:50:01] but we meet on Monday and then we can vote on that [02:50:01 --> 02:50:03] to provide a resolution. [02:50:03 --> 02:50:05] Because you're gonna have the cameras [02:50:05 --> 02:50:15] over your present at the moment. [02:50:15 --> 02:50:16] It's hard to hear. [02:50:16 --> 02:50:21] Well, yes, so we're discussing that if at the upcoming [02:50:21 --> 02:50:23] October the 6th, for the supervisor meeting [02:50:23 --> 02:50:25] where the moratorium will be discussed, [02:50:25 --> 02:50:27] if at our next meeting, us as the committee [02:50:27 --> 02:50:31] put forth a resolution in support of the moratorium, [02:50:31 --> 02:50:35] we have that timeframe because we're meeting next Monday. [02:50:35 --> 02:50:42] be plenty of time before the October 6 meeting and that would be something that myself or [02:50:42 --> 02:50:47] maybe one of the other things that your committee here can attend and give those comments in [02:50:47 --> 02:50:51] person. So that would be acceptable. [02:50:51 --> 02:51:09] If there's a letter support or anything like that in the committee it goes, we should [02:51:09 --> 02:51:14] be able to advise you. The board is super-reserviced. It has to be the board is super-reserviced [02:51:14 --> 02:51:17] and then you guys can sign your letter. [02:51:17 --> 02:51:20] That's how we do it with all the advisory committees, [02:51:20 --> 02:51:24] but I will talk to council tomorrow [02:51:24 --> 02:51:26] and work with that information [02:51:26 --> 02:51:32] and it's doable and I can discuss it tomorrow. [02:51:32 --> 02:51:35] So we have a path forward to support the work for you. [02:51:35 --> 02:51:38] So on Marnexine is just to adjourn the meeting. [02:51:38 --> 02:51:39] Michael? [02:51:39 --> 02:51:39] We have a motion. [02:51:39 --> 02:51:40] Second. [02:51:40 --> 02:51:42] Oh, could I have a second? [02:51:42 --> 02:51:43] One second. [02:51:43 --> 02:51:48] Before just for my logistics, I'm posting to the agenda. [02:51:48 --> 02:51:49] Do we have a location? [02:51:49 --> 02:51:51] Or are we going to stay here? [02:51:51 --> 02:51:52] You want to stay here to talk to her next? [02:51:52 --> 02:51:53] Yeah. [02:51:53 --> 02:51:54] Yes. [02:51:54 --> 02:52:00] Can you talk to the item that you say we can? [02:52:00 --> 02:52:02] Can't hear. [02:52:02 --> 02:52:03] Oh yes. [02:52:03 --> 02:52:05] So we're discussing a potential location [02:52:05 --> 02:52:06] for another meeting. [02:52:06 --> 02:52:09] It could take place at privacy. [02:52:09 --> 02:52:11] That's what my kid's referring to. [02:52:11 --> 02:52:13] But we did not return on a location change. [02:52:13 --> 02:52:16] So our next meeting will take place. [02:52:16 --> 02:52:18] I have a verified available. [02:52:18 --> 02:52:19] Yeah, we'll be here. [02:52:19 --> 02:52:21] But future meetings, we can discuss [02:52:21 --> 02:52:24] in the elsewhere IDC. [02:52:24 --> 02:52:28] So I think now we are going to motion to adjourn, Michael.
